He also said he didn't want to be photographed in the shower by JA. Isn't it illegal to take pictures of someone without their knowledge? I did feel a little sorry for DB today. However, he was very quick to answer all the defense questions, then it was like pulling teeth to get him to answer a question from the prosecution. He/JB showed JA premeditated Travis's murder!

Today, was ALL prosecution and it's the Defense's big day. Doesn't sit well for JA. IMO
Did he say that? I think he said he didn't ask her to take the pictures. Not that they weren't taken with consent or without his knowledge. He also said that he didn't ask her to delete them, and doesn't know what happened to them.

Big difference between, "She did it without me asking" and "I didn't want her to, and she did anyway."

That's what I think. And since someone posted farther upthread that you can only plead the fifth for yourself, and not to protect a third party (I don't know about that since we have a different system here), I think that's exactly what was going on here.

Yeah, it's to protect yourself from incrimination. It doesn't apply to third parties. The only way he could plead the fifth is if he was committing perjury and there was no one else and he was about to be found out.

So...what DID he do to make him ashamed of himself? I'm really curious as to why you don't think he was an innocent person murdered in cold blood.

Really, I honestly dont understand it. Millions of men and women have these kind of relationships. The psyche doc who was on IS today said men have sex after the third date and women after the fifth date so it isnt like people, young and old.. arent having sex nowadays.

Men play women.........women play men..both can play each other for different motives..........and in this case I think Jodi was the type of woman that played Travis using what she was use to using.....sex. Whatelse did she really have to offer him?

So he either plead the fifth because that's what people always do on TV and he actually has no idea what it means (which would not speak too well for his professional reputation selling legal insurance), or he lied and he knew he was going to be found out.
Now I really want to know what happened to him.

I LOVED it when GS told the judge he would accept what she said as "credible". ROFLMAO, I bet she wanted to cuff him upside the head! :floorlaugh:

I know all too well that trolling on the net for legal advise is dicey, but what I found is that taking a phot of a person in a place where they expect a degree of privacy can be illegal. Interestingly the location cited by the attorney I'm reading is "..aiming your camera at someone using a bathroom is illegal.."

All of this suggests that defense has almost nothing. A smug self-promoter comes to them and offers his services and they have no better than to accept it.

A woman's life is at stake and they call an ex-boyfriend whose testifies, against his kindest wishes, that Jodi was sexually liberated and had a strange penchant for gathering gas cans that after her Great Murder Expedition seem to have disappeared.

Jodi will have to testify. (Wearing pigtails and little boy's underwear might marginally help her chances.)

Where in JA's premeditative thinking does she find it necessary to contact her ex bf who lives 6 - 61/2 hours away, 2 times, for the purpose of borrowing gas cans, and then drives SO FAR off her route (Google map attached) to Mesa to retrieve these gas cans?

Yreka is a very rural, mountainous area. I am certain there are plentiful gas cans in/around there??

Gus didn't want to do it. He kept asking "What if I refuse?", the judge was all "I order you to do it" and still he refused. After a bit of back and forth he said "Can I plead the fifth", to which the judge replied that they'd have to confer on that, and does Gus have a lawyer he can ask for counsel on this matter.

Turns out, Mr. Legal Shield has no lawyer he can call :floorlaugh:

Then the public was asked to leave the courtroom and the judge said they were going to have a "procedure" without the public, and when the broadcast came back, Gus was gone.

It was a thing of beauty.

I sure hope Gus is doing this :jail:, even if only for one night. I don't think it's likely, but one can dream...

Sadly, I was posting a reply right before this portion of the trial came on and then I had to take several calls! I missed the whole thing! But i read what everyone recapped and I have never had anyone act that crazy on the stand.

This Gus Searcy is the smuggest ***hole I have ever seen. What a condescending, bully attention "hoe." He thinks he's the boss of this courtroom. Yet, I understand the judge not pulling the trigger and kicking him out ASAP: he may actually have info that shows the State acted inappropriately. Uggh

I think Gus Searcy shows just how desperate the defense is and how they have no evidence of misconduct at all.

Mr. Smarmy (Searcy) is digging his own grave on this one. He reeks of dishonesty.

Wow. What a day in court. Wish I could take a vacation from my own job so I could watch the whole thing. So I guess Gus ended up answering the question and avoided going to jail for contempt. Now they have more witnesses to call and prepare for so it's delayed until Feb 13.

FWIW - as creepy crawly as Gus is, this is actually a really serious issue, and deserves to be looked into thoroughly. I don't think there's any prosecutorial misconduct here because Juan wasn't aware of any of what was going on. However, if Chris Hughes was calling witnesses and trying to dissuade them from cooperating with the defense, that's a pretty big deal and Chris may want to talk to counsel himself. I don't know where Sky comes in other than how she got the defense witness list but that's something that needs to be answered in light of Chris' conversation with Gus.

I respectfully disagree. Just having watched Chris Huges' testimony, it seems clear they are grasping and have nothing to show there was tampering. Also, watching how the prosecution allowed so much hearsay evidence in and failed to object when he could on grounds of relevance, the state is not afraid and just let the defense get on with it. The state had nothing to worry about.

Also, as to Chris Hughes, he seemed credible to me. I can imagine him calling a defense witness he knew, asking what it was about and warning them to be careful of a sleazy defense attorney. But, IMO, that's not witness tampering. I think the applicable section is:
(b) Whoever knowingly uses intimidation, threatens, or corruptly persuades another person, or attempts to do so, or engages in misleading conduct toward another person, with intent to— (1) influence, delay, or prevent the testimony of any person in an official proceeding;
(2) cause or induce any person to— (A) withhold testimony, or withhold a record, document, or other object, from an official proceeding;
(B) alter, destroy, mutilate, or conceal an object with intent to impair the object’s integrity or availability for use in an official proceeding;
(C) evade legal process summoning that person to appear as a witness, or to produce a record, document, or other object, in an official proceeding; or
(D) be absent from an official proceeding to which such person has been summoned by legal process; or

(3) hinder, delay, or prevent the communication to a law enforcement officer or judge of the United States of information relating to the commission or possible commission of a Federal offense or a violation of conditions of probation [1] supervised release,, [1] parole, or release pending judicial proceedings;
shall be fined under this title or imprisoned not more than 20 years, or both.

I've apologized several times for including "posters" in my comment.

I also have stated several times that NOTHING TA did warranted his horrible death period!

I only started this whole discussion when CH emails were mentioned that CH wrote an email to TA stating he felt TA was treating JA badly. And I wrongly commented that "most of us" would agree that TA maybe didn't treat JA all that great. MY BAD!!!

All I meant to say is.... someone can UNINTENTIONALLY harm someone emotionally and someone can FEEL emotionally harmed. This is just a fact.

Caps for tonal emphisis not anger/yelling etc.

Yeah, I think it's probably he didn't know what it was. He doesn't seem very knowledgeable on legal matters. It's something you always hear about, so I guess that's why he asked.

He was probably compelled to give up the name in the closed session, and I imagine they'll be at least getting a deposition from this person in the next week or so.

Time to watch some HOCKEY now! I can't stand much of the HLN people, although I'll probably turn over during the period intermissions.
