The trooper did not interview MY. He stated she was there and after talking to JY he did not need to speak with her.

But he saw her standing there. I am certain that if she exhibited any injuries one would associate with wrecking at such a speed, and not wearing a seat belt, he would have interviewed her.

Shelly Schaad would have what reason to lie about what Michelle Young told her? I'm sure it wasn't a hard sell for Jason to convince her to go with seat buckled - they had a lot at stake for insurance purposes. And again, why would Michelle lie to Shelly, and why would Shelly lie or make up something out of virtual thin air? Telling the trooper she wasn't wearing a seat belt risked a misdemeanor or trouble with insurance claim. Telling Shelly Schaad the truth later, far less risk...and again, what motive would Michelle have had to lie to Shelly, and what motive would Shelly now have to lie? But hey, defense team, impeach the murdered pregnant woman...go ahead.

It was a co worker who testified that MY told her about the accident and her not having the seatbelt on if my memory serves me correctly!

I don't think that's true. They are 2 separate trials. I remember OJ was found NG, but lost his civil suit for wrongful death.

Correct. Criminal trials have the burden of proof "beyond a reasonable doubt" and Civil trials have a lesser burden of a "preponderence of the evidence" (sp?) which means if the scale is tipped slighly one way over the other (49%/51%) then that is all that is needed for guilty verdicts. In laymans terms I like to compare the 2 burdens to "somewhat likely"(Civil) to "highly likely" (Criminal). So you can have a split verdict in 2 different trials with 2 different burdens of proof.

Listen to the testimony, when the trooper arrived there was a deputy already there and MY and JY had went to the hospital and then they returned to the scence!!

I thought he bolstered the prosecution's case actually.

Otto, did you get a chance to see the PI's testimony from today?

I had always wondered who the 4th person was at the defense table.

His name is Steven Hale, and he was awesome.

He conducted his own investigation at the Hampton Inn, pretty powerful stuff.

I was really impressed and liked this guy.....

I have heard the testimony. And nothing I said is contradicted by that testimony.

I could be wrong but I thought it was Michelle's co-worker that testified about what Michelle told her about the accident? Not sure how much that matters, just thought I'd throw that out there. :)

Why couldn't Jason be in King at 5:27am while at the same time 2 people were in a car in the Youngs' driveway. No one saw those people in the house. Could have been 2 random people that got lost and turned around in the driveway or it could have been 2 of apparently hundreds of newspaper delivery people that are in that neighborhood that CB is aware of (NOT the News & Observer of course). Maybe it was an "inviting" driveway b/c all the lights were left on by JY after he murdered his wife 2 hours earlier. If I had to turn around in a driveway, I would pick a well lit one over a dark one if there was a choice. Anyone know if the Youngs received any newspaper delivery at their home? If you believe CB, could this have been a newspaper delivery route driver with a passenger?

The Young house sat a little ways up... Why would someone who just needed to turn around be coming fwd out of the driveway??? I know when I turn around I pull in and back out.. I dont go all the way to the top of the drive turn around and come out fwd... Thats really being brave to pull up to someones house when its well off the rd to turn around.....

Perhaps she's been prompted by the Prosecution team to create something out of nothing. I'm sure she'd do it if she thought it would assist in putting the person she believes killed her best friend behind bars.

Yes I do. Do you honestly believe that every witness for the prosecution has told the truth on the stand? Or every witness for the defense for that matter? Everyone up there has a motive in testifying. Why is it acceptable to question the veracity of every witness the defense has called to the stand, but balk at the idea that a prosecution witness may have fudged on a detail of her testimony for the greater good?

Just like all the other coincidences, what are the chances someone just randomly turns into the driveway of a murder victim that am?

Thanks for clarifying the newspaper subscription (or lack of). Lots of "chance coincidences" in this case....some on both sides of the argument, but I think many more pointing to Guilt. But the burden of proof is high, so who knows if the jury will give enough weight to the NG coincidences to achieve reasonable doubt. I like to think of it as a BIG jigsaw puzzle with each puzzle piece being circumstantial evidence. If you throw 5 pieces out on the table it's crap, but if you have all of them put together you can see the BIG picture. Even if you remove 5 puzzle pieces from the finished puzzle, you can still see the big picture. I think the PT has more pieces than the DT.....I'm hoping the jury can see that BIG picture.

Who said that anyone drove all the way up the drive? They could have backed into the drive to come back out the other direction - happens all the time. I've done that at least 3 times in my neighborhood in the last 3-4 weeks because I forgot my cell phone or paperwork at home.

Were all the lights on when MF arrived?

That is what I understand to be the case. Lots of things were on, like CY's music in her room (I think), and a treadmill (strange), and lots of lights. Correct me if I am wrong WS posters, but I'm under the impression that there were interior lights on too. We know there were lots of outside lights on from CB testimony (if you believe her).

IRRC It wasn't the officer's brother. The officer's partner's brother was a good friend of JY. I can see how the PT wouldn't know about that. If that's wrong maybe someone can correct me.

Part of the impact PY's and HM's testimonies is that "there are a lot of 'Stoubs' (is that the correct name of the trooper?) in Brevard" and everyone knows everyone and Jason was Best All Around and the fun guy everyone liked and he had a ton of friends. In a small town where everyone knows each other, is the trooper, a friend of a friend, going to suspect Jason of anything suspicious? I would think it would be the opposite, since he is JY, the "life of the party", the guy everyone likes. That's what I took away from that testimony.

I'm sorry that I'm way behind here :blushing: - but I'm watching PY's testimony from yesterday and I recently watched her first trial testimony and I don't recall anything about him getting a call and saying "Homicide? No..." (paraphrasing)...Also, I don't recall in the first testimony her saying he asked anything about Cassidy after he first found out..I don't think she mentioned anything in her testimony about CY. :waitasec:

Does anyone think these are new statements? those would have been pretty big to include in her first testimony because there was a lot of questions surrounding why the lawyer need when they thought it was natural causes or a miscarriage...and the fact that he didn't say "how is my daughter" "where was she found - is she ok"
