She won't, because that is admitting premeditation. Premeditation doesn't fit with her "self defense" claim. :gavel:

Because she says she didn't "plan" to murder him, and the third gas can speaks to "planning" to get in and out of AZ undetected.

I have wondered the same thing about the third gas can. She could just explain that away like she did the other two...that she was just trying to make sure she didn't run out of gas while on her long trip.

Slightly OT but not really. I am so freaking obsessed AGAIN with this case...yesterday I got home and tried to hurry up and pull up WAT on laptop....had my phone streaming and grabbed my Nook with headphones just in case....I was sitting there with THREE - count 'em -- THREE devices streaming the trial all at once.

My daughter said I need an intervention.

I must really need one, I take my iPad in the bathroom. :blushing:

Does anyone else find it interesting that the behaviors ALV attributed to common teenage behaviors and disregarded because they happened only (in her knowledge) when JA was a teen are the same behaviors that this Dr is using along with the same behaviors JA has shown through out adulthood to be immature and teenagerish. I couldn't help but see how badly ALV failed to recognize continueing behavior

I was surprised to hear Dr Drew's panel ( I watch this show now... please see addicted to this trial thread) saying that Dr D seemed rattled at the end of the day? Which BTW was delayed by almost 3 GD hours! Way to go HLN. You Won't MISS A THING!! Yeah I'm an expert on EasyCath Catheters and the Sundowner Ugly-azzed shade screen... but I have to put up with Nancy Grace glaring at me ...with her finger in hear earhole talking OVER testimony ... and Jodi's uh duh duh uh errrr BFF bliddity blaaaahing for 20 minutes to cough up one sentence... Jodi was always so happy and smiling. I love that Nancy claimed BFF was In hiding.... on TV ...with a picture of her on the screen So much ding dang genius goin' on here...:facepalm:

I know this has most likely been discussed but my first time finding this.
Dr. D's laptop was stolen from her home this past February that had info of JA psych profile.
Does anyone have any information on the outcome or know who burglarized her home?

where i live, burglaries rarely get solved. there are just too many of them. this particular one smells, IMO, because of what was stolen and what was on it. but even so, it very well could just be your garden variety burglary.

I hope you get an opportunity to watch her testimony. I think you will change your mind...

The difference in the intellectual level and objective evaluations (thoroughly explained) between this witness and the defense "experts" was profound.

Obviously her age has nothing to do with her competence and knowledge or ability to psychologically evaluate this defendant.

It was so on point I found myself saying "of course! That describes Jodi perfectly."

Actually, I think DD was responding in the same manner as Dr. Horn did to JW's questions. It was almost as if DD does not understand why JW is having an issue. Her CV is what it is as she has not "padded" it with a lot of unnecessary lectures she has done. JW almost sounds disappointed because DD has not given her some examples of lectures so there is something to pick apart such as "Was Snow White a Psycho" or some other catchy phrase. lol

After this trial - Dr. DeMarte will have the opportunity to write an interesting paper about a killer who scored very high on 7 out of 10 clinical scales which is unusual in and of itself. Perhaps once peer reviewed, she can add that paper if published to her CV while adding having actually testified in person as an expert in a DP case.

Wouldn't experience come into play more in a therapist role? DD was never that for JA. She seemed to be acting as a "diagnostician" using established tests containing validity scales to detect lying and data provided directly by Jodi. The results were compared to "the norm" not as RS did to only those diagnosed with a mental issue. Where would experience make a difference at the results obtained? Did experience effect anything DD did or failed to do resulting in Jodi ranking above the scale in 7 of the 9 indicators of BPD? I'm not sure about the last stat.

Yep. DD came to her BPD conclusion by using valid testing. ALV came to her conclusion of battered woman's syndrome and that JA doesn't lie by how JA made her feeeeeeeel.

Quite a difference, huh?

Just pointing out that 32 years old IS very, very young for a testifying "expert." Most experts are at least in their 40's and usually in their 50's and older. The idea being that one is not an expert until they've had quite a bit of practical experience and become established in their field. I didn't watch the testimony yesterday, so this isn't a commentary on how this witness did, at all. Just sayin'...I'm seeing posters get onto the defense for pointing out her age and lack of practical experience, but that IS what makes one an expert -- among other things. Any defense in any case would do this and it would be justified since experience is something the jury should definitely consider in evaluating an expert's testimony. Imo, particularly in a highly interactive and subjective field such as psych. All jmo.

