NASHVILLE, TN (WSMV) - Friday marked the last day of motions hearing before the Joe Clyde Daniels trial, which will start June 1.


Daniels has recanted the confession since, but now the question is: will those confessions be allowed and used as evidence in the trial?

On Friday, Judge Wolfe said next week he will make a written ruling if the confession videos will be allowed in trial.

Dr. Richard Ofshe, a social psychologist and professor at the University of California Berkley, took the stand as an expert on police interrogation methods. He says his research proves Joseph Daniels’ interview with two TBI agents was coerced. He says they forced him to believe he murdered his son...

One of Dr. Ofshe’s reasons Daniels was coerced was because he failed a polygraph test.

“You’ll see as we go forward, the interrogators use his failure on the polygraph to constantly tell him we know you know the answer to whatever question they have asked,” Dr. Ofshe comments. “And the reason they know that is because he failed the polygraph.”

“You are only recalling what you believe is helpful for the defendant,” argues District Attorney Ray Crouch. He says Dr. Ofshe’s analysis is biased saying he needs to look at the other two confession videos and evidence before he makes these statements.

A cell phone data expert also testified on Friday whether Joseph Daniels’ phone moved the night Baby Joe went missing. Judge Wolf ruled that data and other Google data will be allowed in trial.

Confessed on 4/6/18. Waived rights to Prelim hearing. Joseph Daniels told officers that he beat his son to death after his son urinated on the floor. But recanted his confession saying he was coerced.
Trial set to begin on 6/1/21 for Joseph only. Jury will be sequestered during trial. Will be picked not from Dickson County.

*Krystal Nicole Daniels (27/now 30) “mom” arrested & charged (4/8/18) & indicted (6/8/18) with criminal responsibility aggravated child neglect & filing a false report. Charged (5/26/20) with criminal responsibility aggravated child neglect, accessory after the fact & making false reports to officers. $1M bond.
Trial will be set after Joseph’s trial ends.

5/13/21 Update: Judge David Wolfe will consider several pre-trial motions & is expected to decide this week whether that confession can be used during the trial scheduled to start June 1. Judge rules two pieces of evidence will not be admitted in Daniels' trial. Those pieces of evidence include a police report filed by a woman who said her daughter talked with a boy some people believe to be Joe Clyde before he went missing. The other piece of evidence is a transcript interview with a neighbor, Matthew Ledford, who may have also seen Joe Clyde while in his driveway. Judge David Wolfe is expected to decide this week as to whether his confession will be allowed at trial. That didn't happen Thursday, though. Instead, the defense argued that law enforcement acted with bias in the investigation, potentially missing out on a lead. The judge disagreed that law enforcement was biased in their investigation as they were already searching for Joe Clyde in the area at that time. Motions hearing continues on 5/14/21.

He also ruled that the state will have to meet the “Bishop standard” — corroborating evidence that backs up a confession — at trial, not during pre-trial motions. Wolfe says they can still dismiss the confession at trial if the state doesn’t provide that evidence. During motions hearings last week, Daniels' attorneys argued that law enforcement acted with bias in their investigation & may have missed a lead in the case. However, Judge Wolfe disagreed. Next trial on 6/1/21.

NASHVILLE, Tenn. (WTVF) — Who will testify? When Joseph Daniels stands trial for the murder of his son, Joe Clyde, the jury will hear from law enforcement. But what about the boy's family members who were in the home when the 5-year-old disappeared?

His siblings have been subpoenaed

Obviously, we won't hear from Joseph Daniels, who is on trial for murder. But there were four other people in the home that night besides Joe Clyde -- the mother, Krystal, an aunt and two sibling boys -- ages three and eight at the time.

So, will Krystal be called to testify against her husband? She can be called, but her attorney has said she won't take the stand -- that she will take the 5th against self-incrimination.

Both children -- now ages six and eleven are under subpoena, and both have been questioned by authorities in the past.

What, if anything, they will testify to remains to be seen.

IT’S OFFICIAL: THE JURY WILL COME FROM CHATTANOOGA.
Prosecutors and defense attorneys will begin jury selection in the Joe Clyde Daniels murder trial next Tuesday in Hamilton County.
The father Joseph will stand trial in Dickson County charged with murdering his son.
The judge decided to bring a jury in from outside the area because of pre-trial publicity and the fact that so many people in Dickson County seem to have already made up their minds on guilt or innocence.
Interesting that the judge chose to go to a city much larger than Dickson.
A good pool of prospective jurors to draw from there.
Folks in Chattanooga likely know far less about the case and I imagine some probably have not even heard of it.
I think the jury of twelve and at least two alternates will be chosen by Wednesday at which point they will board a bus to bring them from Chattanooga to the courthouse in Charlotte.
Best guess — opening statements in the case will come Thursday morning ... perhaps Wednesday afternoon.
The judge will want to move the trial along.
These jurors are being asked to leave their homes, families and jobs for what I expect to be at least a week for the trial.
They will be sequestered in a hotel when not in court.
My understanding is the trial will run Monday through Saturday 9 a-m to 5 or 6 p-m.
Of course, legal analyst Nick Leonardo and I will be on gavel to gavel coverage of the trial from start to verdict.

6/1/21 Tuesday, Day 1 of Trial: Jury selection begins. A large pool of some 100 prospective jurors have been assembled with the goal of finding 12 jurors and at least two alternates. Once the jury is selected, they will be brought to Dickson County by bus and sequestered for the duration of the trial. Jury selection could take between two and three days. If that holds to form, opening statements for the trial will likely begin Thursday or Friday. Jury selection continues on 6/2/21.

CHARLOTTE, Tenn. (WTVF) — The Joe Clyde Daniels murder trial begins in Charlotte Thursday afternoon, thrusting the small Dickson County town into the national spotlight.

The only thing close to rush hour traffic in Charlotte is the lunch line at Wall's BBQ. But even that food serving line isn't in a big hurry. "Charlotte’s been a sleepy little town," said James Boyd Wall, owner of the meat and three. "Country atmosphere."

The population of Charlotte is just under 2,000 people, and it may feel like that number doubles, between all of the reporters and the people interested in this trial, coming to the courthouse to watch. "Really tugs at the heart of people,' said James.

#JosephDaniels - A few Covid-related notes about this trial. Masks are NO LONGER required in the courthouse. Therefore, we should see witness faces. (yay!) Social distancing will still happen inside courtroom but will be 3ft instead of 6ft.
