trial day 47: the defense continues its case in chief #143

I just rewatched the final few minutes of court today several times on YouTube - they are definitely watching the jury like hawks - what I can't figure out is WTH are they looking for? Jodi literally leans over while standing to look at someone. She smiles and whispers to Wilmott who kinda tosses her head back and up and sneaks a peek. (This happens very quickly - I caught it because I stopped the video several times during this moment.) Very weird. Jodi is always so oddly animated and excited while looking at the jury, but in a creepy way. I don't know how to describe it - she is excited in a predatory way.

(And Jodi doing her usual licky-lip thing while looking at Wilmott's lips during her whisper. This creeps me out every single day!)

I agree. Jodi's testiphony already indicated she was not holding a gun or knife while she was running into the closet, jumping on the shelf, and getting the gun. So what's the point of the picture? Juan already said it looked like a Mexican Chihuahua or a dog. LOL

The testimony today was quite funny (from Juan's point of view). I believe letting the picture in will make the defense team look <unusual> to the jury.

MOO

Mel

I wondered why the DT would even try to bring this into play. It just shows how desperate they are...the last witness in a self defense scenario who is going to say no gun or knife when their story has been she ran into the closet to get the gun?

I'm fairly certain JA pushed this one, just because it is so juvenile. And so last minute.

Did Juan ever mention JA was holding a weapon on TA in that pic?

NO.

Here are the times of the last 5 pictures, and the timing between them since the prior photo:

Time, picture, time from prior picture
5:29:20 TA in shower - face photo
5:30:30 TA in shower, lower body, 50 secs
5:31:14 Photo of ceiling lights, 44 secs
5:32:16 TA bleeding, being dragged, JA's foot, 62 secs
5:33:12 TA being dragged, final pic, 56 secs

I think she snapped the close up photo and then dropped the camera because she needed her hands free to get the knife from her pocket or on her person imo. I believe the photo of him when he is sitting on the floor of the shower is also an inadvertent photo taken along with the others.

Somehow in the struggle the camera was perhaps kicked and was left in the hallway.

IMO

It would take a lot of kicks to get the camera where it ended up. Recall that Jodi said the camera rolled toward the bathtub. Now recall the layout of the bathroom. A straight kick would send the camera toward the closet door, not the hallway.

I can't understand why the judge wouldn't stipulate that the defense can put up the photo BUT without the ridiculous outline figure......let the jury see if they can make it out, why does it need to be pointed out to them?

Because it would be confusing to the jury. The Judge mentioned that today. They really wouldn't know what it represented because it is very subjective.

So that is why they just put up the close up photo and stipulated that at that time she wasn't holding a weapon.

IMO

I'm still sticking by that theory too. I can't imagine how or why Jodi's imagination would've made one of the intruders into a female if it weren't true.

I believe that there was a staged burglary around 5:15 (hence the window screen found on the grass in the backyard) just in case a roommate or two came home giving Jodi an accomplice. I believe they both wore ski masks as indicted in Jodi's second story and that's why there were TWO weapons used. I believe Jodi and friend might've been prepared to kill the roommates if they intervened. I further feel, Jodi's grandfather's gun jammed probably due to lack of cleaning/maintenance and gunk built up.

The ONLY reason why she didn't 'throw her accomplice under the bus' as so many people keep saying is........she was pleading for a self-defense case so she wouldn't face the death penalty. And we all know a self defense couldn't have been the true if she had planned for there to be someone with her to carry out the murder.

I also believe Jodi had a disposal cellphone and kept in touch with others that way. I don't believe she went hours without conversing with SOMEONE right before and right after this murder. I always found it odd that she called, of all people, Gus Searcy that night. Why?

So this whole 'person-in-the-eye' evidence might be exactly what Tartlemon is suggesting. Because other than that, why is this substantial? No one is saying Jodi wasn't there.

Edit to add:

Some are saying Flores only suggested the intruder story in order for Jodi to start talking HOWEVER......he also mentioned this possible theory to both her parents so it is my belief that LE really believes Jodi might've had help but doesn't want to go there because it would just cause jurors to start speculating. So instead, they are only going on with what they know and that is, Jodi was there and Jodi killed Travis

I don't believe that. She did this alone. Maybe maybe Brewer had some kind of info?? Or knows something more? But I don't believe anyone was there but her.

It does not matter that she did not have anything in her hand at that point. My guess is that Juan already has an answer for that. That his rebuttal will answer all the questions left hanging by defense theory.

Juan is a smart man. He knows what he is doing. :)

What's the deal with her lately? I know she was the prosecutor for KCL's sister's murder trial & KCL really likes her. I think that it may be a TH thing--they ask her to take the defense position on the air. I know she used to have an office next to Juan Martinez for years. She's a defense attorney now, so maybe that's her on - air persona.

I was disappointed with her on Trisha's radio program last night, too.

I know she has to take sides and is told which side she is going to be arguing for and probably even has a script somewhere to give her a guide, but I thought what she said about Juan and the tweeting was uncalled for. There was talk about her always showing respect for the other side last night on the radio show, but IMO, even uttering the words "nah nah nah boo boo" and directing it toward the man who is fighting for justice for an innocent man and his family, is ridiculous. I thought it was totally classless.

Thud....now I've heard everything.

I'm not understanding it either. But my first take on it is that we all know the Defense is all over the internet reading about the case. It has often been discussed on public forums about whether or not this specific picture shows him scared because she is ready to kill him. IIRC, posters even gave it a shots at doing it themselves and blowing up the pics to see "something". I never did...

I don't know what that really proves for them tho. So what she wasn't holding a gun when she took that picture... We all know that 2 minutes later he was dead, by her hands. I am a believer that he knew something sinister was going on in this picture. Either she showed a weapon or was acting like a crazy lunatic and scaring the crap out of him.

:seeya:

I posted somewhere that I think that Jodi did something to terrorize him--even if it was just him sensing something evil in her demeanor or voice. She creeps me out in the courtroom, so I can just imagine how terrifying she would be if you were literally backed into a corner. She is a reptile.

I wonder if JA has the balls to tweet something again.

I suspect she won't in case Sheriff Joe finds out about it.:floorlaugh:

Seriously, tho - someone upthread said after that came up in court all her tweets were being fast and furiously deleted.

The TH lady on HLN is SOOOOO wrong. "This is a huge win for the defense" STHU!

This is yellow journalism at its finest. How many times has Hln been called to witness stand. They want to be the news rather than report the news. IMO

Slightly O/T Has anyone heard from Weebles? Is her son OK? What about Zuri? Is her family member OK? Are there any others? :( Has everyone checked in?

I pmed Weebles...haven't heard back yet...

Ok, I will just pray that from here on out JM drives home pre-meditation, and leaves no doubt for any of the jury!!!

On another note.. I am watching testimony I missed, and Det. Mendes is adorable, and his voice!!!!!
