Four women arrested after going topless on a downtown street last month say they didn't break any laws and want the charges against them dropped.

The women, each charged with exposure, are to appear Tuesday night in village court. If convicted of the violation they each face 15 days in jail and/or a $250 fine.

Charles Marangola, the attorney representing the women, said he's filed a motion to dismiss the case, maintaining that a 1992 state Court of Appeals decision allows women to go topless anywhere a man can.

In Canada some years ago, we had a similar case. A young women on a very hot day, took her top off and went for a stroll.

She was arrested, charged and convicted. But on appeal, the court stated that if a man was allowed to go topless in public, women can too. Because the law would apply equally to both sexes, not gender specific.

So in Ontario, if a women so chooses, she can go anywhere topless without being arrested as it is her legal right to do so............

You can't charge a women for being topless and then the man beside her who has no top on cn=an go on his merry way..........

That is not fair and equitable.......application of the law
