From that court chatter video, attorney Holloway speculated that something that came out in Brewer's testimony might have conflicted with what they expected Diamond to say, so the defense made a strategic decision not to call Diamond and have potentially conflicting expert testimony.

But he says he doesn't know and points out what I kind of said at the time - when you're in the middle of trial, you have to be fluid and flexible and make strategic decisions on the fly about presenting witnesses and evidence, and this was somehow the result of that process.

Thanks. If it was a last minute decision, I think it most likely that after seeing Brewer's cross the DT shuddered at how readily the State would shred any testimony by Diamond that RH's case was "typical." Just a guess.
 
I have a feeling that the jury's consideration of criminal negligence IS going to pivot on whether or not they believe RH forgot Cooper, and if so, what kind of forgetting happened. FBS? Or was so preoccupied with texting that he was indifferent to Cooper and plain vanilla forgot him? (In which case reckless disregard could easily apply, if not malice murder, because IMO plain vanilla forgetting is irreconcilable with missing all those cues to remember throughout the day).

I largely agree with your post. However, the DT did not lay out FBS as an explanation. They made a weak reference to false memories.
 
You should go! I wanted to go for a long time but have asthma and didn't think I could handle the dust. But an RV (and extra inhalers) makes it much more comfortable. Not sure I could do Burning Man in a tent, TBH.

Just make sure you read the first timer's guide cover to cover so you're super prepared. My first burn, nobody believed me when I told them I was a virgin burner. I've gone camping my whole life and if anything I was probably over prepared!

PS, Yes this is completely off topic from the RH trial; however, we did see that RH googled “Where is Bonnaroo”, so there’s that.

Not FBS as such. But, Kilgore did spend about 15 minutes in opening discussing it in all but name, a preview of Brewer's testimony, which also didn't use the term but which did lay out all the elements of FBS.

I was interested how little emphasis Kilgore placed on the possibility in closing, but IMO that was because he wanted to focus the jury on the question of intent (that the State didn't meet it's burden of proof) rather than have the jury begin deliberations discussing whether or not it was possible for RH to have forgotten Cooper. Just a guess.
 
Jurors want to watch the interview with the defendant and Det Stoddard and they want to see the doll used for the measurements first thing in the morning. Yes to the first question and no to the doll as it wasn't entered into evidence.
 
Depending on how intense her last trial was its possible she doesn't want the job again.

IT sounded like she did want the job again if she said she'd ' make sure the jurors followed the letter of the law.' and she is a high school registrar. Ever tried to deal with a registrar? LOL Very much a stickler for details and no grey areas...

I just can't imagine how it's his job to be there at all. Testimony's over.

This is typical for investigators who strongly believe in the charges. They want to be there for the victim.

Jurors already sent a note saying they will be taking daily breaks at 10:30, 12:30 and 2:30 and leaving at 4:30. Jurors will NOT be working late on ANY day.

Someone smokes.
 
Jurors want to watch the interview with the defendant and Det Stoddard and they want to see the doll used for the measurements first thing in the morning. Yes to the first question and no to the doll as it wasn't entered into evidence.


They want to see the doll...did they use the words "used for the measurements"? That would be especially interesting. Either being incredibly thorough, or perhaps wondering about the reliability of some of LE's investigation/evidence?

My guess would be the woman that was on previous jury and already served as a foreman is in charge again.

I am wondering if she is the foreperson because she would "make sure that the law is followed."

Could well be, actually.

If so, and familiar with the law in that sense, you'd think it very easy for her to draw 'wanton, wilful and reckless' together (in context) for the rest. Singling out wanton I don't get at all.

Very odd that they just asked of the doll itself. Why not the doll and the car seat? But just the doll? How is that helpful? They are not allowed to take a tape measure and check it themselves. So what are they going to do just looking at the doll by itself? :thinking:

The note from the jurors said, "Can we watch the interview in the interrogation room with the defendant and Det Stoddard with the printed transcripts first thing tomorrow morning? Also is it possible to see the doll used for measurements?
