I'm thinking it's Lisa. She was not on the defense list and defense accused Martinez of withholding exculpatory evidence because the State did not call her as a witness. jmo

Judge ruled with PT on felony murder. She has yet to hear about prosecutorial misconduct. That will be on Monday. DP eligibility stands.

The misconduct charge related to txt msgs was thrown out.

Are you sure? I thought that Beth Karas said she ruled against the defense on the prosecutorial misconduct.

:floorlaugh: I spent part of the afternoon at physical therapy today and they had me do that 'over the back of the chair' maneuver. I had a little giggle over that. They wanted to know what was funny and I told them that it was looooong story. I must say, it bore very little resemblance to Jodi's stretch, I'm old, overweight with a bad neck, which made if funnier...or stranger.

OMG that is classic. Was there a video camera on you by chance? We could all make our own videos of the "jailbird stretch" and send them to Vinnie. :floorlaugh::floorlaugh::floorlaugh:

I have no idea about American prisons, but in Canada, people sentenced to 2 years or more are sent to fEderal prison, lesser sentences land you in Provincial prison.

Here if you are sentenced to year or more it is prison, less is jail and conviction of a federal crime is federal prison. I believe :)

Beth did say that. But which one? I think they've argued that just about daily over some thing or another.

No one knows for sure what this is about. DT isn't saying. Nor are they saying why Gus Searcy was called to be their witness for Monday's hearing. We all want to know.

A couple of questions I'd like to hear Juan Martinez ask Alyce LaViolette, the expert witne$$ on domestic violence:

1. In your expert opinion, do you find that stalking behavior occurs more often in abusers or abusees?

2. Do you believe that Jodi Arias had no alternative to violence that day when she stabbed unarmed and naked Travis Alexander 29 times, nearly decaptitated him and shot him in the face? Do you want this jury to believe that this was her only alternative in that situation? Is this something you would teach in your Seminar?

They are both First Degree (Felony Murder or Premeditated Homicide). Both qualify for the DP. They can agree on the First Degree but be split on the Felony or Premed. I found that really interesting. It was be appealed ad nauseum "mark my words". :rolleyes:

it depends on the state - out here in california they passed a new law that now it depends on the crime whether you are sent to federal prison - so they keep non violent felons in county for the entire time - dr conrad murray is serving his entire sentence for killing MJ in county - and because of this a lot are being let out early because of over crowding in the county prisons (which means they don't have probation - or officers to follow their progress)

It means they don't all have to agree on premeditation to secure a conviction for 1st degree murder. (She's charged with two counts of 1st degree, felony and premeditated.)

3 jurors could believe she is guilty of premeditated murder while the other 9 think she's guilty of felony murder...as opposed to all 12 having to agree guilt to just one charge.

Well the mistrial was based on the alledged prosecutor's misconduct and she ruled against the mistrial using those defense arguments.

Judge Sherry Stephens says Jodi Arias’ trial isn't getting thrown out -- and the felony murder charge against her isn’t going away either.

Stephens denied the defense’s second motion for a mistrial, along with a motion to throw out the felony murder charge.

The defense moved for a mistrial, based on prosecutorial misconduct, claiming Juan Martinez failed to turn over text messages from the cell phone of Arias' murdered ex-boyfriend Travis Alexander.

I though the judge ruled with the PT on both motions. The one on Monday is a new prosecutorial misconduct allegation, I believe.

I just finished watching the Letter to Zachary link that folks keep reposting on here the last twwo days. Fist time I have watched a movie on my ook, and had me bawling so much. Thanks for the tears and those folks who keep repeating the link! It is so worth taking 90 minutes to see that and off the threads for it.

Oh ok........I thought BK said she ruled that the prosecutor had not committed prosecutorial misconduct and that is why she ruled against the defense when they asked for a mistrial using this reason.

Two different hearings altogether. There is one on Monday, Jan 28th for prosecutorial misconduct and Gus Searcy, who knew TA, has been called in to testify. This will be televised. The last call by DT for prosecutorial misconduct, several days ago, was thrown out by the judge.
