I think TN Children Services has taken legal custody of the baby and that's why MB was in juvenile court the other day.

Man, I hope so. That is one of my most pressing questions aside from where is Evelyn. Who gets her upon return. I truly hope she’s taken into state care and placed somewhere that is truly and completely vetted as a safe place for her to be.

If MB was in court about Evelyn - she would not be appearing in juvenile court but would be in family court.

How old is MB? She may be appearing in court for prior act before she was 18. Unlike family court, juvenile court deals primarily with minors who have been accused of engaging in criminal behavior but this court only utilizes civil proceedings which means that instead of an actual crime, juveniles can only be charged with delinquent acts.

In general, any individual under the age of 18 may be tried in juvenile court. Periodically, juveniles accused of serious crimes may be tried in adult courts. However, the vast majority of juvenile cases involve petty crimes such as theft, disorderly conduct, drug abuse, and simple assault. Juvenile court is usually less formal than adult criminal court.

This whole case begs the question:

"Which came first, the apple or the tree?"

There's nothing to separate these two in my mind right now.

They're both rotten.

Either one could be behind EB's disappearance.

Or, alternatively, both of them could be.

I fully agree. Literally the ONLY person in that whole group I don't look side eyed at is Evelyn's father.

My guess is that MB didn't release the photo because MB didn't take the photo. What LE didn't tell us is when and where it was taken. The FBI has to be pouring over phone GPS data. Grandma was willing to violate her parole by making that trip across the state line so it must have been an important reason.

I also want to know where MB was getting the money to buy her mother the BMW.

She did not -- no boot means no sale. The failed transaction devolved to theft.

"Get the situation resolved" may cause some people to start getting nervous. I just hope all pertinent parties are being watched carefully. JMO

I think that is a strange comment. I think a concerned, worried Grandmother of a missing baby would be more likely to say "I want to help find my Grandchild".

I fully agree. Literally the ONLY person in that whole group I don't look side eyed at is Evelyn's father.

I also don't look side eyed at EP. I believe he and MB's grandfather (regardless of his past history) are both just genuinely trying to help find this child.

Boswell waived her legal representation in regards to extradition and agreed to be extradited back to Tennessee.

Prosecutors asked that Boswell be placed on a $2 million bond, but no bond was set because of her extradition. Boswell’s bond will be set when she returns to Tennessee.

McCloud also entered the courtroom without handcuffs and claimed he did not know the BMW was stolen.

At one point, McCloud left the courtroom for about three minutes to speak to his court-appointed lawyer. When he returned to the courtroom, McCloud waived his representation and agreed to extradition.

And I'd like to know what vehicles everyone was driving in December because buying and/or selling a car right after someone goes missing is a glaring red flag. JMO.

BBM. This case is in Tennessee not California.

Juvenile courts deal not only with delinquency and status offenses, but also with issues concerning dependency and neglect, child abuse, child support, custody issues, establishing parentage, visitation, and the need for medical and/or mental health treatment for children. Tennessee's juvenile courts have jurisdiction within the following areas:
  • Adjudication of children as dependent and neglected, abused, status/unruly, or delinquent

That might not be a viable option for a young man who is active military, who's father passed away when he was young, and whose mother is battling an extremely aggressive form of cancer. He may not have a very solid support system in that respect.

Thanks for TN Court info. Juvenile court procedure tends to be universal across the states and it's not clear to me what TN calls Family court. If 17 are designated "Private Act" juvenile courts while the remaining 81 are general sessions courts with juvenile jurisdiction, perhaps the general sessions hear family matters. MB very well could have been in court over Evelyn and the court is referred to as "Juvenile Court & Family Courts."

ETA: Confirming TN "general sessions courts" are for family court matters which are excluded from Private Act juvenile court jurisdiction pursuant to Rule 101, paragraph (c) Exclusions.
