The lady said the car was on the Young's driveway and she didn't know the address. If she said the car wasn't on Birchleaf, she literally meant it. The attorney followed up to point out the name of the subdivision is Enchanted Oaks. The cops took her seriously rather than confused and I'm betting so does the jury.

Actually, this is a really good point. She may have meant the car was not ON Birchleaf, because it was in the driveway.

I wish that point had been clarified. I wish either side had produced a map, and had her point it out.

Where can you re-watch this morning's testimony? I would like to go over PY's again.

  • #543
There is no "WOW" about this. Some would consider it quite normal to check with the spouse before bringing furniture into the house. It is not like it was some power tool to be kept in the garage. Don't you think it to be normal to consult with your spouse before adding new furniture, art work, etc., into your house?

Yes, it would be normal, imo.

Yes, and MF was ready willing and able to answer all questions the LE had for her. Also took and passed a polygraph test. So good for the LE in looking closely at any possible suspects. So speculations that MY's Lexus was involved proved it was just that speculation.

Maybe so.. But the description the lil old lady gave would match MY SUV....

Why didn't Howard Cummings cross PY on whether or not clothes were taken out of the suitcase or car?

Wasnt the DA showing her a map or a photo of the area?

I am with you I wish it had been clarified.

She was certainly saying the vehicle was in the driveway though.

Maybe the juror was getting as sick of this cross as I am.

I felt very ill yesterday when PY was on the stand soooo lonnng....going over picture over picture over picture.....and her jason stories didnt amuse me in the least... It was quite over the top, IMO. And I know the jury had to get sick of it esp since for 2 straight weeks they heard the complete opposite about her son. IMO, PY did not help her son at all. I like how HC got her to admit she lied for Jason to a financial rep he was doing business with about him being in jail....so I'm sure the jurors next thought was "pat just said she lied for her son, why not now to save his butt?' if I were a juror I would be feeling very sick esp about keeping CY from her other side of the family. Her only link to her dead mom. Why punish cy ?? Bc in the end that is whose getting hurt the most. Not fair to an innocent child. Shes been through so much. IMO, pt isn't desperate at all. I feel good about their case.

I think there is a good chance Michelle's car was taken out with CY in it to calm her down and/or possibly clean up the crime scene.

I think there were more than 1 person involved, and more than 1 car.

I think the fact we learned today that MY's rings were worth 14 grand
makes a heck of a motive for someone to kill her.

I have no idea who though....

The state does NOT think the Lexus was used in the commission of the crime. They wanted to search it any potential further evidence.

Then you would also be laughing at the state's theory as well, because that is EXACTLY what they contended when they issued a search warrant for Michelle's SILVER Lexus RX300 on July 24, 2006.

The murder happened Nov 2006.

Any SWs were dated after Nov 2nd, 2006. Not in July 2006.

I think the gist of her testimony though is the SUV was a smaller type and not a large one like JYs.

JY seemed to have somewhat of an obsession with wedding rings - I'm sure he took them off MY before the left the house the early morning of 11/3/2006.

I think there is a good chance Michelle's car was taken out with CY in it to calm her down and/or possibly clean up the crime scene.

First, she stated Enchanted Oaks DRIVE and the DT said Enchanted Oaks Subdivision.

Second, BH said ON Enchanted Oaks? A car is not ON a subdivision, it it IN a subdivision.

Once again, she was specifically talking about the road names, not driveway vs. road when she said "it wasn't on Birchleaf." I'm not claiming she didn't get the roads confused.

Moving on................

Me too, also her stmt to police as well......

LE cant win, if they look at a piece of evidence or investigate a lead that supports the defendant NOT doing it they are saying the defendant did not do it, if they don't check out all possible leads then they are focused only on the defendant, they have a no-win job.

He was showing her a map and trying to confuse her. She was quite clear, however, as to where she saw it....driveway of the Young house, not street.

She went directly from saying it wasn't ON Birchleaf to saying yes to it was ON Enchanted Oaks.

Correction:

Search warrant for MY's Lexus was 7/24/07, sorry.

8-9 months after the murder......

I wonder why they waited so long....

I agree the DT tried to confuse the situation by inserting that "Enchanted Oaks Subdivision" there at the end. Her exact words... again...

On direct...
Where did you see this car, do you remember the address of the house?

"I don't know what I'm supposed to say about that, I know where the house is I do not know their address, I do not know the street number I know I live right back over and thats all I know."

Do you know the road where you saw this?
"It's Enchanted Oaks Drive"
Atty inserts Enchanted Oaks Subdivision

On Cross...
After approaching witness with map board
This being Birchleaf drive and this being the house back there, this being the road and this being the driveway...
"The driveway to what"
The house back here... (PT is pointing out the Young residence)
"On Birchleaf?"
Uhhuh...
"it wasn't on Birchleaf"
So the car you saw was on Enchanted Oaks?
"Yeah"

I don't know how much clearer she could have been by saying the car she had seen was NOT on Birchleaf, but on Enchanted Oaks Drive. PT even pointed out the Young house on the map and she said that was not where the car was. It was straddling the driveway & the street... over the crack as she said because she was worried it was going to run her over. Wonder if we're all watching the same testimony and I am not confused ;-)
