State wants answers from Baez

ita and I'm sorry to all the Perry fans here but this is getting ridicules .. When is he gonna DO something? He doesn't really follow through with his threats..

I agree. He has been patient - but what is the limit? He has to crack down now.

"Prosecutors want Casey Anthony defense attorney Jose Baez to explain why he should not be held in contempt of court for failing to miss another court-ordered deadline.

Reality Orlando, I think you mean to say "failing to meet
another court-ordered deadline."

Jose didn't fail to miss the deadline, he did miss it. His mistake was failing to meet it.

just wanted to clear that up.

Maybe I should be over in the "what's the defense" thread. But I do believe that Jose actions and mistakes will be added up and be part of an appeal for Casey after she's tried and convicted to claim she was represented by ineffective counsel. Well...it's possible.

ok, I think I figured out Baez's game. Remember when KC said in a letter to her jail pal
that her trial would end in a mistrial? I think it's possible that is what Baez told her.
He has been showing contempt for the court a lot lately. what if this is just a strategy
of his to force the judge to take some action that would cause a mistrial? Just a thought.
Then there would be another trial with Baez as the ringleader again and bleeding more
money from the Florida taxpayers while KC avoids once again a convection and prison.
Baez gets richer (filling his pockets with taxpayers money) and more notoriety . KC gets to sit her room protected in jail instead of the harsh reality of prison. When will this circus end?

I think Baez IS doing this on purpose. He can't withdraw from the case. This case is costing him lots of time and money. He knows he is not going to win. He want the judge to kick him out. It's blatantly obvious at this point. NO one can be this incompetent. :waitasec:

ITA...he can't be that ignorant, can he??? Now with a veteran by his side they both claim "confusion" over the order! I'm a layman, know nothing of the law and His Honor's order was "crystal clear" to me and probably everyone else.

If he's really trying for ineffective counsel, he's taking quite a chance on ruining his reputation (I know, what reputation!) for prospective clients. If I needed an attorney (God forbid), I'd surely pass by his name...but it's ICA who needs to be satisfied with her representation. I wonder if she still is or will she ask for a new counsel...by asking for new counsel, will this trial be postponed???

If he's trying for a mistrial, and this case hasn't gone to trial yet, what will he try during trial. Is this his Aha moment! :loser: JMHO

It might be a first if Mr Baez failed to miss a deadline

Can you have a mistrial before you have a trial? or would it just be a postponement of the trial?

Could this be another lapse of 'memory' <cough> like when he 'quite frankly' didn't know why they were there? (i.e., in court.)

This is contempt, plain and simple and Judge Perry should find it so, imo.

If Perry doesn't nip this behavior now, he will be plagued with it all through this trial.

An attorney can be disbarred for not understanding simple court motions and I think Judge Perry should file a complaint to the Florida Bar, or at least threaten to if baez continues to "feign ignorance."

imo

Hi AZWriter
It wasn't RealityOrlando's fault...that's the way it is written in the Orlando Sentinel article....

NO, it would probably only postpone the trial..

What I was trying to say, TimesPast....ICA is in pretrial proceedings, Baez doing these shenannigans in pretrial hearings, what would he do when this case finally goes to trial. If it's a mistrial he is aiming for, how much worse can he be in feigning ignorance or appearing incompetent???

The dilemma for His Honor would be, should I have Baez replaced to save the integrity of this trial or do I have him continue on and have ICA use this for appeals purposes and use ineffective counsel to retry her case. Only, she'll still be sitting in jail waiting on another trial to happen. Is this the outcome the team/ICA wants?

CMason, who is the veteran sitting on the defense should take control of this trial and client. I can't imagine CMason could be satisfied looking like an dunce when he's got 40 years under his belt. Why would he allow Baez to ruin his reputation he impeccably built for 40 years to be knocked down in one year..foolish, foolish move...JMHO

I can't understand why Mason joined the team in the first place?? but I don't think the Judge can remove either attorney unless there is serious malpractise (apologies if I use an incorrect word). He may go looking for precedents to force the DP qualified attorney to be the lead, but it seems as if Mason does not want that role.

I think the Judge is aiming to get this to court in May, whether Mr Baez will still be part of the team - I have no idea.

Thank you for the detail. The March hearings may provide some clues.

ITA! Both lawyers for the defense are not behaving as if they believe in their client's innocence, that is certain.

Baez knew exactly what the judge wanted because he protested, "I already filed a motion!"
Wiggle out of this one, Mr. Baezzzzzzz.

I wonder how long it will be before CM picks up the phone to JA to ask that they withdraw this motion, like last time? "He's only a boy, he didn't understand, don't be too hard on him". :waiting:

Jose must be having trouble finding the proper legal language to say they will object to certain/all/any scientific evidence that makes their client look guilty.

oh my goodness......... (from the article)

In his motion, Ashton said after he received nothing from the defense by the deadline, he spoke to Baez about his compliance with the order and Baez expressed "confusion" about the order.

Baez followed up with an e-mail sent to Judge Perry's judicial assistant "claiming not to understand the clear and unambiguous language in the court's order," the Ashton motion states.

I think JB's expert really doesn't have anything to offer in a Frye hearing and such a hearing is a mute point. So he is hoping that it will be canceled because of this excuse, and maybe have a issue for mistrial, etc.

The judge is going to allow this game, to prevent a mistrial.

However, as noted the Judged clearly covered this possibly in every which way possible. So there can be no misunderstanding.

I think the Judge should ask JB bluntly if his goal was to get the Frye hearing tossed. When JB says no, then the Judge should tell him that he is going to try and make that happen. But since the Judge totally clarified his orders, that He (Judge) can not ignore their BS. Then fine them per day that they are late, until they comply.

Then ask them if they understand what will happen if they miss any more deadlines.

He was nice last time, by just making them pay a small amount, when he could have done 'daily'. Nice doesn't seem to have worked.

Right so if Baez was confused at the order, why didn't he raise questions about it before the deadline date...No, Baez just doesn't follow rules/procedures he beats to his own drum...Idiot, incompentent fool to have the deadline pass and then say confused...Yeah, right!

He was probably busy making arrangements for this conference to attend, it is today, isn't it??? Too busy to notice but not busy enough to attend..JMHO

It's incompetency such as this that makes you question our legal system and justice for the victim. I am just speechless.
