The whole thing is absolutely tasteless.

Agree 1000%. It should be the least of their worries. Number one and only concern here should be WHERE IS CAYLEE??????

One cannot legally use the registered TM emblem until the process is complete. They will never get the name trademarked as just proper names cannot be trademarked. It has to be in relation to a product. What are they going to sell dead baby dolls? That tells me they haven't even applied.

That is a very good point Themis. But honestly, you could technically apply online these days. I think they have a case for distinctive, but to be honest there has been so much coverage and so much of their own promotion prior to the TN, I would not be at all surprised if they lost any challenges to it. Also, it is not retroactive for anyone holding any domain names, etc.

According the Social Security Admin., the name "Kaylee" is number 49 for this decade.

So it's a VERY, VERY popular name but they used a C so they could combine Casey & Lee's names.

I understand the reasson they made the name but they still should not beable to say "noone else can use the name" Caylee is a beauitul name and if others like it and want to name their child Caylee noone should beable to say they can't . Our 11 yr olds name is very unique and If others wanted to name their child her name I would have no issues as she does not own her name. BTW my name is 99% of the time spelled with a K however mine is spelled with a C. It happens sometimes with names that can be spelled with a C or a K.

FYI-- I intentional misspelled the name previously so I couldn't accused of infringing. (I don't need CA drunk calling or texting me in the middle of the night)

This would seem a likely infringement tactic, if by some miracle the Anthony's actually were granted a Trademark.

I can see the family protecting Caylee's name as far as domain names BUT all they'd have to do is BUY the domains... this trademark nonsense just makes them sound like they're after blood money. Just gives people MORE reason to think they're enjoying all the infamy Casey dealt the family.

I missed the whole issue. Just what is it these people are trying to trademark? Caylee? Caylee Marie? Caylee Marie Anthony? What are they trying to achieve? I can understand getting all worked up because someone is selling memorabilia with the little girl's picture on it for profit but are they attacking websites that have the name Caylee in the domain name? Are they trying to block people from writing her name on the internet? :eek:

Even families of famous dead people don't go crazy if people use the famous one's name on a website, i.e., "In Honor of Elvis", or "Memories of John Lennon", etc. If they're not selling images of the people or trying to infringe on the family's profit, what's the big deal? There are many fan sites on the web.

Methinks the Anthonys are spending too much time causing trouble and not enough time searching for Caylee. Oh wait a minute, Cindy already knows where she is! She's just not going after her yet. :rolleyes: According to Cindy, Caylee is alive and well and not staying in one place very long. :confused:

Yep, spinning their wheels, because frankly, CA has nothing else to do now. KC is in jail, Lee is "absent", GA is "distant", Caylee is "missing"...it's CA just sitting around killing time.

I can see how they could be allowed to trademark "Help Find Caylee" but not how they could trademark her name. If someone else happens to have that same name, are they going to want to sue? Really. :rolleyes: Now they certainly can copyright pictures the family has made of Caylee and they can order others to take those pictures off their websites if they are using them without permission or crediting the photographer. There's no way they can keep people from writing the child's name.

These people need to get out and search for their missing granddaughter before Cindy gets herself into deeper hot water. :bang:

Ah, but chilly has shown us that they have not actually trademarked the name, but rather are just using the trademark symbols beside her name and the phrase Help Find Caylee on the Caylee site. There is no record, according to chilly's post over in the Anthony's forced to move command center again thread, that they have ever applied for a trademark.

Is there a trademark register where we can check this for ourselves?

Aren't trademarks only given for names/symbols etc used in the provision of goods and/or services? I'm confused how you can trademark a name of a person, who is not you, and who you believe is alive and kidnapped? Do we know who is claiming the right to use this trademark?

There is a US trademark registry, also an international one. I'm not sure if they are public domain - but the copyright one is. Search for the US copyright office - you can also see pictures that are copyrighted, designs, etc.

They were probably trying to trademark her name because if you have a trademark, you can order someone else not to use it. Not even about "profiting" but you can order the person to cease and desist from using your mark.

Its mostly based around consumer confusion, but if they are planning on starting a completely non-profit IRS registered charity organization, they could copyright/TM the name so other people can't start for-profit organizations and capitalize on Caylee's name and likeness.

Like someone said earlier, there a 5 year period where you are expected to "defend" your name or the person using it could argue you are lax and you have relinquished your rights. After 5 years, your mark is sort of "cemented" and you still CAN bring suit - but you no longer need to worry about losing the right to it.

But in practice it mostly has to do with consumer goods - particularly when a foreign company tries to use something similar to your logo/trademark (like, say, the polo ralph lauren horse), in another market. You say we've used our trademark for 60 years, its clearly associated with our name. Etc.

There is a circle with an R in it after Polly Klass' name for "Polly Klass Foundation".

The reason they are doing this is because it has already been demonstrated by the company making the dolls, that others will use Caylee's name for profit. They cannot do that if her name is trademarked.

This is still happening!

I for one, would absolutely do the same for my child or grandchild.

IMO its "murderobilia"
