Looks like it's actually a nice, sunny day in SA for a change!

I hope the pathologist being called doesn't mean another day of Oscar's green bucket coming out.

Telegraph is the only one I can find with a stream working at the moment. I don't trust it though. It always freezes for me at crucial moments.

At the BH these words of Nel stuck in my head

"She couldn't go anywhere. You can run nowhere. It must have been horrific."

Nel no doubt will give OP a relentless grilling as when Jackie Selebi took the stand he grilled him for 8 days. He is well respected and has prosecuted the biggest cases in SA and it has been said that neither threats, fame or infamy deters him in his quest for justice.

The prosecution is bound by the rules of criminal procedure but at no time, ever, are they required to disclose their case strategy to the defence. Its protected as work product which isn't mandated by discovery.

They did nothing wrong ethically by not disclosing their strategy or even changing theories.
Thanks Kate, I'm aware of the case strategy procedure, although the boundary of state claim / state strategy appears to have been somewhat expanded by the PT.

It is quite normal for the accused to be made aware of the full claims being made against them, these are set out pretrial. Having the entitlement of presumed innocence reinforces the reason for this. Although elements of OP's prosthesis on/off will be used in strategy, the nature of these being on/off was a major part of the claim. This is exactly why Roux objected. It wasn't so much a legal objection, he just felt he had to make this point clear, as it must have annoyed him.

In all fairness the DT have been far more detailed regarding the events than they needed to be. You're absolutely correct, legally the PT did nothing wrong, although I'm sure it would at least appear to be more ethical if they didn't set out to be quite so obstructive.

Considering the PT pathologist's live testimony was cut I am pleased and surprised that we have the DT's version without censor. Not sure why but lets roll with it.
This could get messy for OP

B: A lot of work was done on this in the past....modern concensus it's a highly controversial, inexact....general concensus, in most people light meal 2-3 hours to be emptied, medium up to 5 hours, heavy meal much longer

Says that there was landmark case in Canada 'Truscott'.