BBM. I think the defense had no choice but to try to attack the short span of DeMarte's professional experience. They don't have much else to work with, and it makes sense that they'd try to emphasize their witnesses' years of experience. I would agree with the gist of your post, but I would say (re the bolded) that it CAN help one become an expert - doesn't necessarily mean it will.

In this case, I think it's obvious that, while the defense experts have many years under their belts, they did not adhere to standard protocols in conducting their evaluations. By contrast, it appears that the state's witness did adhere and did not disregard any professional or ethical standards.

So in this particular instance, I think knowledge and application of standards trumps years of practical experience (especially if RS's and ALV's adherence to professional standards throughout those years was as lacking as it was in this case).

When you get a chance, do watch DeMarte's direct testimony. It truly was riveting. I felt I learned quite a bit about protocol, ethical boundaries and the actual diagnosing of disorders.

The only problem I'm having with DD is that she's not "quick on a comeback".
When Willmott was asking about her CV, she should have said a CV isn't a book. You don't put every single speech, class, case you've worked on....as some "other" witnesses did.
I've always followed the rule that a CV should be no longer than 2 pages, 3 tops.
It's a "brief" synopsis of your accomplishments, and in this case, tests/tools she's utilized in her experience so far. Just IMO.
I agreed with DD when she said she really didn't "use it" that much.
In my experience, most potential employers want to speak to you, as opposed to read your life history. In an interview you expound upon the brief highlights that are in the CV.
DD could have explained that point when Willmott was alluding to the fact that DD didn't feel these "other" courses, etc. she had taken weren't important enough to put in her CV. Also, when you get to a certain level and expertise, often "word of mouth" takes the place of a CV. DD probably had to make up one specifically for this purpose.
As far as the "compassion" part, I would have snuck in that she did NOT feel compassion for their client....so it was REALLY an unbiased assessment. Oh, and no books, cards, tender moments or APOLOGIES!!!



ETA: That's all "shoulda coulda woulda" now....IMO, the point has been made by JM. I'm probably not used to a straight yes or no answer. I'm thinking the other rebuttal points will bring it home for the prosecution....if it could get anymore "home".

BBM IMO a true expert knows that the attorney who originally called them to the stand will take care of stuff like the bolded part above on redirect.

Plus, even the gas cans she admitted to having were to buy cheaper gas outside of California. Only she bought gas in California anyway, pointing out that that whole argument was a lie anyway. No way she can admit to the third gas can.

I have a friend who managed to find a suitable replacement. During a heated discussion about the sexual abuse she suffered at the hands of her grandfather when she was a child, her mother said, "Sweetie, don't you think it's time you let this go?" She was was so outraged she threw the phone across the room with so much force, it hit the wall and burst into a thousand pieces. :rocker:

Just finished catching up with the replay of yesterday's testimony. The choice of Dr. DeMarte was brilliant!!! Not only is she credentialed, bright, and articulate - she is Jodi's age! The physical resemblance to JA is uncanny, except for her beautiful blue eyes, of course. Was this a coincidence, or what? One cannot help but compare and contrast the two young women. It's mind-boggling.

JA' demeanor during Jiuan's direct exam was strange - she never looked at the witness. She kept furiously sketching away as if to deny the existence of Dr. D. No whispering and giggling with JW, no smirks -- nothing. But when it came time for cross-exam, she put the pencil down and began to stare at Dr. D as if she was analyzing her on a personal level. Was JA visualizing herself in the body of Dr. D? Was she lamenting the fact that one of her 'peers' was exposing her for the manipulating fraud that she is? What was going through her mind? Another murder? If nothing else, JA is a fascinating study in psychopathy!

I imagine that JW had told Jodi to keep herself occupied and not whisper and giggle with her because JW was really going to have to pay attention to this witness. :floorlaugh: I think that's the most note taking I've seen JW do since I started watching the trial. Sometimes she even forgot to do her "OBJECTIONRELEVANCESIDEBAR strut strut stomp stomp" routine.

yeah, cuz driving to utah is like crossing the sahara. no gas stations for hundreds of miles. 10 gallons wasn't enough---she needed another can in case?

driving with 15 extra gallons of gas in your trunk makes no sense, no matter how you slice it. plus, it's extremely dangerous. nobody would do that without a VERY good reason----like wanting to cover up a murder. the fear of running out of gas has nothing to do with it, obviously.

i think LE found out about those gas cans early on, probably from DB. she couldn't deny borrowing his 2 gas cans. she just decided to lie about the third one but it's going to backfire on her big time. JMO.
