Judge agreeing w pros that State has the right to counter the assertions of the defense in mitigating evidence that GT is such a compliant, model prisoner. Defense is the one who raised this to begin w, allowing pros to present evidence that GT's been violating rules while he's been in custody seems fair and reasonable. No mini-trial but a limited presentation of that evidence is appropriate. Will keep letter out, but allowing keeper of records to establish GT's conduct history while incarcerated to rebutt defense claims.

Judge is telling defense that they presented GT to be passive, co-operative individual. But, his actions while encarcerated seem to contradict that. Judge's opinion is that is propper rebuttal to the defense's assertion.

Based upon her review of records, Officer Hayes does not characterize GT as someone who is quiet, compliant, or respectful of rules and authority.

Prediction--the jury will give GT LWOP. No DP in light of the spectrum of possible participation and unknown degree of his exact involvement. JMO

wow, this is very interesting about the disciplinary issue. Who testified that GT was good in jail or good at following the rules? I was gone for a bit?

Judge says rebuttal proof completed. Wants argue and charge this afternoon which he expects will take up to 5:30-6:00 pm. Return 9 am tomorrow when can begin deliberations fresh.

I have no idea what the jury will do with sentencing. I was pretty sure prior to the verdict that GT might have gotten less than the full conviction. Yet, I was wrong.

Just seems very .... almost unethical for the defense attorney to allow in testimony of George being good in jail when they know he hasnt been. Also shows bad trial judgment knowing that state will easily refute it.

Me too. After reading several thrreads in Crime in the News where people are getting very little time for murder, rape, etc.. I thougth for sure this guy would get less than 20 yrs. Boy was I wrong Think goodness!!

I was going to post that I totally agree but then I realized that I was a bit surprised when the jury came back with a guilty on all charges. That being stated, I'm not going to assume that LWOP will be the sentence. This jury sounded very strong on their poll when asked if they agreed with the verdict. They may be going all the way to the DP Sentence. If they felt that he was guilty of all the charges, why not be punished by death? I hate that the judge is going to drag this out another day. I'm sure that the jury most likely thought that tomorrow morning they would not awake and have to go once again into the court room for this case. They probably thought that it would finally end today.
