How is he being slippery? I don't see it. What he said is true...if the defense can submit exhibits during the prosecutions case, it will speed up the whole trial. If not, they will have to recall all of the witnesses. It's not like he is asking to submit stuff that he wouldn't be allowed to during the defense portion.

What happened?

Near as I can tell, Kurtz wants to admit stipulated exhibits and evidence during cross of Ms. Duncan. This means the defense wants to introduce evidence during the State's case in cheif. DA objecting because he does not know what in particular Kurtz will introduce nor if it is relevant to Ms. Duncan.



Jury is to be back at 2pm eastern.

Kurtz is putting on his chapstick :D

Judge to inquire of Brad if he understands and agrees to what Mr. Kurtz is proposing to do.

Interesting strategy - working to use already agreed / self authenticating evidence to negate the testimony of the prosecutions' witnesses as they appear. Or at least use the timely introduction of evidence to create reasonable doubt.

HOLY COW - they are willing to give up the last word to the jury?????????

Seems a bit risky doesn't it ?

Brad says it is his decision to do so, so he tells the judge. Judge says he understands Brad is willing to waive some of his legal rights by doing this.

The prosecution always get to make the final word to the jury. Since the burden is on them they make final statements (closing arguments). They go first, then defense does their closing, then the prosecution gets the final words in during closing arguments.

uh oh a juror has just received some bad news, death in the family. Trying to figure what to do.

Judge to talk with juror - turned off the media broadcast for this.

The timing of the evidence introduction seems like a big deal..... so it has to be something and the judge was very specific in the statement that he would be waiving the last word, or words to that effect.

If JTF is right - then it would be a brilliant move.

Ohhhh. Brilliant move? To not have an opportunity to address the jury at the end? I dunno.

I guess anything is possible.

This case and it's presentation has me feeling very unsure, frankly. I can't put my finger on it exactly, but something doesn't feel right to me.

Well. This is early into the trial and if this juror has a death in the family (grandmother), maybe the judge can just appoint an alternete to take that jurors' place. I would like to see the trial go on uninterrupted. JMO

*So sorry for the juror and the passing of his/her grandmother.

I don't think there was any doubt Kurtz was going to present a case and call witnesses (hopefully not 200+). What he is doing now, just seals it for sure.
The state will get the final closing to the jury.

Just lets us know he will call witnesses and thus, will not get the last say to the jury
