That was not at all the answer Kurtz was expecting her to give.

I disagree. I think it highlights that there were several calls from people who believed they say her (or someone who matched the description) yet the police never said "Hey. We have a lot of people calling in about this. We need to really look into this." "We need to see if their descriptions/locations matched." "We need to check out the details". No. They didn't bother.

She's pretty solid, saying she kept calling because she was worried she was hurt.

I don't think anyone here is saying they don't believe SHE believes what she's saying. Simply that she has made some errors, like saying the woman was wearing an I-Pod. And that while she only said a very brief HI to this woman, she has a photo-memory of her. Yet the police officers/detectives she'd actually spoken to for longer periods of time, other than Daniels, the black guy, she couldn't pick any of 'em out of a line up. She believes she saw Nancy Cupper that morning. Do I as a juror believe her? Hardly. But I will say I don't believe she should be hung next to HP & McDreamy either though. :great:

Reminds me of the scene from the movie: My Cousin Vinny:

50) Q: Mrs. Reilly, when you saw the defendants, were you wearing your glasses?

A: Yes, I was.

51) Q: Over here, dear. Would you mind putting your glasses on for us, please?

(She puts on her glasses.) Whoa, how long you been wearing glasses?

A: Since I was six.

52) Q: Have they always been that thick?

A: Oh, no, they got thicker over the years.

53) Q: So as your eyes have gotten more and more out of wack as you've gotten older, how many different levels of thickness do you think you've gone through?

A: Oh, I don't know, over sixty years, maybe 10 times?

54) Q: Maybe you're ready for a thicker set?

A: Oh, no, I think they're okay.

55) Q: I think we should make sure. Let's check it out. Now how far were the defendants from you when you saw them entering the Sack O' Suds?

A: About a hundred feet.

56) Q: About a hundred feet. Would you hold this please? (Running a tape measure). Sorry, excuse me, excuse me, sorry, sorry. Okay. This is fifty feet. That's half the distance. How many fingers am I holding up? (He hold up two fingers.)

Judge: Let the record show that the counselor is holding up two fingers.

Q: Your Honor, please, huh?

J: Oh. Sorry.

57) Q: Now, Mrs. Reilly, and only Mrs. Reilly, how many fingers am I holding up now?

(He holds up two fingers)

A: Four.

She believes what she believes and that is fine. I am sure she did see a jogger but it wasn't NC. This lady represents my definition of a busy body wanting to attention and to be heard. I don't mean she didn't see somebody but not for a split second and know who it was.

It will be interesting to see if you discredit ALL the defense witnesses. Did you find all the state witnesses to be credible?

  • #445
Yes, where are all the innocence project people who have gotten people out of prison, put there by eye-witness testimony? Eye witness testimony is the weakest link in a case.

Aren't they sitting with the defense?

  • #446
ain't that the truth! she did leave an impression with the jury, however. just not sure how strong it is.

It depends on whether or not they remember previous testimony. When Kurtz was crossing Det. D he said something about the detective telling RZ about a large number of witnesses who claimed to have seen a woman jogging. What she said totally contradicted that.

I thought she was a good witness who was consistent in her testimony. She believes she saw NC on the morning that she disappeared. What she saw coincidentally matches up with what Brad said in terms of time, and activity.

Exactly, which is why I am amazed that the CPD has not located the person RZ did in fact see if it wasn't NC. They have known about RZ and her information from the get go. They knew she would be a witness at this trial. So, where is the person she did see? You can't argue that given the publicity of this case, the person she did see (if it wasn't NC) would not have been identified by now.

I wonder if it was one of those joggers the other witness spoke about..the lady who saw 2 joggers, not running together that morning??..Appears that area had lots of joggers, and it also appears not one of those joggers actually saw Nancy, including the couple who knew Nancy jogging in that area??...

I wonder how her testimony in that civil proceedings helped Brad?..Well, it seems not so much as the two girls are now in Canada with Nancy family members...Ohh well...

Hair pulled back, but wearing no jewelry, according to RZ...Cummings was delighted to hear her say that, I'll bet.

just wondering how the innocence project "vets" their case before taking it on.

any criminal would want to be associated with that kind of assistance, whether or not they deserved it.

I think this witness raises exactly the questions it should: were police suffering from tunnel vision? Did police follow up on tips? When police were told that Nancy was jogging at 7 AM, and a witness claimed to see Nancy jogging at 7 AM, why didn't they immediately follow it up as a credible tip?

To me, it seemed like she left messages with them but no one ever called to ask her what she was wearing, where exactly she saw her, what time, was she with anyone else....details. At least that is my understanding of why she was upset that no one called her. She seemed genuinely worried for NC.

So who gave her all those business cards? My phone doesn't dispense business cards. In order for me to acquire any, I have to actually *meet with* somebody.

The officer she saw at the road block, the one she saw later in the area, the ones that interviewed her in October, the one that interviewed her to ask her the race of people in the picture she looked at.

Since I have had a hard time watching the witnesses, did anyone ask the detectives when they were on the stand why they did not follow up on tips like people think they should have? If so, what was their reply, anyone know?

No I did not find them all to be credible. Thanks.

ETA: For example Sunshine, this guy seems very credible just from a few seconds. BUT was it NC he saw

I hope that of the many of you, you nor ayone of your family members ever become missing, but if it does happen, karma may just come aronud and someone with relevant informaiton may not come forwawrd because of people who will mock them if they do as being attention seekers, or confused, or just upset because they need attention or the many other things being said about these witnesses. I feel like I am on the playground in 2nd grade with some of the comments I am reading and I think the comments are all because you are all so positive that BC did it and have been for so long you don't know how to look outside the box you have drawn around yourselves.

The witness said she maybe saw NC at Place X.
The police were already searching Place X.
What other information was this witness supposed to provide to the investigation?
Why would the police need to follow up with her. They already know her full report.
"I saw someone that looked like NC at Place X."
She had and has nothing else to share.

Ummm Did she look upset? Was anyone following her? Did you notice anyone else on the road, in a car, or in person? What was she wearing? Was she running alone? The questions go on and on.

Uh oh, training manager for Food Lion meats. I do remember that Primetime undercover investigation on Food Lion meats years ago... Yikes!

I'm inclined to think that Brad did it, but I also found this witness credible. She didn't waiver in her testimony. Efforts by the prosecution to minimize the length of time that could have seen the jogger were just that ... an attempt to imply that there no one who says hello to a jogger on a path could recognize them afterwards. That's just not true.
