DICKSON, Tenn. (WTVF) — NewsChannel 5 has obtained video evidence showing someone outside of the child's home the night he disappeared.

It is part of the criminal case file against Joe Clyde's parents, and it surfaces just as the judge grants a motion to again delay the trial until next year.

"Your seeing more and more in criminal cases there's a lot of electronic discovery. There's a lot to video and it takes a while to view those things," Leonardo said.

And, that's the reason for another delay of the trial. Defense attorneys asked for more time to sift through hundreds of security camera video clips taken from the area the night Joe Clyde vanished.

And, it doesn't help matters that Krystal Daniels just lost her attorney.

Or, he said the video could also be incriminating if it shows Joe Clyde's parents. His father Joseph Daniels is charged with homicide. His mother Krystal with child neglect.

Large data file postpones Daniels
A judge last week postponed the trial date for Joseph and Krystal Daniels, saying lawyers need time to examine an enormous new batch of information that could be presented as evidence regarding the disappearance of the defendants’ autistic son.

Dickson County Circuit Judge David Wolfe canceled the August 2020 date after being told prosecutors were in the midst of sharing about seven terabytes of information with defense lawyers in the case.

The amount of data is so large that the computer transfer was taking weeks, District Attorney General Ray Crouch said at the March 10 hearing. Further, Wolfe let the court-appointed lawyer for Krystal Daniels quit the case over the volume of data.



University of Oregon computer science professor Kelly Brown, in a blog post on the university’s website, said a one-terabyte file can contain up to 500 hours of video, 310,000 photos or 86 million pages of Microsoft Word documents.

Wolfe didn’t set a new trial date but said sometime in 2021 is likely. He set a status hearing date for September.

Joseph Daniels is charged with murder and Krystal Daniels faces a count of aggravated child neglect in connection with the April 2018 disappearance of 5-year-old Joe Clyde Daniels. Authorities haven’t found a body.

The defendants were in court for last week’s hearing. The hearing shed no light on the nature of the new data being shared, why it wasn’t shared earlier and why the amount is so massive. Crouch said the files originate with the Tennessee Bureau of Investigation.


The hearing also didn’t make clear whether prosecutors plan to use the data as evidence, or whether defense lawyers demanded the information to try to aid their clients, or some combination of the two theories. The case file is under seal, so any documents on the matter aren’t available.

The data transfer was happening as part of the evidence-sharing phase in the case known as discovery.

“We’re fixing to get seven terabytes-plus of discovery,” public defender Jake Lockert, representing Joseph Daniels, said at the hearing.


Crouch told Wolfe moments later: “It’s been transferring for three weeks.” He didn’t say when the transfer might be finished.

Wolfe granted Lockert’s motion to delay the trial. He also granted a motion by Andrew Daugherty, the attorney for Krystal Daniels, to withdraw from the case.


Daugherty has a private law practice in Nashville. Daugherty is a sole practitioner, and poring over seven terabytes of new information in the Daniels case “would likely shut down his practice,” Wolfe said.

Wolfe appointed Michael Flanagan, also of Nashville, to replace Daugherty.

Wolfe further granted Lockert’s motion to have Joseph Daniels brought one day a month from state Department of Corrections custody to the Dickson County jail in order to make it easier for Lockert to meet with his client.

Crouch didn’t oppose any of the motions.

Krystal Daniels remains in custody in lieu of $1 million bond, an amount Daugherty failed to persuade Wolfe to lower to $50,000 last October.

At that October hearing, Daugherty said the amount is “unconstitutional” and doesn’t fit the charges against Krystal Daniels. Wolfe sided with prosecutors, saying she was a flight risk and that nobody in the community had vouched for her reliability.


The defendants reported their son missing in April 2018. A large search-and-rescue effort was mounted, and later, authorities filed charges against the couple.

Tomorrow will mark 2 years since we first began searching for little Joe Clyde Daniels. We continue working alongside the TBI daily in the hope of bringing this case the closure it deserves. We have regular meetings with District attorney General Ray Crouch Jr. and his staff. We remain as focused today as day one despite the unnecessary distractions.

We remember all the citizens and businesses that helped us during this tragedy.

Did anyone else notice the little slip of words in her letter?

"In all reality, in my mind I think that if a parent really knew that someone hurt their child I don't think that they would be willing to try and help law enforcement in any kind of way."

IMO she spoke the truth, she just didn't know she did.

If you mean the brother's statement about seeing "someone" stab Joe Clyde with a knife then I suspect those 5 terabytes of discovery includes information about it.

IIRC Joe Clyde's brother is two years older which would have made him 7 at the time of the disappearance. A lot of factors could have caused him to make his statement - including that he really did see someone stab Joe Clyde - and it's likely the TBI and FBI have conducted forensic interviews with him.

At face value I'm inclined to believe Joe Clyde wasn't stabbed that night since nothing has been released about blood evidence in the house other than Joseph's blood on the shovel. Results of the testing for mitochondrial DNA on the hair found on the shovel hasn't been released.

What caused the brother to make the statement is anyone's guess: was he threatened, manipulated, did he create a "memory" in order to block out the reality of something he witnessed? Have the authorities talked to him again now that he's 9?

Krystal's August 2019 letter to reporter Nick Beres made no mention of someone other than her and Joseph being in the house. Her letter appears to be in response to Joseph's July 2019 letter to his parents where he accused her of suffocating Joe Clyde and threatening him with a knife when he tried to intervene yet her only mention of it was saying it was one of the reasons she is divorcing him.

[Joseph's October 2018 letter to his parents accused her of being responsible for Joe Clyde's disappearance. He claimed Krystal had help from someone but said the person picked Joe Clyde up alongside the road. He also said he believed Joe Clyde was alive.]

Sorry for the lengthy response. As you can see :rolleyes: I too have tried to analyze the brother's statement to see if there is merit in it and in the end *none* of claims by anyone who was in that house subsequent to the original confessions by the parents make sense. No pattern arises, no dots connect. This is all my own opinion and subject to change in the future.

FOX 17 News is told TBI agents are cutting down bushes and searching the property that the home sits on.

The reporter said LE is using dogs. They haven't searched the home but only served the warrant to the grandmother who's living there. The focus seems to be on the yard.

I've been watching Twitter and the last tweet was about 20 minutes ago. Nothing new, so far all we know is that LE is using dogs and digging on the property.

Something must have changed but if someone talked I'd think the digging would have turned something up by now. If they set up tents it seems like they plan to be around for a while. Hopefully we'll hear why LE returned to the home.

Latest update from 30 minutes ago says neighbors say Agents have been searching since 9:30 this morning.
TBI Agents searching home of Joe Clyde Daniels as part of 'ongoing investigation'
Several holes were dug and trees and brush were cut down along the Daniels’ family backyard fence.

District Attorney Ray Crouch, who is the state’s lead prosecutor of the Daniels, was on the scene during the search Thursday. Several sheriff’s office officials and TBI agents were also involved in the search.

So the DA was there earlier and LE is focused on the fence line. Another report said they were collecting evidence but no word on whether they found any evidence.
