Not defending what TP was saying about HIS impression of KC for the two hours he spent with her......by-the-way have you actually seen TP. He's an attractive guy. KC may have been really nice to him because he is exactly that, an attractive guy. I don't think it is up to the bondsman to make a determination as to whether their client is guilty or innocent, just whether or not they think this person will flee. Not everyone bonded out by bondsman are guilty and I would imagine some who are guilty could be quite nasty but TP's observation of KC for those couple of hours is that she was very respectful to him. If he said otherwise and it was not true he would be no more credible than the person he bailed out of jail. And if I remember correctly there were quite a few people on this thread at the time KC was bailed out who thought she may have been innocent. JMO

If forgery and subsequent fraud can't be proven, the only risk Baez took was that the motion would be thrown out or denied. Baez may have felt this risk was worth it to have Tracy's testimony barred. Nothing ventured, nothing gained, so to speak, on Baez' part.

Tracy's testimony must be very helpful to the state for Baez to make this decision if that is, in fact, what he did. And I hope that, contrary to what Baez expects, the forgery can be proven and he will be disbarred. He's gotten away with way too much already and shouldn't get away with forgery and fraud. Ignorance is one thing but criminal activity is unacceptable and should be punished.

I'm just glad there was a "time out" of sorts called during the Hearing, regarding this matter, and Baez was ordered to give the Original to the State prosecutor and if they find anything faulty with it, then they show it to the Judge.
Baez probably thought the Judge would rule on that Motion regarding the Padilla crew right then during the Hearing on Friday (and nobody would do any further investigating into the authenticity of the agreement documents). I think the whole thing backfired on Baez, including George's testimony.

Maybe irrelevant to the motion but I think it should be investigated. If the document was forged and he's guilty of fraud it should be pursued and he should be disbarred.

I agree! But ...... it won't happen automatically ...... the Florida Bar will not investigate the matter unless "someone" files a complaint, backed up with evidence of fraud. Someone has to take action and contact the FL Bar.

Aren't attorneys legally obligated to report such as this? I thought I read that here at one time. If that's the case, then the SA or even the judge will have to report it if they become aware of it.

That is my understanding as well. If something unethical or illegal was done, they have an obligation to report it to the Florida Bar. They cannot simply ignore it. I am just hoping that this matter does not get declared a moot point if Judge S. makes a ruling and denies the defense Motion to bar the Padilla crew testimony (the agreement will not matter at that point). However, even if the Judge denies the defense Motion .... it does not change the fact that it has been alleged that the defense attorney committed FRAUD when he filed an alleged fake document with the Court - Baez cannot undo that filing.
 
You have JB pegged. He, no doubt, will wait for the judge's ruling before turning over any "originals". Then, they'll be a moot point. I hope the judge see's this coming and holds out on his ruling until the originals can be produced.

No worries though. I expect there will come a time when the FBA will want to see the original documents. I hope so anyway.

You said it....I am prepared that, at trial, the judge will not act on a lot of things that make me holler at the TV...For example, I wanted him to tell GA in no uncertain terms to cut the attitude at the 08/21/09 hearings, though it didn't happen.
Perhaps behind the scenes, they are handling things more professionally than I am inclined to (I would have liked to have disbarred him months ago!)

Gorgeous hadn't been home in a month, and she walks in the door to her adoring Fan Club and her Dear Attorney. I doubt TP spent more than a minute in a tete-a-tete with her - Cindy would have been monopolizing the conversation, George would have been basking in her mere presence, and Jose wouldn't have allowed it.

TP deals with some rough characters. Since she didn't actually spit in his face and kick him in the family jewels (yet), he probably took that as a sign of respect.
 
That being said I have a couple of questions..thanks

When you see them causing pain to others or obstruction of justice..how does this make you feel about folks that haven't done you wrong but have wronged others?

ITA and also, it would seem to me that if something as serious as FRAUD has been alleged against the defense attorney in a criminal case, that this serious matter must be resolved before any further Motions are filed by the same defense attorney in the case. It would make every piece of paper this attorney files come under suspicion, IMO.

