Whoah...he just cut across the judge.

He is 'moving on'. Wise.

He asked her, "have you discussed this with your husband?"

She answers, "yes, I don't think that's odd..." In a defensive manner. That's the sort if answer you give when you are already anticipating being accused of collusion. I think it makes the witnesses look bad if they are cooperative with one side and not the other. It makes them seem partial.
It's natural to be defensive after the Burgers were accused of colluding with each other. Doesn't mean anything except that she's aware of how Roux implied over and over and over that the Burgers testimony was embellished. I would fully accept Stipps would be anticipating a grilling and to react accordingly. Would be odd not to.

I can imagine listening to a traumatic event and not noticing whether dogs barked or not, because if dogs are always barking in your area then you may not notice them as they are a normal noise that doesn't register.

Thank you judge for upholding Nel's objection!

How? They're not supposed to be watching the testimony, are they?

What a ridiculous thing. Defence saying her memory failed as she 'forgot' the dogs barking, but not producing any evidence the dogs ever barked in the first place.....

The dogs didn't bark, did they?

Wowsa. The longer this witness is on the stand - the more I like her.

My Lady is not appreciating Oldwage's games right now

  • #309
The only thing Oldwage is proving is that he's fluent in Afrikaans.

IMO, I don't think he's proven anything else otherwise.

Yay - My Lady is challenging Oldwage again!

I don't think she's buying what Oldwage is peddling.

this wont do. he still has to knock the screaming on its arse, without that, this is going nowhere.

he really does have to eliminate and erase the screaming.

she explains, as a lay witness. the basic facts are correct. perhaps some time areas, consists of seconds, .

oo. mapisa. translate this word. . it means quieting down..

masipa is that what you were saying> you are saying the nose quietens down>> ??

yes milday. well ..yu can argue that at the end of your defence.

  • #311
I'm so glad the judge is completely on the ball as I've completely lost track of which bits of her statement/testimony he's questioning.

  • #312
OW saying her statement says the screaming 'quitened down' after the last shot. Not that it stopped completely.

AS asks if she can 'defend her statement' and does so.

Judge checks translation, and asks OW what the problem is? 'You saying it's not the same thing? Okay (laughs) You can argue that at the end of the case.'

  • #313
I'd say that would help her credibility rather than harm it... easy to put something into a witness statement because you believe it to be true (hubby saw it) and then realise afterwards that it is more important to give YOUR view and your view only, than to try and explain everything that happened on that night.

I don't think the judge likes Oldwage too much. She is not buying what he is selling.

  • #316
Oldy is oh dear. Masipa again has to interrupt and make him speak clearer..

re the lighted window. you made the assumption that where the man was walking was ehre the shots were coming from?

do you remember the approx. time it took for you to make your affidavit. I cannot recall, ..

perhaps an hour? I cannot recall.

end of evidence.

heh.. Oldy he tried, but ..

Strolling into court, sorry I'm late. I burned my crumpets and had to start the day over.

Another heard screaming witness eh, OP has alot of splainin to do.

  • #318
She pointed out OP's house to security when they arrived, to the house on the left because that was where her husband saw someone walking.

What a ridiculous thing. Defence saying her memory failed as she 'forgot' the dogs barking, but not producing any evidence the dogs ever barked in the first place.....

Maybe the dogs were screaming?.

He is trying to paint her as unreliable and perhaps even dishonest. But I don't think it is working.
