“But the charges against Fisherman have now been dropped after he produced a time-stamped video showing that he was on board a boat in Miami Beach very close to the time of the alleged assault.

Fisherman's video was uploaded to Facebook at around 9pm that night, showing him cruising on the water. Prosecutors said the video was a valid alibi.

'We determined in good faith that we could not prove the case against Ohad Fisherman beyond and to the exclusion of all reasonable doubt,' the state attorney in Miami-Dade County, Katherine Fernandez Rundle, wrote in a media release.

'The defendant's presence at the scene of the crime is an essential element of proof and this video evidence casts doubt on that proof.'“

Kate Whiteman, 45, was found dead in Australia late last year. The coroner in New South Wales told the Times that Whiteman's cause of death was under investigation. Fox News Digital has reached out to the New South Wales coroner for additional details.

The news comes just before the brothers' criminal trial is set to begin, with jury selection starting Jan. 20.

Just weeks before a federal jury is scheduled to hear allegations of a two-decade sex trafficking scheme, federal prosecutors have expanded their case against the Alexander brothers, charging two of them with sexually abusing a woman who prosecutors say was physically incapable of saying no.

According to a newly filed superseding indictment, twin brothers Oren and Alon Alexander are accused of committing the assault in January 2012 aboard a Bahamian-flagged cruise ship that departed from and returned to the United States, a charge added as all three brothers remain in custody awaiting trial in New York.

Jury selection began in New York City on Tuesday in the federal trial of two luxury real estate brokers and their brother, who are accused of sexually abusing dozens of women.

Prosecutors allege that Oren, Tal and Alon Alexander showered victims with free travel and luxury accommodations before drugging and raping them in vacation destinations such as the Hamptons.

Judge Valerie E. Caproni began jury selection by describing the case against the brothers and asking each of them to stand and face dozens of prospective jurors in the packed Manhattan courtroom. She told the jury pool that the trial, which is expected to last about a month, includes charges of sex trafficking, sexual abuse and the sexual exploitation of a minor.

Witness testifies she felt 'powerless and terrified' after alleged assault​

One witness, who testified under the pseudonym Katie Moore, testified Tuesday that she was drugged and raped by Alon Alexander following a night out at a New York City club.

Moore said she was handed a drink and felt her “body starting to sway.”

“In that moment, it felt sudden. I know I wasn’t drunk or losing control; there was no gradual fade out. I had never experienced that sort of loss of control of my body before,” she told the court.

“The next thing I remember is coming to instantly, like a switch, and I was laying naked across a bed with Alon standing over me, who was naked as well,” she testified. “In that moment, I had no idea what happened. … I tried to get out of the bed a few times, but Alon kept pushing me back down. … Finally, he sat down on the bed, and I was able to get up, and I said, ‘I don’t want to have sex with you,’ and he said, ‘You already did.’”

At least eight accusers are expected to testify, including a woman who was 16 at the time of her alleged assault.

The brothers face sentences ranging from 15 years to life in prison if convicted. All three have pleaded not guilty to the charges.
