I'm at the point of needing a flow chart for the various lies. What JA said on TV, what she said in LE interviews, her lies that came out of other people's mouths...

I think the disconnect is extended planning v. formed in a second premeditation. Your post speaks to the latter, while the evidence the State seems focused on (stolen gun, gas cans, cell phone off, etc) speaks to the former. I've always said I was surprised that the State is going with stabbed first (maybe they had to b/c the ME felt strongly about that) because the argument that she stole a gun to kill Travis but didn't use it first goes against the State's apparent "extended planning" focus. Maybe the State will offer both premeditation theories to the jury in their rebuttal case, but I don't think so. I think they're relying on the felony murder charge to cover it if the jury doesn't buy the extended planning argument. jmo

One of the arguments of those who speculate that she used the gun first is the idea that stealing the gun but not using it first goes against premeditation. I disagree based on the premise that we don't know anything about the knife. We don't know where the knife came from, if she actually stole the knife or had the knife previously in California, or that she had both the gun and the knife when she entered TA's home that day. There is no reason to disregard premeditation based on no information concerning the knife (other than her word, which is not proof) and speculation concerning the gun. We don't know what was in her mind, we can only speculate based on all the evidence. I still believe based on the ME's autopsy report and the evidence of planning I outlined earlier that she intended to stab him to death and brought the gun as back up. The prosecution has to prove premeditation for the death penalty, which is what this case is about.

Bringing this over from the other thread...

So how much does it cost an entire state when Jodi doesn't get what she wants?

Yes it's going to hit 1 Million just to defend her.
http://www.abc15.com/dpp/news/region_phoenix_metro/central_phoenix/jodi-arias-trial-cost-taxpayers-could-end-up-spending-more-than-1-million-to-defend-arias

Not the costs for feeding her, her medical care or anything in the last 4 years. Not court costs, state costs or anything after the trial like appeals, keeping her in prison and of course the cost of the needle.

She disgusts me not only for robbing Travis of his life but for what she is costing you Arizona people becuase she refuses to just admit what she did wrong.

Nurmi and Willmott disgust me when they needlessly waste court time for being lazy, disrespectful and unprepared. The tax payer clock is ticking.

Actually $838,000.+ isn't bad. Honest. Trials ARE NOT CHEAP! Normally you can easily incur a million in attorneys fees in of itself. That's not counting expert fees and costs. Again Trials are not cheap. Or for the faint of heart.

But I agree it sucks because Jodi is obviously guilty. And it does seem like a total waste of resources.

I don't mean to speak for others here but...

The talk about Jodi and her sex life would not be happening if Jodi and her team did not make it a central part of this trial themselves.

People are irritated that Jodi acted as if she was this innocent little girl who was taken over by big bad Travis who did naughty things to her when all she wanted was to follow her faith. Jodi has taken the stand and talked as if Travis raped her. She has accused him of being a sexual deviant when it's actuality Jodi.

People are angry about that, angry about throwing Travis under the bus sexually. I am not saying name calling is OK but I don't feel people should swayed from talking about sex and Jodi's personal sex life like it doesn't have any part of the trial. It does and it was Jodi who put it there.

When it comes to the defense team.

Personally I would not have such harsh words for these two if it wasn't for their own actions that I find to be disgraceful. They have done things that are disgusting and not needed to defend Jodi. One of them also happens to have NO respect for the court at all as he acts like a lazy pig. Again, this has nothing to do with the defense of Jodi.

However when it comes to Jodi's defense, I give their position in this trial a big fat F. For example Mr. Nurmi putting a photo of a Penis that is not proven to be Travis' up on the giant screen and paces the room droning on about how Travis did horrible things to Jodi.

I also think the mini trials against the State for doing every ridiculous thing under the sun, costing more time and money are pathetic.

I have full respect for those who have to defend the un-defendable. It's not an easy job at all. However I do not have respect for Nurmi or Willmott personally. For their own actions most of which have nothing to do with their case.

One of our verified nurses here stated she believe the two picture of the male private parts were not of the same man. jmo

My DH made a good point a few weeks ago, he saw the shower pics.

He said there is no way TA sat down in that shower (same size as we have), DH is 5'9" 184 lbs and said he would never do it.

Also said, look at his home, do you think he would sit down in any shower especially at the end of the shower. He felt TA was immaculate in his home and person.

Lastly, he said he didn't feel the pictures were posing, he feels TA might have been reflecting on himself once again "slipping." And DH feels the shower door was closed in all the pics except the showing his lower body.

Anyway, those are my DH's thoughts.

Carp.... I am at work and just about time this thing gets started I'll have to leave and listen on satelite radio HLN with all their dang commercials.

Maybe I'll pull it up on my phone so it will still be playing during the commercials.

I hate listening in on HLN and waiting till 9pm my time for the ding dang thing to end. Messes up my evenings.

I'm thinking about it :floorlaugh::floorlaugh:

We have a boat also told him I want to check lake mead may have thrown it over Hoover Dam, again said I'm nuts

Since court hasn't started yet, here's a true story.

I have a bunch of heart problems and see a cardiologist every couple of months. The last time I saw him, as I'm leaving he says, "The nicest people always seem to have the hardest time. I have several patients who are a reall piece of work and they seem to do just fine." Those were his actual words. So I said, "Then if I become a total *****, will I get better?" He said it was worth a try.

So my comment was part of my efforts to heal myself. :floorlaugh:

Strangely, this story is not totally off topic. Jodi will never have heart problems.

There was no morning session. Court starts at 1pm MST, 4pm EDT.

Question
Is will wilmott done with the guy ?
Hln said jury questions
Is that so?

Considering she's doing a fourth direct, I'd say she intends to try to rehabilitate Same Ol' a little bit more.

Then questions after the jurors are each given a can of Redbull.

I was trying to keep a list of Jodi's lies as they were disproven through evidence --- but I gave up about a day after Juan started cross because they were just too numerous to keep track of any longer.

Or whether or not PTSD has anything to do with premeditation?

Or whether dissociative amnesia has anything to do with premeditation?

Or whether DV has anything to do with premeditation in the legal sense?

JM will tell the jury to put all of the distractions aside and focus on the real issues at hand.

I am copy/paste the AZ definition of Premeditation as necessary to find for 1st Degree Murder:

According to AZ jury instruction:
Pr-meditation means intent or knowledge to kill another human being.

"Premeditation" means that the defendant intended to kill another human being or knew [he] [she] would kill another human being, and after forming that intent or knowledge, reflected on the decision before killing. It is this reflection, regardless of the length of time in which it occurs, that distinguishes first-degree murder and second-degree murder. An act is not done with premeditation if it is the instant effect of a sudden quarrel or heat of passion. [The time needed for reflection is not necessarily prolonged, and the space of time between the intent or knowledge to kill and the act of killing may be very short.] pg PDF 71
