Not really. He did say he wasn't sure, may have run some other errands. He was vague but didn't outright lie, just evaded the question. I think anyone in that situation would do the same thing. This doesn't raise my suspicions of him bc he did leave the receipt in the car and he had just purchased other paints and supplies for NC and the drop cloth was never opened so it's a non-issue.

It seems like those in the "guilty" category are angry about others trying to be objective about the evidence and I wish I could understand that. I have a science background, worked as a chemist for many years and I think it's my instinct to look at everything with an open mind and scrutinize everything as thoroughly as possible.

It's a good observation. I think for many (most?), there is a tendency to "weight/process" new facts/evidence against the already formed opinions. Things that support the opinion are emphasized, things that do not are minimized (consciously, or unconsciously), this is what happens... it just does.

Some of this is human nature I think and the way we (as individuals) are 'wired' It actually takes a great deal of effort - (probably almost constant) to stay purely objective (in this matter and pretty much any other matter where there's some degree of empathy/resonance and potential for emotion).

Just MO...but it's also part of the reason the guidance from the judge to the jurors is to not only refrain from talking about the case, but to refrain from a rush to judgement until seeing all the evidence, from both sides. [ Prosecution has a (slight) advantage here in that if they can bias the jurors to have a filter by the time the defense comes on board... it helps them... defense has advantage in that they get to go last... maybe it balances...]

That said, while there's a lot of folks on the board who's 'intuition'/gut thinks he did it (perhaps for good reason, and general stats back that up no doubt), there's also definitely a lot (like yourself) who are trying to keep it scientifically balanced until proven, focusing only on the facts/evidence.

Based on the evidence/testimony given to date, and posts on the board, I'd still be surprised if a significant number would/could honestly return G 'beyond a reasonable doubt' if on the jury today. [Obviously there's a lot more to come though, and we shall see to what extent that changes when the prosecution rests. (later this week?) ]

Brad would have been better off if he had done nothing to try to create an alibi for himself. If he had made only 1 trip to the store. If he didn't try to use phone calls to try and prove Nancy was alive. If he didn't talk about all his cleaning. If he never mentioned he was up at/around 4:30am.

The state would not have had much on him if he simply said, "I didn't see her leave, I didn't know what she was wearing cause I didn't see her. We didn't discuss her early morning plans."

But why the need to evade the question if innocent? I wouldn't evade it. I would tell the truth and I think people can sense when people are willing to do that and have nothing to hide.

LIE by omission....not telling the detective. What would be the big deal for him to say ..yeah after helping Nancy, I was late but stopped by Lowes. He blamed Nancy for his being late.....so he was aware of what he did that morning. The detective found the receipt...that is how he knew Brad went, not by Brad. So he lied by omission to me and I hope we find out why he felt the need to lie about that purchase. I'm sure there is more for them to bring this into the trial. We shall see either way soon.

I have not listened to the whole testimony today so I am missing the whole discussion about being late to work. I know many people that work at Cisco and there is no such thing as being late to work unless it is for some type of team meeting. Everything else is done via conference calls and as long as you have a cell phone you have to ability to be on time.

People who are on the fence are not ABBs! They have been great contributors to the discussion. Fair-minded in most cases! No one's talking about fencers, golly. They see points on both sides.

I see people who are truly on the fence finding positives and negatives on both sides. That's why it's called a fence. There are a few here who see everything the prosecution does as being wrong and are all pro-Brad and some that see everything as anti-Brad. Most of the true fence-sitters don't seem to say much. MOO

He bought at Lowes and left w/o a bag.
It was seen laying in a HD bag, within a 5 gallon bucket

Thank you for pulling all that out. I have not been able to watch anything due to buffering today, was a rough day for my obsession.

Try to watch it on the WRAL site tonight. Somedays, if I've done alot of sufferin' from the bufferin', it'll work flawlessly when they post it later.

Good luck...I know how it is to have an obsession:)

I have another theory on that if he is guilty:

He made the first trip to HT and some of the locals have indicated that the first trip would have taken him close to the site where NC was found. Either he did dump her then or was checking for police activity. The next trip was fairly quick. If he set up a call to make it seem like she was still alive, he would be nailed if a body was found before the call was made. So the time was very, VERY limited, just in case. I am anxious to hear from the real phone experts now that the foundation has been laid.

It matters because he never mentioned it. His beer run to Lowes Food before the barbeque would have been a quick trip I would imagine, and he didn't forget that one.

Then almost 3 months later in custody depositions he is asked about errands on 7/11, he hedges his bets and says (paraphrasing) "maybe. It's possible. I don't remember." He knows good and well were he was that Friday and he knows better than to turn Alice Stubbs loose on that information, on camera.

Brad is many things, but stupid he is not.

Their financial situation was not the workings of an intelligent person. I don't believe their financial situation was all due to NC either.

Bottom line is that he lied about going to Lowes that morning...To me it shows a guilty conscience. Not sure why he bought that drop cloth yet. I think we all need to remember that the evidence is still in the foundation and getting introduced phase in this trial. We know he went there now and didn't tell the cops but rather blamed Nancy's inept skills as his reason for being late. Such a helper that Brad.

If it was a lie, it was a lie by omission. I sure do hope they run out of foundation before they run out of witnesses.

Thanks, yes I have been listening to it tonight, so far on part 3, its just so much to listen to and reading the board to catch up, its a full time job!
