Trial break: The State vs Jodi Arias; trial resumes 4 February 2013

Dang, cleaned the house today so I could be ready for the trial and then went into my bathroom for something and saw disaster. Feathers all over everywhere, rugs bunched into a mess and everything turned over on the counter and my cat throwing a dead bird up into the air playing with it. She uses a cat door to go in and out of the house. :what: I feel horrible because I filled the bird feeder a couple of days above. Now, I feel like I set up dinner for her.

I'm going to open that can of worms again.........where is it said that Jodi had to shoot Travis in the shower? Couldn't she have stabbed him while he was in the shower, he made his way from the shower to the sink, she stabbed him in the back and head, he made his way to the hallway of the bathroom almost to his bedroom, she pulled his head back and slit his throat, dragged him back towards the shower, shot him in the head, then put him in the shower again when she was done killing him? Just because Travis was found in the shower with his left side facing out does not mean that Jodi had to have shot him first when he was in the shower.

I don't know. I'm not in the business of murdering people but, rationally, if I was determined to do so, I think I would start with the gun. It just makes a lot more sense. If I had both weapons, I think I would shoot first. Why mess around with all the blood and precision required from a knife, before pulling out the gun?

I think she shot the gun. He didn't die immediately; she tried to shoot again and the gun got "stuck".

It's all part of her "ninja" story. I think its a part of the truth.

Travis had it? He hid it in the bathroom?

The gun had to come from somewhere?

That's been an ongoing debate and both scenarios are believable to me ~ so many great questions and answers to both!

I started out thinking that Jodi would have used the gun first and then resorted to stabbing and slicing when he refused to die. After listening to the ME and the prosecution I tend to agree with their basis that the gun shot to the head came at the end.

Thanks LambChop but I'm looking for the Prosecution's statement. The video on YouTube starts late, I can't find it Transcribed and I googled my heart out and couldn't find it either.

I didn't see anywhere on the ME drawing of the body with pen markings that indicated where the stabs were that were in the spine. But I haven't been able to follow very closely. Did the ME say anything about a stab to the spine? I did hear her interview where she said he said he couldn't feel his legs and that's why she couldn't save him from the ninjas. LOL.

I saw a photo with 9 stabs to his back but they were to the right of his spine (almost under his shoulder area and all going straight down)

It seems clear that JA’s premeditated plan was to murder TA in the morning in the shower and then drive to her prearranged mid-day meeting with Ryan in Utah but, IMHO, TA delayed getting in the shower which, in turn, delayed JA's plan.

Finally, TA jumped in the shower after 5pm to start getting ready for his 7pm conference call and JA went into action, executing her premeditated plan and TA.

Had the roommate arrived home near 5pm, would JA have carried out her murderous plan anyway, delayed the plan until TA’s next shower, or left the house with TA unharmed???

If her plan were to include the roommate she would have had to kill TA within an hour of the roommate showing up. That is why I believe she waited until 5:30 to kill him. Roommate normally was home by 6pm.

How would JA know that TA was going to take a shower? She could have easily killed him in the bed, anywhere actually. Why did she wait until 5:30 at night to kill him knowing his roommate would be home around 6pm? That means she would have run right into the roommate when she was cleaning up, etc? We know she intended to kill TA because we can see her plan, step-by-step. I still feel she had plans for the roommate and may have planned to make it look like a murder/suicide to take the attention off of her. Travis was in the shower and no threat to her she could have walked out the door easily. I think the pictures would never have been deleted if that was her plan. She could say she was with TA earlier in the day, then left before the roommate came home. The roommate found the pictures and obviously killed Travis. Jodi saves face because everyone will believe TA perferred a same sex relationship and that is why he rebuffed her. It would account for any of her DNA being in the house but the evidence would be pointing to the roommate.