There was no deadline set during the Hearing on Friday .... it was just left that Baez would turn over the Original to the State and if it looked OK then nothing happens ... but if something looks fishy then the State shows it to the Judge.

It looks like it is something that the State must pursue - and may end up filing a statement or Motion to the Judge regarding the matter - would be my "guess". But, we have no idea of the timeframe. We just have to wait and see what comes out in the news (or through Tony P ?).

When first meeting KC, do you think Tony should have known immediately that KC was a sociopath, and she was just acting or do you think when confronted with the particular question of what KC was like, he should've provided a composite of all the thoughts he was to later acquire?

Usually when LE questions someone about a particular moment in time, they're seeking exactly that person's impression of that moment in time, not some response from out in that person's future.

For Tony to characterize KC as being something other than what she revealed to him during that initial time period would technically be lying about that moment in time.

If that's the way KC presented herself, then that's the truth whether any of us like it or not.

It sounds to me like Tony came to see the real KC, so for me, I don't have a beef with that.

Not only that but he works with a kit sociopaths.

His concern is that the subject get to court and not rabbit. Not whether the subject is fit to enter a convent.
 
It seems that some of our fellow posters are truly offended and outraged that Tony made the observation that Casey was a nice girl. Why is that? We all know that Casey can be VERY nice when she wants to be so why the storm over Tony noting this fact? I for one, as some others have stated, believe that if she was JUST out of jail and busily preparing dinner for the man and smiling and being as charming as she possibly could that we should examine that for what it says in light of the situation.

To me, having this side of the story revealed tells me some things.
1) Casey is a VERY self-serving girl and will put on her very best face for someone who can HELP her.
2) Casey is a very shallow girl, if, having been incarcerated for over a month and her daughter, her two year old daughter, still MISSING and unaccounted for, she is flitting around to please yet ANOTHER man.
3) Casey is a serious con, and a crafty girl and CAN be very charming and gracious when it is of benefit to herself.
4.) Casey is no fool, and putting on her prettiest smile for the man who gave her freedom back at a half a million dollars bond was the ONLY choice in her mind.
5.) Casey could care less about Caylee and loves ONLY herself.

I for one am happy that Tony has honestly shared the situation with us, exactly as it happened and how he saw it at the time, because we can learn something more about Casey from this information.:woohoo:
 
i have a lot of things i would like to say... but i would get banned

but to say the things he says about certain people that we all have seen the wretched things they have said and done in real life and on video and then to not say but imply some negative things about some people that have not done much of anything on the negative side...

well,,, he would have better off to not IMPLY anything about people that appear to be pretty honest and decent people

ITA and I don't think Tony was saying she was innocent or could never have committed this crime, but rather that at the time that he was with her she was very nice to him. Having done what she did does not change that fact.

More than that --- why would one set up a separate file for this rather than keeping it with the other related docs? I guess it's possible that it's all alone in a file labeled 'privacy agreement' but it just seems common sense to me to retrieve that doc and put it with all the other related docs for ease of reference.
Ya know, seeing that JB is so quick to yell "Privacy Agreement" and seems so worried about what everyone could say, you'd think he would have been ok with a gag order early on. Don't ya think?

Well his first clue on meeting Casey, might have been that because he was bailing her out on a charge of Child Neglect and filing false statements in the investigation of her child's "disappearance" there was a good chance that she was not a very nice person! You think? . She was the only suspect in the Police investigation, video of her lying to Police was all over the news and talk shows, to saturation point, and it seems everyone but Tony and Lenny had at that stage made a fairly accurate assessment of the character of not only Casey but the entire family. Soon after release, Lenny saw this girl for the sociopath she was and started to regret the bond. Now TP says she was just a charming girl who made him dinner and pleasantries... Oh, you mean to say she was not distressed? - not desperate to find her child? -not grieving for her? - not sending out searchers for her? not contacting Equusearch to mount a search?- what she was doing was making mac n cheese and chit chatting. What would that tell ANY reasonable person about the personality of this girl?
I thought he did acknowledge that there was something "off".
