What do you characterize 'nekkid kissy face' as? My understanding is the witness, JP, doesn't even know himself if he had sexual intercourse with NC. He does know he had nekkid kissy face with her though. Perhaps you can correct my assumption? I'd ask Nancy for her side, but then she's dead and my mind is foggy today. Not sure my psychic side can get through to reach nancy.

It was a 'sexual encounter'. This is witness testimony, no need for interpretation. You can spin it however you want, it's no different from BC and HM in the closet as far as adultery goes.

Yes, because the State didn't take the time to listen to police interviews with witnesses who they knew would take the stand...we're off camera while they take the court and jury's time to do so.

I mean WTH?! how do you prepare for cross without listening to those?

they haven't heard the redacted version.

sometimes when you change the order of things or remove certain parts, the context changes. they need to hear exactly what the jury will hear.

She got to quite a few men in the area. BC was one of them, though certainly not the last. She was (or maybe still is) with this current witness (JP) as well. Broke up his marriage.

Yes, that's my understanding as well.

It's ok, I do it too cuz I hadn't followed this case too closely this entire time. I watched when it happened, but then lost touch until about 20 days into the trial. So I ask questions the same way you do! Thankfully there are many people here who are well versed on the goings-on in the case and willing to share.

I am finding myself struggling at times to keep the facts separated from the speculation. Somebody asked this morning where NC's diamond necklace was found and I knew it was in a drawer--but couldn't remember where the drawer was, foyer or Brad's room.

I know, these relationships are bizarre, which is why I dubbed it "Swingtown". But I have to disagree on SH being "creepy". I think he's hot, and I cannot believe his wife cheated on hottie with BC. Ewwww!

In BC's depo I remember him saying SH didn't learn about the encounter BC had with HM until about a month before. Meaning a month before the depo was taken, which would mean SH learned about the affair Sept 08. Now we know Mr Cupper lies, but that's what he claimed in his depo. If that's true, or if SH didn't know the full extent as to what happened until after July '08, you can't blame him for being supportive of BC in July 08.

You are correct, and I understand that - my point is that there is nothing in the redacted version that is not in the full version. For Cummings to protest that he has "never listened to that" insinuates he has never listened to the interview.

I'm sorry I thought the defense had not provided the State with a revised redacted transcript and sprung it on them this morning. I guess I misunderstood but anyway, I wanted to hear this as well.

It is what it is. He had a sexual encounter with her. How can BC ever get a fair trial when there are people like you twisting everything around. I mean geez.

In early affidavits, he stated that they were naked on the sofa in Nancy's house but he didn't remember (due to drinking) if there was an actual sexual encounter or not. I have read, too, that Nancy said the same thing before she was killed--no memory. He may say something different today, or in the taped interview, but the 'don't remember' by both is what's showing in the affidavits from early on.

Yeah, where are all the complaints from the brad-crew about yet another late turn-over of defense discovery resulting in yet another long delay?

On the stand, didn't SH testify that he had heard a rumor of his wife being with BC, but it wasn't confirmed until NC went missing?

I could be wrong. It's all very strange indeed.

I haven't been following as closely as some, but I heard Kurtz say this is the exact same situation that the pros put the defense in, except then it was a 6 hour video the night before, and not a 1-hour video. Correct?

yea I mean, he's being overly dramatic by saying he has *never* heard it, because you're right, he has. he just hasn't heard "that version" and I understand him wanting to see/hear exactly what the defense doesn't want the jury to hear.

You are right. They, the defense, just edited the tape last night/this morning per Kurtz and didn't give the edited version to the prosc. until this morning.

I can't believe they let SH off the stand without more questions about what he and Brad talked about after July 12. Yesterday he was asked to characterize BC's behavior in those days and he said "lost". There had to have been conversations. Were they discussions about the girls, funeral plans, time off from Cisco, etc? Why was he not directly asked, "did Brad discuss with you anything that took place on the evening of July11 or the morning of July 12. Let's at least get a definitive statement under oath from this guy. We spent more time hearing from their exterminator than from BC's best friend!

Same Elliott doesn't look like the same person without his mustache. I was shocked when I realized it was The Sam Elliott.