It may have been a stroke of fortune for the roommate because he was delayed at work that day if this was, in fact, her plan. I just do not see her waiting so late in the day to kill him if this was the plan all along and we know she did plan it all out from the beginning to the end. That could be why those pictures were on her hard drive. She may have been trying to load them onto his computer. jmo

Insightful and good points regarding the shower and the timing. However, I don't believe killing the roommate was part of her plan at all or she could have waited for him to come home. I do believe she intended to kill him earlier in the day but the right moment didn't come; therefore she was late leaving his house and late arriving in Utah. Perhaps from her being with Travis previously she knew he'd take a long, hot shower and she knew this would be the perfect place for her to get him cornered where he couldn't fight back. Or so she thought.

I am not excusing anyone, but children in a family experience things differently based on many things. If a child is sexually abused, burned with cigarettes, and berated, is there no pity for that child who did not choose that life? If that child turns out to be a killer, that person must be kept away from the rest of us.

When I think of my family, my friends and the people I know who provide love, nurturing, opportunities, problem solving skills, academic enrichment, etc and then read about children starved and locked in a closet for years, I wonder about the justice of it all. Cosmic questions.

The death penalty is extremely expensive. The appeals alone make it far more expensive.

Respectfully disagree. She deserves the death penaly. I think that the death penalty needs to be expediently carried out, especially when it is so evident that she is guilty. That way there isn't all that money wasted.

I think some people, like Scott Peterson, see a situation they want out of, weigh the options and decide all things considered, killing the person is the best choice. To me that speaks to all the premeditation, cover up. And is born out of a lack of conscience.

You know with all your heart That Travis was a SURVIVOR..he must fought so hard to survive this attack.

Once again I get so angry that the people who contribute to make the world better and try to do the right things are made to suffer at the hands of people that are like Jodi and Jodi herself...

The thought crossed my mind that maybe the time had come to go read a book and check back tomorrow when trial had resumed so new info will have cropped up.

Stephanie - You did a recap of what you thought happened a few pages back and I agree with it completely. I can't find it now or I would have quoted from it! A few things I'd add...

- I think he kicked her out or she left (but on bad terms) and she snuck back in
- I think she took several of those shower photos without him realizing that she was there
- I think she scared the daylights out of him when she made it clear that she was there (by speaking to him while still photographing)

I'm torn about the picture of his face when he is already seated in the shower. I'm convinced that she had already shown him that she had a gun but I'm not sure as to whether she was threatening suicide or threatening him at that point. He doesn't look scared yet. He looks like he's trying to "reach" her through eye contact. So either, he's trying to settle her down not to hurt herself or not to hurt him but I'm not sure which...

Then all hell breaks loose. She shoots him and he DOESN"T JUST DIE! He manages (who knows what state - primal survival maybe) to stagger out of the shower and lift himself up with the counter in front of the mirror at the sink. (Blood spatters everywhere!). I think she only came "equipped" with the gun. I think she tried to shoot it again and it jammed. He got out and got to the sink while she ran back to the bedroom. According the DA there WAS A KNIFE IN THE BEDROOM that they had used for "tie up play". When the gun didn't shoot again and he kept moving around, I think she ran back the bedroom and got it. She stabbed him in the back at the sink and continued to do so as he stumbled out and then all fours along the hallway. She stabbed and stabbed and stabbed until finally desparately, she slashed his throat from behind while he was on all fours in the hallway entering the bedroom. (Hence the pool of blood there.) She dragged him back to the bathroom on a sheet, cleaned up as much as she could and left. I think TA could still have been alive at that point. Incapacitated and brain dead but still alive!

A brutal vicious murder but one that she initially thought she would handle with a single shot.

I don't buy the "knife in the bedroom" theory at all. I think she's trying to cover her you know what so that it won't lean towards premeditated. I haven't seen any evidence at all about a knife being there (I guess it would be hard to disprove though as TA certainly wouldn't share that info with his roommates).

I found a pic of Travis's shower after he was removed. There is still blood in the shower so some may view this as graphic. This photo shows just how small his shower actually was.

I am spacing the photo down further so the ones who want to can pass over it after seeing my warning.

It makes no sense to me that he would voluntarily sit in the bottom of this tiny shower. Something's just wrong IMO.
