As far as trial strategy with the testimony of the daycare worker...I think the prosecution should let her testimony just stands as CY's behavior. If they go trying to defend the gender, # of dolls, clothes of dolls etc.... like is going on today...it will just put the focus on that and not what should be taken from the testimony. CY witnessed the murder of her mother....horrific that a 2 year old had this scenario in her little brain days after her mother and was acting it out while playing. Not how you want to see your little girl play house with dolls.

They were not in his suitcase or SUV

We know JY left his door propped open for a smoke. A very tall woman goes in his room, steals his dark pullover, pants, and heads out to the Young home where she secures the size 12 HP shoes from a bag waiting to go to charity. She then kills MY while wearing those shoes and switches back to her size 10 Franklins.

You can't prove that DIDN'T happen? :waitasec:

As it is, I have no problem believing JY pulled some of MY's hair out, no problem believing MY did it while grasping during the strangulation struggle, and would have no problem believing someone else did it, if I thought the evidence suggested someone else killed her.

Factually, as the defense pointed out, the figure is a female. If the prosecution wants to present the female figure as Jason, they have to overcome the gender problem.

Same here. I believe JY did it, but I'm curious about the defense's case-in-chief.

Was not able to do much with the hallway photo. Not enough resolution. I used the photo from WRAL. However, I think I can spot a zipper and a floppy collar. Collar appears to be shifted over JY's left shoulder (our right) to make it appear like its a hooded sweatshirt.

So it does appear there could be a hood element to this pullover.
I guess I see some bulk around the left side of the neck.

With that, that totally busts the defense's trick of using a crew neck sweater to imply it was the same.

That hooded sweatshirt would also come in handy at the crime scene.
Zip it to the top of the neck and pull up the hood...maybe even use a ski mask as well.
Sure would protect from blood spatter - head to toe.

I'm reminded of a particular abuse case, and I can't for the life of me think of names right now. But I have a vivid memory of the description of the abuse. 'After the male threw a plate of food across the kitchen, he grabbed the female by the hair, threw her to the floor, rubbed her face in it, and told her to clean it up, kicking her as he left the room.' Using hair to control a female, adult or child, is commonplace, especially in domestic or intimate relationships IMHO.

I see where you're going with this, but the DT would be out of their minds to touch any of this, because once they open the door and challenge the gender, or if the child can distinguish gender, they are f---d because then well, how about: Can she pick her daddy from a crowd? How about when he's beating her mother? From a defense POV (I'm not a lawyer, just a trial watcher), IMO, their best option is to not challenge the reenactment at all, because it's just a reenactment of what the child witnessed, not naming her father as her mother's killer.

OTOH, I hope they go all stupid and open doors for the PT.

Two questions by DT... To day care worker.. Did CY ever use the word daddy when hitting the two dolls..And I forgot the second. LOL

The bulkiness has always been obvious to me. I don't think it's a hooded sweatshirt with a zipper. I think it is some kind of hooded jacket as it hangs loose, not gathered at the bottom. He put that on after being seen at the desk, I do believe. Or maybe the camera doesn't capture it well. Where is the bulky top? It wasn't in his suitcase.

I am too. I don't think it will differ much from the first trial but it may have twists like the state's case this time.

The biggest deal to come is if JY takes the stand. He won round one, IMO. Can he do it again?

Along with the scratch marks on MY's neck, I think she pulled her own hair out trying to frantically get JY's fingers from around her neck as he was strangling her. I'm sure the hair was in disarray all around her neck.

Nope.

IMO he only won the first round because the prosecution was completely unprepared for him. They will be ready this time, I should think!
