Court reinstates charges against Steven Powell
Pierce County Prosecuting Attorney Mark Lindquist said Powell now has 30 days to appeal the decision to the Washington State Supreme Court. If he does not, Lindquist said Powell will be formally charged and will face trial on the child charge.

Prosecutor Mark Lindquist said Powell has 30 days to appeal the ruling to the Washington State Supreme Court. If he does not, prosecutors will summons Powell to court to be arraigned on the charge. Should Powell be convicted on the reinstated charge, he would face up to five years in prison.

Aeosana also says the garage door opens and closes on its own and she sometimes feels like someone is watching her.

Most recently, she said her 1-year-old son was talking to an empty swing in the front yard of the home saying, "Go away, leave me alone."

On the eve of his child trial, Steven Powell is once again claiming the search of his Puyallup, Washington, home in August 2011 was illegal.

Powell's trial was scheduled to begin Monday but was continued until next week after he filed a 127-page motion claiming the search warrant served by West Valley police in Utah on his Puyallup home was illegal and that all evidence collected as a result of the warrant should be tossed.

In his motion filed last week, Steven Powell contends the search of his home was not warranted because he had been cooperating with law enforcement, including offering the journals to detectives, and because his residence had already been under extensive surveillance by West Valley police.

In arguments earlier this week, attorneys for Judy and Chuck Cox asked the Ninth U.S. Circuit Court of Appeals to let a jury decide if Washington's child welfare agency is liable for the deaths of their grandchildren, Charlie and Braden.

The judges did not immediately issue a ruling in the case. Outside of court, Susan's father, Chuck Cox, said they wanted changes to the child welfare system.

"The policy manual for social health services used to say their goal was the safety of the children and reunification as the same, on equal footing," he said. "We want them to change that to say safety of the children is number one, period. No question."

UPDATE (July 24 10: 05 a.m.) - West Valley City Police Department released a statement saying that Steven Powell never provided any information in the past that helped with the investigations of Susan's disappearance. His death does not change the status of the investigation. The department also stated that Steven's death does not make the case any more or less likely to be solved.

Steve Powell, father-in-law to Susan Powell, a mother who went missing from West Valley City in 2009, has died, authorities confirm.

'Cold': Josh Powell diagnosed with shoulder injury 10 days after wife disappeared

WEST VALLEY CITY — Josh Powell, the lone suspect in his wife Susan Powell’s presumed murder, sought treatment for a shoulder injury just days after her disappearance in 2009.

West Valley police never discovered that information during the course of their investigation, likely because Powell’s visit to a physical therapist was billed through an existing personal injury claim on his auto insurance policy.

Chuck Cox is hoping his daughter’s story will encourage other women to leave their abusive spouses for good.

The heartbroken patriarch is participating in a two-night docuseries on Oxygen titled “The Disappearance of Susan Cox Powell,” which explores the devastating final years of the 28-year-old Utah mother when she vanished from her home in 2009. It features shocking never-before-seen videos and rare interviews with family members — and footage of her two young boys, who died in a fire started by their own dad.

“I must have received about 100 calls from people saying, ‘Because of Susan, we got our daughter out of this situation,’” Cox told Fox News. “[These women are in] uncomfortable situations and think maybe they should leave… but then they feel things are going to get better. And they believe their abuser. They’ll start a divorce proceeding and go, ‘I don’t want to be mean to him.’ So they start and stop. If you’re going to leave, you have to make up your mind and leave.”

“I thought she was being isolated so I bought her a phone,” said Cox. “I told her if she had to get out, take the phone… and get out. We would find a way to get the kids. We had several discussions about going to a neighbor or safe area and then getting in touch so we can deal with things. I didn’t trust Josh, but she had to make that decision.”

Cox was outraged that his daughter’s privacy was violated publicly. He also believed she was never capable of walking out on her children.

“Josh never treated her like how a wife or loved one should be treated,” he said. “And that was at the beginning of the relationship — the time where everyone is on their best behavior. If you’re not going to be treated right in the beginning, then how do you think it’s going to get after the novelty’s worn off and the honeymoon is over? … If something doesn’t feel right, there’s probably a good reason for that.”
