IIRC Nancy's Family did not want it..Being Canadian maybe, or maybe because the children is living with Nancy;s family.. Either way, it was never really a priority...Most DP have a protocol for seeking DP..Just a depraved murder doesnt cut it..There has to be more than one of the criteria ..such as multiple murders is one..particular malicous or heinousness of the crime, if the victim was a LE officer in the line of duty, ..I have tried to Google the actual criteria to no avail..sorry cant be more helpful :waitasec:..

IIRC a Plea Deal was offered to Brad in order toavoid a trial and put the families thru all this ugliness!! But Brad and his council refused it..So here we sit seeing and hearing all this dirty laundry ( Sorry, not trying to be funny :-(( )

But the bottomline is the victims's family were not wanting that and most Prosecutors follow those wishes..LWOP would be sufficient..:seeya:

I bet they regret not taking the plea deal.

Two things haunted me all along in this trial: One was NC looking at home from the party that night to see if the lights were out. It seemed that she was waiting for everyone to be asleep. The second was the realtor's call that she needed to move quickly on getting a new place. Piecing them together with the testimony today makes good sense. NC obviously realized things were escalating past the point that she could handle. As was pointed out, how tragic she didn't move on her instincts faster and get out of there.

Do you (or anyone) remember the date of the email exchange between herself and a former boyfriend in Canada when he asked her if she was safe and she answered yes, the "he" was just really mad and he would get over it? I know it was in the testimony that has been blacked out to us.

Thanks. I'm going to go back and listen to her testimony because HP never mentioned there was another person for lunch, just that NC picked up lunch for them and the kids.

It was the friend, the social worker lady who testified she was at lunch with NC, was not in HP's testimony. So check hers out. Don't waste time on HP's.. :) too much testimony to be looking in the wrong place :)

So since the trial is not actually over yet, I am still trying to reconcile things in my head that just don't add up.

Apparently NC, JA, HP & SC had lunch together on Friday. She was all fired up, hating BC, stressed out, fed up, etc. then why does she not even mention to them talking to the Realtor about moving out soon?

I know. These loose ends are the reason I was so convinced of his innocence. That and the lack of evidence and the state providing days and days of non-evidence.

I still wonder why she never told anyone BUT the RE agent of her plans to move ASAP and coming into money soon. Very, very strange. And no one knows where she was getting the money.

And now BC, a Cisco engineer doing something so foolish just seems so hard to comprehend. I still think there is a chance he looked at the site on the 15th, after she was found to see where it was and the date was changed but we'll see.

How many cases have there been where computer evidence nails the criminal? That's why all along when people suggested the Fielding drive searches I dismissed it because no one would be that stupid.

Also, I still wonder about the phone call. I think a live person made that call.

But, I thought the state had to let defense know everything they had on the defendant so they could make an informed decision on a plea. Do you think Kurtz didn't know about the Fielding Drive searches? IF he did and still didn't take the plea, they must have something strong to counter it. IMO

Aweee cody, you truly have moved over to the G side of things..Welcome aboard...:seeya: Many of us fallen of the fencers have felt this exact the same, based on bits and pieces and especially Brad's behaviors and attitudes..but to actually have that search which proves something to link alot of those bitty pieces have only validated our previous notions, and seems to have been enough to give you pause.. :applause::hug:

I think she felt something those last few days. She agreed to call Interact, called the realtor, and her friends worries were growing. JA panicked quickly, as did H, sorry, can't remember her last name/initial right now. Krista said 'what did you do to her?' And dad said 'this isn't going to have a happy ending.'

She did not agree to call InterAct, she did not tell anybody she spoke with the realtor or even that she was thinking of maybe moving out sooner than later, JA called the police and pointed the finger at BC, her story is inconsistent in multiple places, she got in contact with everybody else and surely got their emotions whipped up into a frenzy as well.

Great book written by Gavin DeBecker called "Gift of Fear". People should pay attention to the instincts.

Oh yes, remarkable book. Also, "Protecting the Gift" - about protecting your kids. What an eye opener. And scary as all heck.

THanks, Lyndy Loo. I was on the fence, I will admit, mainly because it was a very bizarre trial to me. I know many of you have said the same thing too. And, I was looking for a piece of concrete evidence to put these other pieces together. Unless we find something that shatters this new piece of evidence (which I doubt happening).

Ok...the other Cisco guy stated that they were at the restaurant (Two guys and a Girl)at 1:00 on July 11. I am sure the defense will bring this up. I also have that he was reading her email at 1:00 as well. So they must have left for the restaurant shortly after. Pre - Meditation now!

I have not been watching the trial the entire time - when was the testimony about July 11th lunch?

Good observations.
I am thinking that perhaps she didn't realize until that very night that her life may be in danger. I know I've said that before but the more I think about how she kept peering out of DD's window the more I think she was feeling fear for the first time.

While I agree today was a bad day for the defense, the trial isn't over yet either. The defense still has to present it's case and the jury still has to decide. Stranger things have happened in trials before.

Or maybe the plea deal was offered prior to all of the computer evidence coming in? I can't remember when it was finished but I am thinking it was late in 2010.

It was last week. A coworker was on the stand - he went to lunch with BC and 3 other engineers. Said BC took a cell phone call away from the table of guys at lunch. He went outside for a long period to talk on the phone and it struck the coworker as odd since they don't lunch frequently.
