The car wasn't on Birchleaf, it was in a driveway. The witness made it clear she didn't know the address of the property.

BH: "OK. So the car that you saw was on Enchanted Oaks?"

Heads-up, I may have changed my mind on the previous witness.

I looked up her address and Birchleaf (not Enchanted Oak Dr) is in fact the way out of the neighborhood for her. When she said "its the only way out" she was talking about Birchleaf, and that route takes her right past the Young house.

I was confused on why she said that was the only way out as well, since clearly it's not. The only thing I can come up with is her taking Birchleaf to Blue Sage to Enchanted Oaks (which I presume is the main way out since that is the name of the subdivision) is a more direct route to her hair appointment. We have three ways out, I routinely take the back exit one that's close... unless I have to go south to the other side of town then I take the main way out. I guess it just depends on where she was going.

This is how I think the defense will go after the possibility of Michelle's Lexus,

(SILVER) being taken from the home, which ties in with one of the state's

theories and *search warrants that CY was taken from the home in Michelle's Lexus as well.

In all my time following this case I haven't read or heard anything pertaining to the silver Lexus around the time of the murder. If you have a minute before the afternoon session I'd be interested in hearing more details about what you're thinking.

So,now the killer or killers are driving around in MY car and then they brought it back and parked in the garage!! If this was not a murder trial for a pregnant mother, I could honestly roll around in the floor and laugh my azz off!! Does the defense honestly think those men and women on this jury are that gullible. IMO

Michelle Young owned a silver lexus. It was in her garage at the time she was found. Jason's sister, Heather, then took possession of it after the murder.

I hope the defense recalls Spivey on some other issues as well.

Remember, Cindy Beaver will testify to a "soccer Mom type car" leaving the driveway......at 5:30 am,
and Mrs. Hemsley's testimony puts one there at 6:15. (depending if the Jury finds her credible/ reliable)

This is another case where this trial is frustrating! Did I mishear or was the first thing the DT said was "I've never talked to you before right?" I would have thought someone would have interviewed her. Even if just to see if she was still "with it".

Plus couldn't someone (even cops) have shown her a pic of the Lexus? Except for the street stuff she seemed pretty dang with it!

I hope someone follows to clear all this up. Because no matter what people heard here a lot of us are still very confused. Which makes me wonder if the jury is as well.

Someone mentioned a stipulation with the first trial re her? Did I hear that right? Do you know what was in that stipulation (if I really did read that)?

In any event. I loved that little lady and I would give anything if she were my gramma! Did either side ask her her age? If not I would have thought so. But that's just me LOL

I don't think her testimony can be taken as reliable by the jury. they won't have the ability to look up her address. They can only use what is presented in court and she said it wasn't on Birchleaf. I don't think this is going to make or break it one way or the other. jmo:seeya:

That makes sense because Klinkosum did say "right, Enchanted oaks subdivision" after she said "Enchanted oaks road"

I just looked at the maps and I do think she was probably referring to Birchleaf when she said it was the only way out. To leave her street she had to turn onto Birchleaf first. In any case, I think she was a poor witness for the defense simply because she was confused about the street names. I think jurors will consider her testimony and say if she was confused about the street name, perhaps she is confused about the specific house too.

JMO and all that jazz

Catching up and find it ironic that PY says they feared MY's family would take CY from them when that is exactly what they basically did....

No disrespect to you here, but I believe you need to re-watch the testimony. JY turned over complete custody to MF ... that way he didn't have to undergo a psychological examination or deposition.

It was in the Enchanted Oaks subdivision as clarified by the defense attorney. She already said the car she saw was in the driveway of the Young property of which she didn't know the address. The car wasn't on any street.

While the prosecutor did a fine job of confusing some here and trying to confuse an elderly lady, I think the jury found the witness both credible and sure of seeing a vehicle in the Young driveway the morning of the murder. Too late to have possibly been Jason Young.

I'll recheck the warrant so how about your thoughts, specifically in regard to the theory of CY being taken from the home.

I'm well aware HY took possession of the Lexus after the murder. I don't find that significant.

The search warrant issued 07/24/06 can be found at WRAL.

The wording of the warrant is as follows:

"Due to the situation with the child's bloodied footprints...vs. the the clean condition
of the child's feet when found, the confusion over the keys to the decendant's vehicle and how they came to be placed on the kitchen counter and M F's keys being found on the hood of the decendant's vehicle, it is believed that the 2000 Silver Lexus RX300 could have been used to transport the child from the scene. If this was the case, there may have been been transferance of blood from the scene to the vehicle using the child for conveyance".

Interesting comment. When the Highway Patrolman testified yesterday, someone made a comment about his brother being a friend of Jason's. I don't remember if it was you or Cammy, but one of you replied that he would never risk his reputation for his friend or brother.
What's the difference between him and Spivey? Spivey would but the other guy would not?
Is the difference because one is testifying on behalf of the defense and the other is testifying for Pros?

They don't have the ability to look it up, but the Defense Team can put it on a map of the neighborhood and argue it in closing. And I think it would make quite the point.

She liked the detectives (Blackwell & Spivey) and talked to them several times, but was 'angry' at investigators and never told them about missing items for 6 months...and not until they visited her again. Mmmmkay. That makes sense. :waitasec:

She never came up with the stolen items for 6 mths because the police said there was no motive for anyone besides Jason to murder Michelle because nothing was missing.Bang...she finds missing items.

How do u know how the jury found this witness as far as credible or not!!

Sounds like Beth Karras (Sp?) got from it that it wasn't the Young residence.
