Joseph Daniels trial: Venue change requested

The attorney representing Joseph Daniels has requested a trial venue change for Daniels, who is the lawyer’s second high-profile client. Public defender Jake Lockert, who also represents Steven Wiggins, made the same request for Wiggins.

Lockert states the same reasons the Daniels trial should be in a different building as he did for the Wiggins trial last week. Lockert also filed a separate “Motion for change of venue” document for both clients. The documents list new reasons a venue change is needed for both clients, including:

Daniels and Wiggins assert they cannot receive a fair and impartial trial in Dickson County.

District Attorney Ray Crouch, according to Lockert’s filing, has agreed the jury pool will need to be in a different location — but Daniels and Wiggins both assert a different location is also needed.

Lockert’s affidavit was filed Oct. 19 with the Dickson County Circuit Court Clerk.

The trial for both Joseph Daniels and his wife, Krystal, who is also charged with murder, is currently set for March 19, 2019.

NASHVILLE, Tenn. (WTVF) - The public defender for the father accused of killing 5-year-old Joe Clyde Daniels plans to file two motions this week to change venue for trial and move him back to the Dickson County Jail.

He also plans to have his client's confessions thrown out, which is has been a big evidence for prosecutors.

In the motion, which has yet to reach circuit court, public defender Jake Lockert said his client is "being adversely affected physically and mentally by his being housed with TDOC inmates and away from his family."

The motion also stated that Daniels has lost more than 45 pounds in prison, and is mentally ill and requires medication to remain competent to stand trial. Recently, Daniels was deemed fit to stand trial after a mental health evaluation at Middle Tennessee Mental Health Institute, his second mental institution since being arrested.

Despite the confession, there is little or no physical evidence including a body, so if Lockert gets the confessions thrown out, it could be troubling for the state.

"He's [Daniels] got no clue where the little boy is," Lockert said.

Lockert said detectives coerced this confession and he'll hire an expert to show how they manipulated and confused his client.

A hearing will be scheduled later this month to discuss the motions. Daniels is expected to go to trial in March, but Lockert says there could be delays until next summer or fall.



So... if anyone can get into Dickson County court records & could get the date for this motions hearing, it would be greatly appreciated! :)

Right? And now he’s saying he’s so easily influenced. What happened to the genius IQ? It couldn’t be that he’s trying to get out of trouble or anything. I swear if they get off for this I will lose it.

IMO his "genius" brain is focused on weaseling his way out of the murder charge. By now he's aware of "no body" cases in other jurisdictions - some are successful, others are not (Delano Wilson's dad got off even with video evidence). IMO he's playing the odds.

Just read that David Marshburn is on his way to Tennessee. Hopefully he can bring him “home” like he did with Lucas. :(

New Investigator Looks Into The Case Of Missing Joe Clyde Daniels

A new investigator has taken the mysterious case of little Joe Clyde in Dickson County.

David Marshburn has solved some high-profile cases across the country. He arrived in Dickson County this morning to begin working to Joe Clyde case.

You may recognize the name Marshburn. He was instrumental in solving the high-profile cases of missing U.S. Army Specialist Kelli Brodeaux in North Carolina and 5-year-old Lucas Hernandez in Kansas. Now, he's turning his attention to Dickson County.

Judge agrees to bring in outside jury in Joe Clyde Daniels case


DICKSON, Tenn. (WTVF) - Suspects in two, high-profile cases in Dickson County appeared in court Tuesday, where their attorneys sought a change in venue.

A change of venire was granted in both cases, meaning an outside jury will be brought in and the trial will remain in Dickson County.

At one point, Joseph Daniels took the stand and requested he be transferred from Riverbend Maximum Security Prison.
[.....]
However, a judge denied his transfer request.


And of course the article doesn't give the next court date....
