In a court hearing, the prosecution announced it plans to call on some 20 witnesses to testify against 36-year-old Caleb Cannon when his trial begins next month.

The trial is set to begin on May 15. Cannon has been in custody since October after his arrest in East Tennessee.

The trial for a local man accused of killing his son’s mother and allegedly later confessing in jail is scheduled to begin Monday.

Caleb Cannon is charged in the 2014 death of Nikki Burgess. A former cellmate told investigators that Cannon confessed to killing Burgess and taking her body to East Tennessee.

Her remains still have not been found.

Nashville prosecutors say custody issue drove Caleb Cannon to kill Nikki Burgess

Prosecutors said on Monday Caleb J. Cannon was upset his ex-girlfriend and their 10-year-old son were moving homes so much, while he got to see the boy only every other weekend, that Cannon decided to act.

“So he removed (the boy's) mother, Ms. Burgess, from the equation,” Assistant District Attorney General Megan King said.

Prosecutors offered Cannon's crossness over the custody issue as a possible motive in the case, which will largely rely on circumstantial evidence, during a Monday afternoon opening statement in the trial.

Jim Todd, Cannon's lawyer, urged the panel to scrutinize the state's case, and the police work that put it together.

"This case was a missing persons case for 48 hours," he told the jury. "And within 72 hours of the time Ms. Burgess is reported missing, within 72 hours, before they even search her home, they conclude that my client was involved in her disappearance."

King suggested Burgess was killed in her Hermitage home, just before Cannon was late to pick up the couple's son at school. She said cellphone records show Cannon was at the home for an hour.

A friend of Burgess', Stephanie Lamoreaux, testified that Burgess sent her a text message that afternoon saying Cannon was angry.

And then several unusual things happened, according to the prosecutor.

Instead of getting on the road immediately to East Tennessee, where Cannon lived, father and son returned to Burgess' house, King said. Cannon lived in Andersonville.

The boy, as well as his friend, are expected to testify that they were not allowed to go into a bathroom at Burgess' home during that time.

Son, neighbor testify in Caleb Cannon murder trial

The boy, who is now 13 years old, was asked about the day his mother disappeared. The child's friend, who is also 13 years old, also testified.

Both said they smelled bleach inside the house and that Cannon told them they could not go into one of the bathrooms. Burgess’ son also recalled his mother’s allergic reaction to bleach.

The state showed Cannon's son had initially lied during his first interview with the Nashville Children's Alliance in 2014. He said he lied at the time because "he was really scared and didn't want to get his father in trouble."

The son's friend testified that he saw Cannon leaving Burgess' house "struggling" to carry a large duffel bag before going to pick up his son at school. He also said that Cannon's son was "nervous" when they were playing together later that day.

Both said it was odd that Cannon was inside Burgess’ house without her being there.

Burgess’ former neighbor also took the stand. James McCavanagh said the two were close and hung out together about three times a week.

He says late one night in May of 2014, he went out to his car and saw two people moving something out of her house.

“This real big duffle bag being pulled out, and there was one person on one end and then there was another. That is when I saw someone’s head popped out. There was obviously two people trying to get this thing out of the house,” explained McCavanagh.

“It was hard for them to move this object. It was not an easy task, you could obviously tell. It was like if you could fill a bag like that with sand,” he said.

“Do you see the person you saw standing in that porch area, in the area of Nichole Burgess’ residents, the person you described as pulling the duffle bag out of the house? Do you see that person today? Can you point him out?” asked the attorney.

“He is right there,” said McCavanagh, who was pointing at Cannon.

Crime scene investigators, cell mate testify in trial for Caleb Cannon

Most of the witnesses who were called to the stand on Wednesday are Metro police crime scene investigators who went through the evidence collected at Burgess' home.

Officer Charles Linville said he lifted latent fingerprints from inside the house. He said they used a product called Blue Star to check for possible blood stains.

Linville said they found what they call "presumptive blood" on the floor at the foot of Burgess' bed, on a fitted sheet in a laundry basket and on a towel in the hallway of the house.

Brian Brewington, Cannon’s cell mate, testified that Cannon told him he killed Burgess.

“He had showed up earlier that day, and when he arrived at the house, there was another kid. He sent them both outside, had the house to himself,” he said.

Brewington said Cannon told him he got into an argument with Burgess and became angry when he thought she was sending a text to a friend asking them to call police.

“He followed her to the bedroom, took out a pair of brass knuckles, struck here in the back of the head. He took a cord that he ripped off an appliance and wrapped it around her neck, strangled her to death,” Brewington said.

“He took the body and put it in the bathroom,” Brewington added.

“Retrieved a tarp, put her body in the trunk and took her back to Knoxville,” he said. “When he took it back to Knoxville, he took it to a farm and put it in a machine that ground up her body. That was meant for feeding pigs.”

Guilty Verdict! Life in prison.

NASHVILLE, Tenn. (WZTV) — A jury has found Caleb Cannon, guilty of the first-degree pre-meditated murder of his ex-girlfriend and mother of his son Nikki Burgess.

The jury deliberated less than two hours when the trial wrapped up on Monday. The verdict comes with an automatic life in prison sentence.

Friends, family of Nikki Burgess relieved, feeling bittersweet by killer’s conviction

“It’s a bittersweet thing,” Shannon Million, a friend and co-worker of victim Nikki Burgess, said. “We’ll never get her back.”

“It’s the best outcome that we could possibly hope for,” Million said.

Though questions surrounding her death still linger, friends said they are breathing a sigh of relief that justice has been served.

“We’ll never see her again but at least we have justice and this guy is going to be in jail forever,” Million said.
