She is talking about his bond now. (I missed her name)

Who is? In front of the jury? I didn't think they could even allude to the fact that he was in jail? Perhaps I am mistaken, but I know that serious steps were taken in the Cooper trial to make sure the jury didn't see BC as being in the jail during the trial. They weren't allowed to see him dressed down, or leaving the counsel table to go to the holding cell.

Is the prosecution proving that Pat Young could afford to pay for a custody dispute?

  • #407
This is my thought too. I don't know what his limiting instruction is, but this is the first thing I've thought came close to reversible error in this case.

I'm glad he has the cojones to do this. Unlike Belvin Perry who was totally intimidated by the thought of appeal.

Showing that they had money in excess of 1 Million in equity to bail out Jason (Show that Jason lied that he couldn't afford to fight for custody of CY).

I was just thinking... I think I would find it more suspicious if CY was named as the sole beneficiary on the life insurance policies, and JY fought hard for her custody, because he left her alive and knew she was worth $4mil.

Available funds to the defendant.

IMHO

I'm going to disagree here. This is available funds to PY, provided by PY to JY. Not the same thing.

Didn't see the ruling. I guess it's impeachment of his alleged financial situation, maybe, and if his own statements on such an admission by a party opponent as justification? Not sure - just catching a bit of it.

The prosecution may indeed prove that Pat Young could have paid to fight for custody, or even that Jason willingly gave up custody ... does that prove murder?

Regarding the civil judgment. The judge is going to instruct the jury that the finding in the civil case is not an admission or conviction of criminal court, ie murder. But the lawsuit judgment was based on him not appearing and he lost by forfiture. (sp?)

I think that's some fancy lawyering, but I'll buy into it. I didn't see the ruling either, but that makes sense.

It doesn't prove he committed murder, but it does point towards him being a liar. You add in he denied having anything to do with his wife's murder, well, you get the point.

Isn't this going to show that Jason didn't care enough about money to figh the lawsuit?

Listening now. Wish I'd heard how this line of testimony (civil suit and complaint etc.) got started. This is a very sporty area to be in! It would not normally be admissible, IMO. There must be a special purpose.

I don't agree. It actually, to me, shows he cared too much about money. Or, he's guilty and didn't want to answer questions about MY's murder in front of a court of law.

This is where I thought they were going last night. (To force the defense to present something) Wasn't sure how to frame my questions on it and thought for sure it wasn't admissible.
