Tim Miller: Possible Lawsuit against Casey

IF LE would have drained that flooded area, none of this carp would be happening. It really ticks me off that they didn't do that. It has been done in other cities and states when a person/child is missing. Florida doesn't really care. Florida and California are the best places to commit the ultimate crime and know you'll get away with it. Sick!

I don't think it's just those two states. The missing persons forum reminds me of this constantly.

If they just would of listened to Kronk that first go around....

Boy! Ain't that the truth! This case was a perfect example of Murphy's Law. Anything and everything that could go wrong, did. LE blew off RK when he first reported a strange object in that area, the hurricane blew through and flooded the area with deep, standing water, KC and the A's refused to tell the truth about anything, and, as luck would have it, KC found an attorney who was happy to go along with their lies and confusion. The perfect storm to cover the murder of a 2 year old little girl. Disgraceful! jmo

Yes, and at that time - they would have been more likely to have determined the cause of death. :furious:

She's never going to be held accountable for anything, sad as it is, that's just a fact that we're all going to have to accept. I swear, she could fall into a septic system and still come out smelling like a :rose:

Fortunately Momtective, we know her well enough to know she will keep falling in those septic tanks until she hits one she can't get out of. I think we can rely on that happening...

Since FCA has already been deemed liable to the state and ordered to provide restitution for LE searches and recovery costs, wouldn't that automatically support the grounds for TES' claim as well? He was also working closely with LE at their request to help them almost like a professional partner, like the dog handlers.

I believe it was mentioned a little bit ago that she was deemed liable for the actual investigation, not the searches themselves per say. I didn't think LE could be reimbursed for 'searches' since they are a public agency (meaning they were going to search for Caylee alive or dead).

I understand, and I don't want to split words, but seeing as how the investigation included looking for Caylee because she lied and said she was "missing", wouldn't searching by an outside agency, one given LE blessing and requested by her family and approved by her attorney essentially be under the aegis of that effort?

In my head I was thinking..."well, yes she was convicted of lying so it would automatically support TES' claims now that she is lying in their case!!! :floorlaugh:

I see where your coming from, but again I think it goes back to actually proving that Casey herself authorized the searches (since she is the one being sued). LE wasn't the one that specifically asked for TES' assistance but acknowledged them once they were there. Plus, the motivations behind LE's search and TES' search are not one and the same IMO. LE was searching for a missing child, alive or dead. TES' lawsuit is claiming they were mislead because they thought they were searching for a live child and if they knew the truth (Caylee was already deceased), they would of devoted resources elsewhere. LE was devoting resources to finding Caylee regardless.

GA's friend was at the house, so hopefully he can testify as to what Casey actually said.

And that is the great thing about these civil suits. Wouldn't you give your left arm to be a fly on the wall when TES's attorney starts the line of questioning of the friend....?

Q. So, the day that George grabbed Casey by the throat and slammed her up against the wall and said "TELL ME WHERE SHE IS, TELL ME WHERE SHE IS".. was Ms. Anthonly's response anything other than running into her room and slamming the door???

Q. Was Cindy's response anything other than making George leave the house that night because he upset Casey so much?

Q. Why do you think Casey was so upset if she knew Caylee had been drowned?

Q. Why do you think Casey didn't tell everyone ion that room at that specifc point in time that Caylee had been drowned by George?

I just hope one of the jurors who found her not guilty is aware of all that has come out e.g. psych reports, TES case, etc. But I sincerely doubt it.

I wonder how this will play out. Tim told LE in December 2009 that KC never said "please find my daughter" and in July 2011 tells WFTV she said "I know she's alive out there somewhere ... So please bring her back". Seems like conflicting statements.

Those statements are going to come back to haunt him if he loses the case. Can't blame him though. I'm sure in Dec 2009 he never thought in his wildest dreams he would be in a civil lawsuit 2+ yrs later with her due to her being aquitted.

Often it is not a question of what a person knew as much as a question of what they should have known under a given set of circumstances.

A child was missing per her mother, and TES came to Orlando and met with the family. Everyone knows what TES does. People nationwide and likely worldwide knew that TES was searching for Caylee Anthony. It is unreasonable to assume Casey Anthony did not know. Even if there is no way to prove that she knew, it is perfectly reasonable to conclude that under the circumstances she should have known.

Like you said, he's going to need people (perhaps more than one) to back up his claim that Casey specifically said that to him. His previous statements did not indicate this was the case though.

I'm sure this has been talked about upthread...but here is the transcript of the interview with Lisa Hoffman (Tim's assistant)...THANKS TO VALHALL at the Hinky Meter. Just go down to Lisa Hoffman...it's only 13 pages.

She is not very clear, and the questions are general in a sense in that they did not pinpoint exactly where Casey was when this "map on the table" thing was going on. At one point Lisa says that she personally looked over "their" shoulders....and another time she says Casey was in her room. But AT LEAST she can verify that Casey was in the house when Tim was there.
