When Officer Hays first met BC on Saturday afternoon, his first impression was that he "looked tired"

So, Mr. Ironman gets fatigued in one day of playing Mr. Mom? Well, you have to understand that he had been pretty busy that day.

So, you're wife is missing and you don't return or answer calls from LE? Why not?

I guess he checked his VM at some point because he did drive home! (therefore I guess he does know how to use the VM system on his cell phone).

Dunno - Officer Hayes called him again at 3 pm after not getting a response to his 2:36 call. Spoke with him for 42 seconds - Brad said he was in the Regency area.

Ouch - head to the table, no calling for Nancy or looking when entered house but did so when prompted by Officer Hayes.

I bet Hayes was waiting to see/say that about checking the house... very good.

He could see if he did, prompt him to, then see how he does react.

So as of 5:30am they find out they are out of milk...for a baby who is still on a bottle.

So what time would her LAST bottle have been the night before? And why didn't they/he notice then that they were "out of milk?"

Brad did look extremely tired the morning he made a statement on TV. Remember, that is when he had on the long sleeved shirt, with a tshirt underneath it, and the CISCO ball cap. His whole demeanor was way off. I doubt he'd ever wear a long sleeved shirt like that in summer. That's where we remember that at this time, he should have had the scratch marks on him.

Now, as to the running shoes. Remember when the police took shoes from the garage? They took two pairs, from what I remember. But weren't the shoes mixed up (as to their mate)? It's hard remembering this, but my memories come from the lists of things removed from the house, and something else in the docs.

There's something strange that they brought up about the shoes not matching (that maybe Brad put on her when he ---allegedly---dumped her in the woods.

Anyone who can get their hands on that one?

And, I remember Brad stating that "Nancy had more recently started wearing Sauconys". I remember reading that too.

eta: sure Brad looked tired. He'd stayed up all day the day before (party day), all night "tending to things" and tending to kids that he was not accustomed to tending to, and he would have been overwhelmed with cleaning, shopping, planning alibis, a dead wife, where to dump her, washing clothes, doing floors. Oh my. Even an Ironman would be mentally and physically exhausted. Right?

Her cell phone was *in the drawer* of the front hall credenza?

Hmmmm....

ETA: NOTE the ADA asked this TWICE!

SO,

According to Officer Hays testimony, BC said he was concerned when NC did not return by 9AM.

I can't say for them, but if I am trying to contact my wife, I make repeated calls to her cell phone. Even if the calls do not connect, there would be a clear record of my making them.

Now, you may say that he knew she did not have her cell with her, but he supposedly just calls up to cancel the tennis game? No attempt to see if she is just in the coffee shop?

Nancy's cell phone was found in a drawer of the table near the front door. Brad took the phone out of the drawer and handed it to Officer Hayes.

Officer Hayes also reported seeing a jogger on Lochmere running in the bike lane - light blue jogging outfit. This when he first came on duty.

Brad's answers thoughtful, did not get a sense Brad was upset when talking to him. So says Officer Hayes. Did not smell cleaner but noted it in the bathroom.

Yes, 1 pair found with the same 'footed' shoes IIRC.

I thought the officer found two ASICS without their mates (like 2 left shoes or 2 right shoes) in the garage.

I will say this again: I occasionally still see a woman running in Lochmere who looks just like Nancy Cooper. It's not unusual: long brown hair in a pony tail, long lean slim body in m otion. From the distance of being the driver (the speed limit on Lochmere Dr. is 35, never more than 40 if I recall) where I've seen this woman.

It's just easy for some women to resemble others. You'd have to stop the car and check her out to see the differences.

As to that lady who swears she saw NC running that day, from 10 ft. or so away: Did that woman KNOW NC? I don't think so. If it was my mom telling police, my mom thinks everyone with brown hair and a pony tail looks alike, and thinks every say, brown pick up truck looks alike. She does NOT notice details. I don't see how this woman can be so sure she saw NC that day, esp. when I still see the "clone" runner who looks like NC to this day.

I mean, if you really want entertainment, hang out on Lochmere Dr. and you can see WRAL TVs Am. Lamb walking her dog, as well as WRAL's B. Leslie (running in hot weather with his shirt off). You'd only notice them if you knew them. Most everyone blends in on the sidewalks, some wearing their hair in a pony tail, or a hat, or fresh out of bed looking like it.

Evidence entry issues again. Judge does not like cutting corners or taking shortcuts. Says previous argumment was only about stipulated evidence, nothing else. Objection sustained. Admit evidence during defense case not during the state's case in chief.

While the jury is out for a moment, could I ask a question?

Can anyone tell me what is the lady, who is sitting in front of the witness typing etc., holding up to her face? What is that thingy?

Officer Hayes was apparently on patrol in Lochmere at 7am when he saw the jogger in the bike lane on Lochmere Drive. Interesting.

Says he does not believe anyone slept in the bed in the picture being shown by Kurtz. Sheets are too smooth for having been slept on. Someone sat on the edge but does not look like anyone slept in it.

Kurtz isn't gonna be happy about that one...moving on to outside activities now is Mr. Kurtz.

That is the court reporter. She's holding a mask to her face that she whispers into questions and answers that go on a tape to assist her when she prepares the court record of the testimony.

I think the defense just muffed it pretty badly.

Bringing up the jogger, when it is a known jogging area. Given the reports of a similar looking person still living in the area, etc. They are looking a bit like they are blundering at this point.

It is going to be a pretty sad case if the defense has to stay outside the house to keep from getting wrapped around the axle.
