This "new" knowledge (to me it's new) is really messing with my head. What an evil profession, IMO, I know we need defense attys but GOOD LORD!!!! They must have NO CONSCIENCE at all.
No offense to any defense attys out there, but I just don't understand being able to operate like that. What a messed up system. This is going to bug the he77 out of me for a long time. Wish I had never asked the question now, the answer is so disturbing! :furious:

Not only that, but if he knew where Kyron is and told LE without the express permission of his client, he could face sanctions by the bar and even lose his license to practice law.

But there are always enough people willing to wrap themselves in the flag and go on and on about our founding fathers, government abuse of power, rah rah rah, etc. Yeah. Great system here. Criminals' rights before victims' rights.

One more question then I have to get out of here for awhile (RL calls) WHAT IF Terri had Kyron stashed, lets even say she had him stashed with a sexual pervert/ offender, and Terri was honest w/ her atty about this...would the atty STILL not be obligated to tell LE that Kyron was at such and such location with a sex offender, possibly being sexually abused day after day????
I am scared to come back later and read what the answer to this will be.....

OMG. I KNOW!! SOooo scary. I knew defense attorneys were "questionable," but this is just insane.

YES. I don't understand how anyone could defend...say...a repeat murderer or sociopath. No way, not me. Frankly, some people don't deserve a fair trial, lol. Anyway...

Another poster mentioned something about a throw away phone used on the day Kyron went missing and THAT makes sense.

I first learned about this some time ago in Caylee's case. It was terribly upsetting. I've come to be upset not with the defense attorneys, though - they are doing their job, and following the laws.

A defense attorney simply advises and represents their client. The attorney advises the client of their legal options under the various laws, and it is then up to the client to choose the option they wish. The attorney is simply acting according to their client's wishes.

In these cases of missing persons, the attorney communicates and negotiates with LE and the DA. LE and the DA want the location of the child, whether alive or deceased. The LE and the DA sort of represent the people, us, the families. And in these cases, they do offer deals to the client via the client's defense attorney, to try to make it easier for the client to tell where the child is, so the child can be brought home or laid to rest, LE can resolve the case, and the family can know what happened to their child.

It is the clients, not the attorneys, who make the decision whether they will accept the deals offered, tell where the child is, and give the child back their safety and well-being (if alive), or their dignity and respect (if deceased).

I blame them, the clients, the perps, the abusers, the murderers, the kidnappers, the molesters, the predators for their refusal to tell where the child is, and their insistence on continuing the pain for the victim, the families, the loved ones, and all the many people who become involved in these cases, and care about the child.

I think what we, the people, have trouble swallowing is that an attorney can stand before the court and demand the state prove its case when the perp has admitted the deed to the attorney in the first place. Then it is just playing games.

Yeah, we have a great system, rah rah rah <wave flag to patriotic music> but it still sucks when the perp gets more rights than the victim and his/her family. IMO. (And my brother is a criminal defense attorney).

But it really isn't. There's no flag waving going on here, and it really shouldn't be minimized how important the defense attorney's job really is. Without their demand for the State to make proof, you, the people, will have more than trouble swallowing.

I am sure no attorney who handles a missing child's case looks at it as a game. The perp isn't getting more rights. They're getting the same rights, with a lawyer who will defend against the natural instinct of "we the people" to violate that perp's rights just so we can get blood.

No one has to like it, but I sure bet if it's you (general, not specific) in the hotseat, you'll be screaming for your lawyer to do just this.

Exactly. Anyone who believes defense attorney's don't struggle with what they deal with is absolutely kidding themselves. The attorney/client privilege is perhaps one of the most important parts of our justice system.

Okay but I am a social worker. We work under therapist/client confidentiality EXCEPT when it comes to a child being hurt in any way (sexually, physically, emotionally)...Then, we are legally bound to report it and I cannot fathom, or stomach, how this wouldn't be the same for someone who is an "officer of the court"...
