I don't know if the jury will accept the proposition that neither financial difficulties or wanting to end a marriage cannot be motives for murder. In fact they can be exactly that as shown by the number of people in jail convicted of murdering their spouse.

no jury is going to buy the money angle the Defence has proposed..

no one in Au is that stupid..

Why would he need to walk away if he wasn't under finanacial pressure? You don't walk away from a profitable business.

And why then is he on legal aid to begin with?!?!

1:00pm: Mr Byrne said the three friends - Robert Cheesman, Stuart Christ and Peter Cranna - who had each loaned Mr Baden-Clay $90,000 were not concerned about the real estate agent's financial position.


1:01pm: The court has adjourned for lunch and will resume at 2pm for legal argument.

The jury will be required to return at 2.30pm

I heard his C mates give evidence and they were all very concerned about his business finances but they decided to take the risk anyway.

12:51pm: Mr Byrne has displayed to the court a balance sheet documenting Mr Baden-Clay's asset

The spreadsheet shows Mr Baden-Clay had a "net asset position" of $74,663.11.

So maybe a year's wages if he could realise the value of the assets, and half that if he walked out to start a new life with TM. If the business folded, he'd be out of a job too. Not exactly a comfortable financial position IMO.

Defence says #badenclay not in personal financial strife. "Do the math." Personally he was up $500k in assets over liabilities.

The problem was not in his balance sheet.

It was in his cash flow.

I'm sorry but I don't recall reading this in the evidence. Why would dad be telling her to be nice to mum because she is sick? This worries me a bit.

1:09pm Wrap: So far today ...

Mr Baden-Clay's defence barrister Michael Byrne QC has begun his closing address to the jury.

He has sought to discredit the prosecution's key allegations that love and money were motive for the killing of Allison Baden-Clay.

Mr Byrne said Mr Baden-Clay had no intention of leaving his wife for his long-time mistress Toni McHugh and was not under "significant financial stress" at the time of his wife's disappearance two years ago.

He has also pointed to the lack of evidence linking Mr Baden-Clay to the crime scene at Kholo Creek and warned the jury not to make excuses for the absence of forensic evidence "because Allison is dead and someone must be punished".

Mr Byrne has also urged the jury not to be swayed by "sensationalist media reports" and consider only the facts presented in court, saying the murder trial is not a "soap opera" or "whodunit play".

A grant of legal aid may still be made to someone with substantial assets if there are exceptional circumstances in which the assets cannot be accessed (joint accounts/holdings, asset preservation orders, caveats etc.).

70k (even if prompt liquidation was possible) would last no more than a week in a privately funded murder defence.

Assets?? What assets? 1/4 of Allison's investment property, rented property, leased cars and business equipment? Old worn furniture? What assets???
