So...from reading that article, the owner of the vehicle stated that he couldn't get a hold of either Maggie or Angela to collect payment ? So why the hell isn't Maggie also being charge with car theft, hmmm ?

Nope...not buying this load of crap. AT ALL. Someone is lying through their teeth.
Maybe because her mom is in possession of the stolen property with the owners' registration and plates on the car and MB is not?

sn’t it theft “over $2,500”? My guess is the next stage is theft over $10k and it falls somewhere in between those two.

i had a quick look at the price guide for a series 3 2007 bmw and the price guide have lows of like 6.5k all the way to 20 grand so its a wide ranging value car depending on model and extras and things like that

I may be wrong on this, so please correct me if I am, but I am almost certain that theft over $10K is a federal charge. If the goal is to give state LE power in questioning, plus the ability to extradite, they are better off keeping it under the limit that bring the charges up to a federal level.

ALL MOO: I used to manage several addiction treatment centers, so while I am familiar with common offenses that can constitute a violation of probation or parole, I am no expert on automobile theft and the intricacies of the law associated with it. I think you are spot-on with the fact that the charges were served up as a way to extradite them back to TN for questioning there to this case. It is doubtful that these charges will stick, other than AB’s potential probation violation for crossing state lines.

And I’m not sure if it’s because of previous charges or warrants, but they’re also apparently being held without bond.

Not at all. We only drive BMWs and just bought our teen daughter one for 4K and it is in pristine condition. It is a 2010. Theirs was a 2007 so it is entirely possible. One reason we never buy cars new, they depreciate like crazy.

As someone who has spent time in the Tri-City area and completed due diligence related to whether it was advisable to open a business within the area, I can say that the demographics and culture of this area play a relevant role when evaluating interviews, motives, etc. There are educated professionals within the area, however, this area of the country was targeted by big pharma with opioids (this has actually been reported by MSM, so it is not speculation). There is literally an addiction crisis within Western NC, NW GA, and this part of TN that intentionally created an epidemic of a proportion not seen in most other areas of the country. This is also a mountain community. I saw an interview with someone from western NC once describing the following: “One day someone from the government showed up to tell us we were a poverty stricken community. None of us knew that until they showed up. We just thought that is how life was.” I had an employee from this area who grew up using an outhouse. It was not that her family could not afford to do anything different, it was their remote location and the fact that it was all they had ever known that kept the outhouse going. It is a bit of a different cultural mentality. Like I said, there are educated professionals in the area. There are modern day amenities, however there is also a portion of the population with parents who never attended school or dropped out before 8th grade, and saw this as a totally normal and reasonable choice. Poverty begets poverty. While a portion of the population is progressing, there is a portion who has been left behind. Going back to the interview I referenced, there is a general distrust within the population of government and law enforcement because their presence was unfelt and seen as mostly unnecessary for a much longer time than in most other areas of the US.

Agree with this. My grandparents and most of my maternal relatives lived in Mountain City, TN, and I still have many relatives living in Mountain City and Johnson City. Driving the hour to Johnson City when visiting them was a real treat because there were real stores there and even a shopping mall. When going to visit them, it was so rural and so poverty stricken. There was a sawmill down the mountain road from my grandparents house where we used to play in the mounds of sawdust. Everyone burned their trash and composted, because there were no services. They had an outhouse, which I HATED to use. My parents had moved to the east coast before having me and had a regular house, still very modest, but we had indoor plumbing. Many of my relatives lived basically in shacks with tin roofs and outhouses. Some did have electricity and indoor plumbing, but some didn't. This was in the late 80's/early 90's. Many of my relatives who still live there are still in deep poverty and addiction. I have many cousins that never graduated high school. It's such a different culture than even other very rural places I have lived or been to. I live in DC now but also have a home in the mountains of WV. This girls family looks really rough, but my relatives that I know that still live there are very similar. Poverty does tend to beget poverty.

The AMBER alert said it had front end damage. Would that go into their estimate? Maybe they lowballed it to keep it under federal level?

I guess Maggie just has all kinds of money to throw around at 19, huh ? And the last I heard, Grandma didn't even have a valid license. Go figure.

i don't think so its up to them to really determine that, but we are kinda getting to a point of semantics about this, i think most of us agree its just to hold them that its quite possible they'll never have to answer those charges, all the police care about is where the child is

i'd like to know what happens monday when the holds wear off and they can see a judge under TN law.. then what happens... hopefully she is found then i guess that's the hope

I have also frequented NYC, and to say there is a VAST cultural difference is an understatement. I grew up in SC. Although I grew up in a middle class family, I am the first college graduate. I have a grandparent who married at age 15 and never attended 9th grade. While this seems shocking, it is a part of the culture within many areas in the South. However, honestly, the area I grew up within in SC has progressed more than this particular area in TN. It is actually meaningful when you apply this understanding when watching interviews with various individuals associated with this case.

Very enlightening and helpful, because I really wasn't clear about how the locality affected the case. Now I get it.

My students are (I should say were, as I've recently retired) mostly immigrants and from every country you can imagine. Some cultures as a rule are enormously concerned that their children excel in school. Other cultures, as a rule, (there are always exceptions) really don't want their children in school at all, particularly not their daughters. However, they learn quickly that they are MANDATED to send their kids to school, which some do begrudgingly, but they do it so they don't lose their children to the system. As tremendous a city as we are, most of us live in huge apartment buildings, and the neighbors will know if your children don't go to school. It will be reported. The same is true for drug-addicted parents, and parents who prefer to keep their teenagers home to care for the little ones or to work in stores that they own.

In their home countries, many of the parents did not go to school. They find out that it is unthinkable once they settle in New York. That's why it amazes me that in our own country this could ever be considered acceptable, and I see now how this culture could impact how the parents and grandparents are behaving in Evelyn's case. I suppose in a rural environment it's easier to keep your kids tucked away from concerned eyes.

I think LE's focus right now is on finding the missing baby and the FBI is very likely involved at this point.

Don't get hung up on @$2,500 ---

Criminal theft statutes are categorized as Petty theft, Misdemeanor theft, and
Felony theft. Property dollar value used to determine the Class for the theft charge A - E.

$2,500 is Class D Felony theft. (more, less than $10k)

( § 39-14-105(3).) The punishment for a Class D felony in Tennessee includes imprisonment for a term of not less than two years and not more than 12 years, and a fine not to exceed $5,000. ( § 40-35-111(b)(4).)
