Judge ruled with PT on felony murder. She has yet to hear about prosecutorial misconduct. That will be on Monday. DP eligibility stands.

:floorlaugh: I spent part of the afternoon at physical therapy today and they had me do that 'over the back of the chair' maneuver. I had a little giggle over that. They wanted to know what was funny and I told them that it was looooong story. I must say, it bore very little resemblance to Jodi's stretch, I'm old, overweight with a bad neck, which made if funnier...or stranger.
I have no idea about American prisons, but in Canada, people sentenced to 2 years or more are sent to fEderal prison, lesser sentences land you in Provincial prison.
Are you sure? I thought that Beth Karas said she ruled against the defense on the prosecutorial misconduct.
IMO
So is this about prosecution not sharing TA's text messages?
A couple of questions I'd like to hear Juan Martinez ask Alyce LaViolette, the expert witne$$ on domestic violence:
1. In your expert opinion, do you find that stalking behavior occurs more often in abusers or abusees?
2. Do you believe that Jodi Arias had no alternative to violence that day when she stabbed unarmed and naked Travis Alexander 29 times, nearly decaptitated him and shot him in the face? Do you want this jury to believe that this was her only alternative in that situation? Is this something you would teach in your Seminar?
Does this mean they are going to have to find her guilty of First Degree Murder OR Felony Murder?

It means they don't all have to agree on premeditation to secure a conviction for 1st degree murder. (She's charged with two counts of 1st degree, felony and premeditated.)Does this mean they are going to have to find her guilty of First Degree Murder OR Felony Murder?
Lol. I thanked your post as soon as I saw the "$" symbols lol

Beth did say that. But which one? I think they've argued that just about daily over some thing or another.
I bet ya $1 the DV expert will bring it up though.
Also, people keep saying she texted a woman from TAs phone, but she didn't. Rather, she thought about it and then backed off. Just clarifying...
VELEZ-MITCHELL: And in one of her online conversations with this new boy toy, Ryan, Jodi admits secretly going through Travis`s phone. On it she finds the number of a woman she thinks Travis is secretly dating while still having sex with her. Listen to what she decides to do next.
BURNS: "I decided to text her back, quote, `Time to cuddle with Jodi. Good night.` Then I deleted the message, went to sleep, and never mentioned it to him. One day while he was taking a nap, I took his phone and read his text messages. Bad, I know."

Yes. I am sure.
I though the judge ruled with the PT on both motions. The one on Monday is a new prosecutorial misconduct allegation, I believe.
Well the mistrial was based on the alledged prosecutor's misconduct and she ruled against the mistrial using those defense arguments.
Judge Sherry Stephens says Jodi Arias trial isn't getting thrown out -- and the felony murder charge against her isnt going away either.
Stephens denied the defenses second motion for a mistrial, along with a motion to throw out the felony murder charge.
The defense moved for a mistrial, based on prosecutorial misconduct, claiming Juan Martinez failed to turn over text messages from the cell phone of Arias' murdered ex-boyfriend Travis Alexander.
