I've poured through SA's rules of criminal procedure but can't ascertain whether they actually have reciprocal discovery or not. State's obligation on discovery is very clear - defense, not so much.

For me the most fascinating difference is that it doesn't matter legally if he intended to kill Reeva or an intruder as long as intent is proven itself. Makes a heckuva change from castle, SYG, and other domiciliary defenses with which I'm familiar.

That's not quite how the law or intent reads to me, speaking of SA law, specifically.

OT but...

Since last year I have only been able to thank one poster per page. If I try to thank another I must refresh.

Anyone else have this problem?

That sometimes happens to me. The the thanks button will disappear.

Links to the vid have already been provided upthread .. they make a comparison with shooting the melon to it being softer than brains when you shoot at it.

I saw that, but we don't know (and can't know) who was speaking.

That only happens to me when people have replied after I've posted something but all the thanks buttons then reappear when I've refreshed.

I spent a bunch of time tonight re-watching Oscar on the stand from these past few days. I listened to every second, I rewound, listened again, I paused... I gave him every benefit of the doubt. I was really hoping that he would give me a reason to believe in his version of events.

I can pretty darn comfortably state at this point that I believe he is straight up lying. His story is total BS.

There are about 100 reasons why I feel this way but it's 2:25am so I'm not even going to try to articulate them.

Lisa, I'm listening to experts say that Nel is right in this current argument over the video because of the good character evidence that Roux put before for the court yesterday. I can't recall what that evidence was & the experts aren't saying. Can you recall what it was?

Perhaps I worded it poorly. However:
The state can prove the direct intention by proving that the accused actually meant to kill the deceased. Evidence that the accused and the victim were involved in a stormy argument before the killing or that the accused had previously threatened the life of the victim could be important.

The state can also prove intention via the concept of dolus eventualis. This form of intention exists where the state can prove that while the accused might not have meant to kill the victim, he nevertheless foresaw the possibility and nevertheless proceeded with his actions. “Jub Jub” Maarohanye and his co-accused Themba Tshabalala were convicted of murder on the basis of dolus eventualis as the court found that they foresaw that their reckless driving in a built up area might lead to the killing on innocent bystanders.

I am not sure that is how OP is going to respond. I think his competitive nature may kick in, and he may stand nose to nose with him, like Arias tried with Martinez.
We only got a few minutes.. but I started to think OP would be OK..... but he is naive ... Nel <modsnip> easily trapped him into asking to see this silly video that OP obviously had no idea about.
Apart friom what else I have mentioned, I think Nel is showing signs of being a bully. :)

O/T: I didn't think bullets worked with zombies or vampires?

I'm a big TWD fan. According to that show bullets only work on Zombies if you hit the brain.

For a vampires I think you need a silver bullet to the heart.

He showed a youtube clip showing OP and Reeva being quite affectionate inside a small store.

Whatever it was it happened yesterday, experts are saying Roux introduced good character evidence yesterday which opens up the door
