I can't stand all this drama surrounding this trial! Why can't there be some order and discipline!? So much secrecy that keeps us guessing every other day about what's going on! I'm glad that atleast Travis' family know what is going on. Prayers for them and everyone supporting Travis.

I was seething when court started after the attorneys, JA & Samantha got back to their seats. Jodi was gloating and gleeful for the first time today, and Samantha and Tanisha were crying.

I hope it is not because JA is intimidating them while they're all together in chambers. It really bothers me. I want to just hug those girls & slap JA across the face.:furious:

Judge says to ALV in talking about her having to return "you will have made preparations"...me thinks she means getting herself an attorney.

Wow. The "testifying for men" issue is worse than I thought. I didn't see the original question from the juror, but having just watched ALV's response nd JM's objection to what she tried to say, it's really bad. JM made it clear that the question wasn't referring to written reports and the question was specifically about testifying in a criminal case. Her answer wasn't an evasion or misunderstanding, it was just a lie.

In Nurmi's request for mistrial, because of prosecutorial misconduct, part of his complaint was that the expert witnesses could not successfully testify because of problems with social media blowback. I wonder if they are calling her back to testify to that?

From the motion:

COMES NOW, Ms. Arias, by and through undersigned counsel to request that a mistrial be declared based on the prosecutorial misconduct that has infested these proceedings with a level of unfairness that cannot be cured by any other means. Ms. Arias bases this assertion on the fact that the circus like atmosphere inside the courtroom that to date has included counsel for the State yelling at witnesses, attacking witnesses on a personal level and throwing evidence. Not content with confining his misconduct to inside the courtroom counsel for the State, pursuant to his own admissions, chose to release evidence that was not coming into evidence at trial to the media and to pose for pictures with his so called fans on the courthouse steps has turned what is supposed to be a trial that comports with the rights due Ms. Arias pursuant to the 5th, 6th and 14th Amendments to the United States Constitution and Art. 2, §§ 4, 15, 23, and 24 of the Arizona Constitution into something that more closely resembles a modern day equivalent to the Salem Witch Trials which ended in 1693. This State of affairs has placed counsel for Ms. Arias in a position that they cannot fulfill the duties they owe Ms. Arias, pursuant Arizona Rules of Criminal Procedure, Rule 6.8. Counsel’s inability to fulfill these duties would thus result in Ms. Arias not having the benefit of the rights she is due pursuant to the 5th, 6th and 14th Amendments to the United States Constitution. Support for this Motion can be found in the attached Memorandum of Points and Authorities that is incorporated herein by reference.
MEMORANDUM OF POINTS AND AUTHORITIES
I. RELEVANT FACTS
OpeningstatementsinthismatterweremadeonJanuary2,20 13. Sincethattimethe State has thrown evidence and his pen, yelled at nearly every witness who took the stand in support of Ms. Arias and has hurled personal insults at defense counsel. In response to this behavior Ms. Arias has had to make several oral motions for mistrial that have beensummarily denied by this court. More recently Ms. Arias has had to make mistrial motions because the State has not confined its misconduct to inside the courtroom. Most prominent amongst this extra-curricular misconduct is his decision to pose for photographs with his “fans” outside the courthouse steps where jurors could potentially see him so doing. In further efforts to prove his case in the court of public opinion rather than a court of law on April 4, 2013, the State unapologetically admitted that it had released a plethora of damming evidence that would not otherwise come into trial to the media. Pending before this court is a motion for mistrial based on the former, Ms. Arias’ motion for mistrial based on the latter was summarily denied.
Note should also be made of the fact that the conduct described above has ramifications that effect the ability of Ms. Arias to present her defense as the public response to this unprofessional conduct has involved berating witnesses via e-mail, telephone and in various internet forums. Said action has not only caused personal distress to these witnesses but has made it difficult for them to provide effective testimony for Ms. Arias....

I'm positive it has nothing to do with any charges of perjury. As much as we talk about it, it's quite rare for a court to actually indict and prosecute a witness for perjury. Here, especially, where her explanations for inconsistency are, if not convincing, at least plausible, it just doesn't happen.

In your professional opinion would it be likely then if it's something she's under subpoena for coupled with the comment the judge made about her "making arrangements" (came across like she needed to find legal representation) that is may be related to her courtroom behavior? Being combative with JM after being admonished, approaching Samantha, or mentioning in an almost defiant manner in her response to juror questions that it's illegal for her to talk to TA's family...all examples of poor courtroom conduct.

What about being dishonest on her CV as an expert? Her CV (minus formal education) she has been busted on less than honest representation of qualifications. Could JM argue to disqualify her as "an expert" in spite of her so called 35 years of experience?

Re Miss Wong; the day after JC was on the stand and Nurmi filed a mistrial on the basis of prosecutor misconduct, Judge Stephens toldNurmi she understand Miss W in court and asked if he wanted to bring her to the stand. Nurmi said no because ALV had been off ill for a day and he was keen to instead press on with ALV's testimony as ALV had other commitments/things on her schedule.

I think you're right. I also think that may be why the judge said she didn't want to hear about her personal issues, especially if they were related to medical treatment or similar. That would be evidence for the hearing and not something to discuss off the record directly to the judge today. jmo

Roflmao! I think it's laughable! This witness doesn't read tweets, forums, emails, texts or instant messages...so she testified!

Wondering: will ALV be paid to come back if its not to testify? Maybe the fact she won't be getting paid (if that's the case) for this Tuesday appearance has something to do with her sour face and trying to get out of it?

pretty sure the answer's no. she's under subpoena to be there.

Things we need to thank ALV for:

1) Matt did NOT see the "handprints" on JA's neck
2) JA shot Travis in the closet
3) JA left the imaginary knife on the night stand
4) ALV will believe absolutely anything JA tells her. Even if she like..like...murdered someone - ALV would still believe her.

What other goodies did she give us guys?

Abusers can CONTROL their anger very well. Person after person as told me how the abuser can be in a raging fit but when the doorbell rings and they answer it, "No problems here, officer. We were just having a little argument and I guess it was kinda loud. Isn't that right, darling? See, everythings fine. We are so sorry you guys had to come out tonight."

Don't believe it? Then just take a look at Jodi. So calm and collected. I bet she takes those little pencils back to her cell and stabs them into the wall until they look like nail heads. When JM was cross examing ALV, did you notice how vigorously she was erasing and sweeping her paper? I did. And if I were one of her victims, that would have brought me in line just like that.


Well said. JA is as hard as nails, which is why this phony 'battered woman's syndrome' defense such a farce. I can visualize her forming a prison gang when she is finally sent away to the big house. No one in prison is going to be safe - she is a natural born killer. ALV is trying to sell the jury a song and dance about how JA didn't grow a spine until AFTER Travis was murdered and she was able to escape her 'abuser'. I don't know how this woman (ALV) sleeps at night!

Looking forward to verdict day when all of the trial watchers can finally say: "Smile, Jodi, and say cheese"!
