Perhaps the new debate should be, was it pre-planned vs heat of the moment after a 'hate Brad' day?

IF you freeze frame that at 1021 you will see exactly what I am referring to on his right shoe..outer aspect near toe of shoe...I dont know how to capture a pic of it..sorry..

I see what you are talking...but that picture is so blurry/grainy that it could be a shadow. It's impossible to know what that is. If it were mud, I would not expect it in that location on the shoe, but would expect it everywhere on the bottom of the shoe.

No folding done at all..it was jammed into that Home Depot bag..and I'll just bet he planned on dumping the whole bag..but got side tracked with JA calling him and Police getting involved...

Drop cloth was not needed to wrap body..only to protect interior of vehicle.

Actually, from the video, it looks like the dropcloth bag was unopened. It is sitting in a bag full of other HD bags.

While I was looking for the picture of the shoes, I ran across the plastic drop cloth in the HD bag as well. It's here at about 9:14 on the video.

In the depositions it seemed Brad took every opportunity to diminish Nancy as a wife. He tried to make himself look like the dutiful husband. He really evoked no sympathy for Nancy and it came across in the depos.

Can you be more specific? I didn't catch him diminishing her at all. He talked about all the things he provided for her over the years, many of those things we know as fact..car, jewelry, paintings.

Fair enough.

On the issue of the dropcloth, Brad would know full well not to dispose of it having bought it a day earlier. I'm not convinced he used it either. The testimony about its condition has been too vague so far. I don't see Brad buying a tool to conceal murder one day, knowing police would be finding out, and then it going missing.

As for the shoes, he's not infallibly thorough and this strikes me more as an unplanned oversight.

And it is this downplaying in the testimony (quoted above) that makes me think we're going to here more on this, either from cross or from other witnesses.

Actually, he paid in cash, so the only way they knew about this was from the receipt. So if he bought it to use as part of the murder, I don't think he would have kept the receipt.

No, but I was expecting that they would have. The omission of the question in direct examination is why I'm still hedged on this, but the missing shoes immediately cast major suspicion.

However Det. Young was asked IF they were ever able to recover those shoes??..and He said NO..at least that is what I recall..:maddening:

Well well well, it appears Brad is indeed a list maker..seems he had a todo list in his office??

Yeah, you're right! And that MBA of his may have come in handy. He had a lot of plans to make....

I hope so, because I hate these innuendos and vague answers we get on some things.

Has there been any testimony if LE asked BC where those shoes were and what the answer was?

No. JY simply said the police didn't recover them. No other questions about what that meant.

I stand corrected...however, they still look like a casual canvas shoe of some sort.

Thanks for doing that! Just saw the discussion of the shoe and I didn't remember it that way so I had to go look. Didn't know if it was my screen or what. Wanted others to look at it. I was looking at the sole and the profile of the shoe (what you can see of it anyways) and it just didn't look like a boat shoe to me.

That's what I see as well. I feel like I'm seeing the clear folded up drop cloth, still in its packaging, sitting on top of tan colored plastic shopping bags.

Oh wait just a minute.

That's ANOTHER thing that was inconsistent with how Nancy was when she was running.

When her body was found her hair was not tied back, not in a ponytail, no ponytail holder found, and there was no ballcap either!

Add these to the list of 'souvenirs' the Hawaiian/Mexican/Mormon/DrugCartel/WiFiStealing/VanDriving/ConstructionCanibals took, along with her 2 left shoes, shorts, socks, and Tshirt.

And I'll bet they killed her, too!!!!!!!!!!!!!!!

But you make a very fine point here, SG -- good thinkin' and thx.

Here's the issue - it's not the drop cloth - it's the start of the deception.

I think that he made the statement about his Friday AM activities and them getting along prior to her body being found, correct?

WHY lie about that? WHY be deceptive? IMO- you do that to move suspicion away from you - and why do you need to move suspicion? Because you KNOW you have something to hide.

Confirming the state of their marriage would be pretty easy. Both were talking to attorneys (or at least trying to do so), neighbors were WELL AWARE, heck lists were being made about assets, etc. So why lie? Again - you do it to make yourself look better.

If she was just missing - who cares if you hated her? She'd turn up eventually and you'd continue on with your divorce.

If it were me - and something happened to my ex when we were going through nasty divorce - I'd SAY SO if he were missing. Even though I know it would put me in a less sympathetic light - WHO CARES???? since I would not be worried because I had nothing to do with his disappearance. And - then I would not have to act sad that he was gone (I know - not nice, but neither was he) And - since I would have no idea what happened to him - WHY LIE? And I would be assuming he was MISSING - not DEAD.... since I would have no firsthand information....

IMO he lied to buy time and make himself look better. He lied to shift suspicion. Again - you only shift suspicion if you know this is a murder and not that she's out getting a manicure or stiffing you on your tennis match and leaving you with the kids.

Why lie about the state of their marriage? It only made his mannerisms look weirder when his "loving wide" was missing. If he had been honest, his detached attitude would have been NORMAL.... like - he'd already mentally divorced her and he wasn't in love with her, etc. People feel like that when they are in the middle of things. But no - he said they were all peaches and cream.

And that's where the lies started.

I do have to disagree there..why in the heck would an upopened drop cloth be placed in a bag of garbage or trash..Wouldnt it be put somewhere to be used for some sort of job?...No..its just the wrapper of the cloth thrown ontop of the scrunched up plastic drop cloth..ready for disposal..obviously didnt get disposed of tho..

Brad may be intelligent..but organized in household , everyday functioning he is definately NOT!! IMOO

I don't think that was ever in question.
The jury saw it was still in the original packaging.

....and those diamond earrings.
BTW, those looked like full karat.....$$$$

Well, removing those earrings was one thing our BC should have put on his list -- even if he didn't want them (although he had her necklace) he should have at least removed them. And they were large enough for any idiot band of Marauders (even those who live in Cary) would notice... And didn't Carrie say NC never ran in jewelry?? But I could be mistaken on this.
