Yes that is another possibility. Just b/c the DP is on the table it doesn't automatically mean the DP is the right verdict.
IMO, however, this case does warrant a DP sentence. If JA had truly acted in self defense, or even if it was a true crime of passion, I.e., she snapped then I could understand that for some it was a verdict they couldn't render. But when you consider the cruelty of this crime along with the premeditation, heaped with lies, lies, lies, and more lies then for me it doesn't pass the smell test.
This isn't even a case where premeditation was found in the "moments before the murder." It was planned for weeks in advance, that we know of. It could have been longer for all we know.
What's also telling for me--although not necessicarily a mitigator that she deserves death--is the fact that the DT doesn't appear to be rushing to make a deal regarding the DP. In fact, I wouldn't be surprised to learn that JA refuses to make that deal.
Anyway, all IMO, MOO etc., etc.
