My dad was a pilot and we went to the drive in to watch Flying High. All my family except dad were rolling out of the car in hysterics and the only thing my dad smiled at was when they were flying on instruments! Guess it wasn't funny to a pilot.
I still remember most of the lines from that movie and often say, "but that's not important right now"!

Surely you can't be serious! He he he!
 
The blagg case is interesting reading. What was the relevance of the rape case at the end? Did I miss something there? I was skimming over parts so may well have missed the link.

Yes, I find it very interesting - Blagg got a re-trial a month ago. Upheld appeal because a Juror didn't answer a question correctly in the initial stage, and it was found out after the fact (a few years after the verdict).
Its why I am very glad that the judicial system we are seeing in the GBC case is as transparent as it is.
And there are mechanisms for Jurors to report anything they find while the verdict is being decided.
And they they have gone to the Judge for clarification.

Its another point why I thought these cases were similar.

🤬🤬🤬🤬🤬🤬🤬🤬🤬🤬🤬 seems to creat a sexual problem and then men continually seek out the 'buzz'.
I watched the vid of Ted Bundy's last interview days before being executed and he said his problem started with 🤬🤬🤬🤬, mild at first and then continued on until he murdered continually in search of the buzz.
 
If the jury cannot reach a verdict after a sufficient amount of time, then the judge will order a fresh trial. It is then up to the Crown whether they prosecute again. They likely would if they think they can get a conviction with a different jury. That of course would be a costly debacle in many ways.

BBM. Ali, can I ask what is generally considered "a sufficient amount of time" for the jury to deliberate ? Days - weeks ......?
 
I promised that I would comment on this direction by the Judge. Sorry it has taken me this long. A websleuther who was in court 3 weeks ago heard the lawyers and judge talking about an Edwards Direction. I had no idea what this was so I looked it up. This is the suggested wording for such a direction.
"Finally, in this case the alleged lie is the only evidence against the defendant [or is a critical fact in the prosecution’s circumstantial case against him]. Before you can use the lie against the defendant, you must be satisfied beyond reasonable doubt not only that he lied but also that he lied because he realised that the truth would implicate him in the offence."

I told the websleuther who asked me that I thought it must be about the face scratches. They certainly fit the category of being a critical fact and that he could have lied about them because to tell the truth that Allison made them would implicate him in her murder.

So it's an Edwards direction to the jury that because such a lie about the razor is critical to the case, that they have to be certain that he told the lie to avoid being implicated for murder and not for some lesser reason, eg she scratched him after they had a fight and then voluntarily left him. The judges direction goes further to say it is open to the jury to conclude that the lie about the scratches implicates him in her killing her but not necessarily intentionally.

Hope this makes sense.

Alioop... On a more serious note... I asked a question a couple of threads ago that you might not have seen... Please excuse my ignorance.... But can a defence team help the accused make up their defence or can they only help get evidence to support what the accused tells them... Just wondered what the ethics were in terms of that.... I am assuming that the defence team can't say eg ' Let's try and convince them that Allison was suicidal.' But if GBC mentioned depression they could then try and get as much support for that story as they could.

Yes, Blaggs response to his wandering was to blame his wife.
After having their child she had a hysterectomy and her libido dropped.
A born again church-goer, he went off to the strip clubs and parlours for sex. Plus uploaded 1,000's of 🤬🤬🤬🤬 pics and said they were used for 'education' purposes only with his wife.
But one specialist investigator said Blagg was just covering his tracks.
Blagg was a guy that was in the armed forced - fought overseas and was a 'party guy' in his prime.
He had been cheating on her for years.
 
As a matter of interest - the Northreach church in Townsville has this on their notice board currently:
"God's justice and mercy met me at the cross".

I'm hoping justice for Allison is met by a guilty verdict.

God I didn't know that about Ted Bundy. I agree about the 🤬🤬🤬🤬 problem but never realised it could lead as far down that track - but it does make sense. Continued use necessitates greater and greater stimulation so I suppose if you took that to the nth degree violence would come into it. Plus it desensitises people to feelings which is a dangerous way to be.

Wondering about 'witness collusion'. If the Jury were pondering over inconsistencies in evidence given by NBC and Olivia (who had sworn to give the truth) ........ as Father and Sister. Of course, GBC's Mother, as the first person to receive a phone call from GBC on the morning of the 20th wasn't asked to be a witness at the Trial.

The Jury may consider that there had been collusion!

GAWD Thanks KJ - now I will be hooked on this one. Everyone is different but I usually go in with Guilty until proven innocent so it is not looking good for Hubby in my eyes. Very young to be having kids.

Sorry Timmy, I did see your question and meant to answer it. Thanks for reminding me. Firstly, and this been discussed before, if the accused admits guilt to their lawyers then those lawyers are limited in what they can present to the court. They can't suggest an alternate theory of say suicide or point the finger at someone else. However if the accused does not admit guilt then they are free to propose alternate possibilities just like in GBC case.

The second bail hearing was the first serious mention of depression. His lawyers raised it before Judge Applegarth and sought bail on the basis this possibility was a change in circumstances for GBC bail status. They were clear (I was in court) that it was the prosecutions evidence, namely the toxicology report that showed Allison had greatly increased levels of sertraline in her body. The judge did not like it one little bit and pointed out it was very unlikely she overdosed then walked 14 Kms to Kholo.
However for the purposes of the bail application he decided that this theory or suggestion by the defence did not change GBC's circumstances and refused bail.

Ever since then both for the committal and trial, both the defence legal teams have tried to present as much evidence on the depression/ suicide possibility as they could. This would have been the lawyers and GBC with his family all working on this together. And there is no problem with the lawyers doing that as clearly GBC has not admitted guilt to them.
