Am I on everyone's ignore? Did the defense or the pros. for that matter ever request NC's cell phone records?

Ok, so I've sat here most of the day eating jelly beans and peeps so I am not at a full functioning level.

Has the witness really testified about anything "really" important? I know he is stating the phone was not handled properly...... But nothing really concrete, right?

Yes, the reallllllllllllly important stuff is that this phone was wiped clean by a police officer, and that this is unheard of in the 10 years that this type of evidence has been accepted in court.

It does appear that Kurtz turned over selected reports and with held those that were NOT helpful to his agenda??? Does not look good...I am sure the State can prove exactly when these reports were turned over to defense...

I believe that the Defense never received those records during discovery and the Defense filed repeated requests for these records over more than two years.

The important information was stored on the phone. That information is not available.

This guy just said he has NEVER seen any cell phone been totally wiped out before....hummmm Has he had expert computer defendent as his client before?? Is it possible Brad did something to the phone that caused LE to wipe it completely?...Pleeze Boz ask that question....Pleeze......

Now that could be a Perry Mason moment!

I honestly don't know. I would think they did but don't know for sure. I'm very, very confused right now. Hopefully somebody else can help.

It sounds like they requested/received billing records but not call detail records which would have given them much more info about the calls (e.g. cell tower).

Anyone else noticed WRAL has seriously shortened their timeout time for the streaming? Not appreciated, especially when I'm not near my PC. I'm now carrying a stopwatch timer around my neck so I can catch it in time.

This is substantial, now on redirect witness asserts that phone was not totally wiped as of 9/29/08 (had to have some info on the card in order to connect to cell tower as it did 9/29)...thus Det. Young statement that is was wiped 8/9/08 is not true.

Uh oh, he's upset because he wasn't given a piece of discovery when he requested it from Kurtz. Now Kurtz said it was provided later.

Well, then, IMHO, Kurtz should have sent it to the expert when they got it.

JMHO
fran

How do you know they didn't? There has been quite a delay in Pros sending discovery to Defense, they even went to court about it a couple of times.

I remember when Johnston county had big time moonshine business.

We've only been 'country people' for a few years now. But we love it. :seeya: Nice and peaceful out here. But then we are pretty remote and on a dead end road, off a farmers gravel road. Other than the road we live on, we don't get much outside contact. We have far more animal neighbors than human ones. :great:

He's never had a situation like this before because BC is an electronic Wiz Kid!!!

Yes, between the last computer guy(JW?) saying that Brad has a higher certificate of expertise at Cisco than him....which by the way I thought was priceless, that their expert witness had a lesser certification, and now this witness saying I have never seen this before...... appears that Brad has stumped all the defense witnesses.......or the cops are corrupt and framed him?????? :waitasec:

They did get her call records from AT&T..but was unable to retrieve any texts IF there were any..and the wiping deleted all other data including contact list..This witness is complaning that the call list was the right one he wanted...However I do recall the call logs being rather complete..BUT then what do I know??

So far today, knock on wood, they haven't timed me out at all. Last week I was on a 38 minute cycle. Very annoying.

BC was a VOIP expert...not mobile phones. Competely different technology.

I posted earlier asking my hubby about this (he is an expert in the mobile industry), and he said he never heard of a phone accidentally being "wiped" before. His response was the only thing he could think of was "take a sledgehammer to it".

Pros says the CPD detective "accidentally wiped" the phone...very hard to believe that assertion...

Yes this is interesting testimony.

BC was an expert in VOIP, not cell phones. I worked for a phone company for 30 years but I couldn't tell you how to wipe a cell phone.

A number of people posted that they were losing the signal ... now we have a one minute warning before it shuts down.
