Same public defender as CA-H. Requesting a gag order in this case, as well. This appearance is only in relation to the murder of Mr. Tunstall. Charges forthcoming for the other victims. Next hearing Sep 13th.

ETA: Charge is first degree murder. Penalty is life with parole, life without parole, death penalty.

I can hardly bear to look at this man's court appearance. Was he cuffed and/or shackled? Was he still flashing that broad grin?

Our world is crumbling. My sister used to live in Memphis. It WAS a beautiful city. Heaven help them all now. JMO.

he doesn't look nearly as cocky in court as he does in livestreams where he is shooting innocent random folks.

It seems the first shooting was not random.

According to witnesses, Kelly and Tunstall had been friends. The two were eating with other friends at a home on Lyndale just after midnight Wednesday when Kelly allegedly pulled Tunstall aside and shot him in the head.

But Kelly ultimately took a pleaded guilty to the reduced charge of aggravated assault.

He was released in March and, according to his aunt, worked as an aide in a home for the elderly before Wednesday's chaos.

He's looking at his guaranteed future of life without parole or the death penalty. No more live streaming on Facebook. No more social media period. Hard time in maximum security prison. I can't wait for his trial. That's one I'll follow.

IMO .. I'm thinking that whatever he was high on during his rampage has now left the building and they've probably had to give him some medicine to help with withdrawals. Would definitely explain his deer in the headlights look during his court appearance.

Likely. I highly doubt Kelly and Tunstall had gotten together with friends after midnight on Wednesday to "eat". It's not exactly the dinner hour. jmo

Dewayne Tunstall spent Tuesday night as he spent most, cooking at his friend's house just north of Summer Avenue.

Inside the home, Marcus Cash was laying his 8-month-old daughter in her crib when he heard a gunshot fly through the window a yard from where he stood. Another went through the shower wall where his fiancé was bathing.

Cash and Tunstall worked in construction and home renovation, and they recently purchased a barbecue trailer to launch a food truck called "Everybody Eats." Cooking was Cash's passion, but helping bring the truck into fruition was largely from Tunstall's support of his talent.

Although not officially launched, they were cooking and selling food from the truck Wednesday, Cash said.

Kelly came to the house and bought a plate with three ribs, six wings, spaghetti, baked beans, coleslaw and a Hawaiian roll. Within 20 minutes, shots started to ring through.

Cash only vaguely knew Kelly, but said that Tunstall knew him quite well. But to his knowledge, there wasn't a conflict between the two.

In February 2020, Kelly, then 17, was charged as an adult with attempted first-degree murder and other crimes in two shootings committed a few hours apart. Both victims survived but did not cooperate with prosecutors, according to court records, and Kelly pleaded guilty to reduced charges of aggravated assault in April 2021.

Kelly was sentenced to three years in prison, but was released in March after serving just over two years behind bars, including credit he received for time he was jailed prior to his plea.


Months before his release, Kelly was denied parole in September 2021.

Ahead of that decision, he said at a parole board hearing that he had left high school during 11th grade because he had an anger management problem. On an assessment for inmate risks and needs, a parole hearing official said he scored high for “violent,” according to a recording of the hearing.

Wow! If he was working in a home with elderly people, that place needs a Joint Commission review, stat! No one with a violent criminal record should be working in any place with access to vulnerable people.

There is a problem with the hiring process. All people who work with seniors should have a criminal background check.

I thought they already did that..I think they only go back seven years...not sure about different states..

This horrific video of him shooting the guy inside the store looks like he’s foaming at the mouth. Literally. I know that’s caused by a multitude of things, drugs included. It’s hard to see because the video quality is not great but it’s the first thing I noticed. JMO

"The Memphis Police Department has identified of the victims of Wednesday night’s shooting rampage.

Memphis Police say 62-year-old Richard Clark was shot to death in the 900 block of South Parkway East Wednesday afternoon.

Police say officers responded to the scene at around 4:38 p.m. and found Clark in his vehicle. Memphis Police say Clark had been shot multiple times.

Clark is believed to be the second victim of the mass shooting. The first, 24-year-old Dewayne Tunstall, was shot to death at a home on Lyndale Avenue at around 1 a.m.

Other victims of Wednesday’s shootings have previously been identified. Allison Parker, a West Memphis nurse, was identified by West Memphis officials."
