Note that this was written in Nov 2008, (affair with Toni got physical in August 2008). So this is the time span he's covering in court atm, when Allison was supposedly incapable due to depression...

Wow, have just checked out the blog page and found the accused's entry dated 28.08.2008 is titled - Big Bang!

It was only mentioned in court today, that the physical relationship with TM commenced on that same date....

I hope when the prosecution cross examine him they are about all the lies and contradicting stories he has told and he stumbles because he doesn't understand the question he reminds of Jodi arias

Gerard: I admitted to them that there were occasions when I was effectively sleeping with Toni for the sake of the business. #badenclay

Gerard says that got back to Toni. "She was quite justifiably very unhappy about it." #badenclay

It might be true that he assisted Allison a lot like he says and that he looked after the children, too. This is only evidence of fatherhood, not being a miracle-worker.

However if he wants to be found not guilty he and his lawyer have to establish with as much force as possible that Allison was likely to commit suicide, and in order to do so he and his team have to forcibly ram home the suicide theory, showing that Allison was incapable of leading a normal day-to-day life. If I'm correct, his team must initially present an alternative theory (suicide) and then stick with this theory (I don't think they can change their defence argument part-way through... but I haven't looked up what the law is here in QLD for that. Maybe it's an American court-only rule, but I doubt it - otherwise courtrooms would turn into a circus?)

However I believe a lot of his testimony is contradictory - e.g. how could he be home every day at 5pm to help with the kids if he admitted he stayed late at work about 4 times a week to conduct his affair with Toni? That's why he's getting a lot of mudslinging in his direction - most of his statements don't add up.

Yeah I agree. I think they're burning the suicide theory a bit though because on the stand he's said she was doing better as he said in the police interview tape that morning she was missing that the jury heard. So if anything he has supported the theory she was depressed but was improved more recently.

He also has the problem of explaining how she got to the bridge without a car when walking to it is unlikely especially without being seen and how she would have killed herself with no broken bones, not drowning and no sign of toxicology overdose or medication possession sufficient enough to use. Easier ways to kill yourself and why hide your body?

He didn't want her to leave the business and damage it #badenclay

Oh now that is just plain rude, what is he implying there for gods sake, that he had to keep her sweet by sleeping with her for fear of what revenge she'd take? He really is a piece of work.

Kimster, the different states have their own rules.
In Queensland (where the Baden-Clay trial is), the law requires a "Unanimous Verdict"
Ref:
http://www.parliament.qld.gov.au/do...ublications/ResearchBriefs/2006/RBR200604.pdf
I can save you from reading all that, it simply says "a unanimous verdict is necessary".
Some states only require a majority verdict, this trial is in Queensland so Queensland's rule apply.

12:03pm: "Moving back to 2010, going into 2011, were you at that time still having an affair with Ms McHugh?" defence counsel Michael Byrne QC asked.

Mr Baden-Clay replied: "Yes I was."

Mr Byrne: "Did you attend a conference in Sydney?"

Mr Baden-Clay: "Yes I did."

Mr Byrne: "Did you have a liaison with another person?"

Mr Baden-Clay: "Yes I did ... I was going to a conference in Sydney for the weekend."

He said he met a woman with whom he had previously worked.

"We got together for a physical relationship on that weekend," Mr Baden-Clay said.

Mr Byrne asked: "Who was that person?"

Mr Baden-Clay replied: "Jackie Crane."

Mr Byrne: "How long did that last?"

Mr Baden-Clay: "That was the only time that we actually had sex."

He said reinvestment in the business was through staff recruitment and in office technology.

The accused said his wife fell pregnant in 2006.

“As soon as she knew she was pregnant her mood certainly brightened a lot,” he said.

He said they went for a 12-week scan where there was an opportunity to determine the gender but his wife asked not to know.

Baden-Clay said they agreed he would know the child’s sex and it was a girl.

“Having another girl, I felt a confidence I knew how to change their nappies and how to care for them and look after them, so I was in a way, quite relieved but I was worried how Allison would take that news,” he said.

He said his wife was still seeing psychiatrist Dr Tom George and her mood generally was good.

He said in the third trimester she experienced more negative mood swings and they organised to have an elective caesarean section to control the delivery.

Baden-Clay said he spoke to Dr George about the child’s gender.

“Because Allison was so set on wanting to have a boy and I knew it was a girl and I was concerned there may be some emotional backlash for Allison when she had the girl,” he said.

He said his third daughter was born on September 15, 2006.

Baden-Clay said his wife’s initial reaction was shock

12 week scan is not the gender scan, it's for growth, dating and checking NT. 20 week scan is when you can find out sex!

Sorry if already been covered, as usual I'm not quite up to date.

So he was with Toni because of no sex with Allison and the poor man just needed some. So then the affair with the other woman was because...? ;)
