If I was under oath and someone said 'Have you heard of a crappy before?' I'd say no. If I then saw an old video of myself saying 'I feel a bit crappy today,' I wouldn't consider myself to have lied under oath.

Perhaps I worded it poorly. However:
The state can prove the direct intention by proving that the accused actually meant to kill the deceased. Evidence that the accused and the victim were involved in a stormy argument before the killing or that the accused had previously threatened the life of the victim could be important.

The state can also prove intention via the concept of dolus eventualis. This form of intention exists where the state can prove that while the accused might not have meant to kill the victim, he nevertheless foresaw the possibility and nevertheless proceeded with his actions. “Jub Jub” Maarohanye and his co-accused Themba Tshabalala were convicted of murder on the basis of dolus eventualis as the court found that they foresaw that their reckless driving in a built up area might lead to the killing on innocent bystanders.

Yes, apparently it will be a bit more subjective. I don't think culpable homicide is out of the question. From what I've read he could very well be found guilty of that. I don't think he will be acquitted.

Lisa, I'm listening to experts say that Nel is right in this current argument over the video because of the good character evidence that Roux put before for the court yesterday. I can't recall what that evidence was & the experts aren't saying. Can you recall what it was?

My brain is a little fried right now but a few that come to mind are OP talking about his charitable work. Also when Roux asked him if he has ever come to the aid of someone and he told stories about how he helped a woman in distress, rescued a man being beaten up in the road, etc. That type of stuff.

A few years ago, a man shot his teenage daughter because she woke him, coming into the house from a date. In his waking stupor, the Father thought she was a burglar.

I think the same happened here. In a crisis situation, real time is irrelevant. The perception speeds it up or slows it down.

You must have missed all the awards he's got, the work he's done with children etc although it wasn't yesterday as that was xxxxx :) baba day.

I think its pretty unlikely too. Lots of legal experts seem to feel CH at a minimum because of his statement alone. CH can happen...but only if he can prove putative self-defence. Yet another subjective arena none of us can predict.

I'm a big TWD fan. According to that show bullets only work on Zombies if you hit the brain.

For a vampires I think you need a silver bullet to the heart.

Silver bullets are not usually lethal for vampires.

Wooden stake in the heart does the trick.
