June 2009 assessment isnt documented...hummmmm Not to good..Wonder why he didnt bring it to court that ??? His report however reflects what Kurtz told him tho.... I think Boz is showing this investigation as not fully documented for his testimony today...Those pictures showing his manipulations of that phone were done Sept. 2010....

It could be suggested by Boz that the sim card got wiped or deleted by his testings//but we have no proof either way?? hummmmm

He's a bully and the jury has a front row seat to all this. I would not be surprised if there is a juror or two is offended by his behavior regardless of what he gets a witness to admit.

There is a lot to be said for how respectful Kurtz has treated all the witnesses.

You do understand the meaning of *cross* examination, don't you? Have you listened to or viewed any other trials? Do you recall the questioning of, oh say Johnny Cochran or F.Lee Bailey at the O.J. trial?

BZ is badgering this witness at this point, I am not sure why Kurtzis not objecting, the questions have been asked and answered numerous times now on the same subject. Also, this witness would not turn anything over to the State, he would hand it to the Defense and the Defense would give it to the state. BZ does not make himself look good by treating every Defense witness as if they were hostile.

I'm an attorney myself, thanks for asking. I've plenty experience to know that the way BZ handles defense witnesses is turning some of the jurors off. Maybe even to the point that some are tuning him out.

Yes, most definitely. And I have been in court many times as expert witness. I bet some jurors don't like it. His tactics work on some jurors but not all of them.

Which indicates the phone was likely deleted even prior to LE taking it into evidence...This guy testified that it takes 2 rounds in order to delete both phone data and sim card data..and Det. Young only did one round ..then stopped and sent it for forensics....sooo how did sim get deleted too??.. I think Brad already did one round of deletions..IMO

BZ giving the witness a platform to explain to the jury that phone records it (state) provided are billing records, not "best evidence" forensic records that phone companies can provide to LE. Witness cannot even authenticate State's phone records... point for defense.

BZ better be careful with this line of questioning, the Defense has already made a point in one of their declarations before the trial started that because Young waited so long on letting them know that he zapped the phone that it was too late to get the detailed call history of NCs phone. They also made point that the cell tower information was not in NCs phone records that they were provided but that CPD made sure that BCs phone records did contain that information. That indicates to me, that CPD waited too long to also request the carrier send NCs records, which tells me they did not either want that information in evidence, or that they did not look at anyone else than BC.

On CourtTV? Yes, many years ago. That trial was theater. In real life you are to be respectful. Since you are so interested in all this you should inquire about sitting in on some trial court classes at a law school. It may be truly revelatory for you.

I do not think Boz is bullying or badgering this witness. He's trying to get clear answers. His MO is more aggressive than the other central lawyers in this trial.
While I am not a fan of H. Kurtz, I will have to admit he's been very gracious and has displayed excellent manners since day one of this trial.
