N is explaining that he did not take a lot of notice of Stipps' evidence.

  • #122
And I'll bet the difference is that this fellow had doors and windows closed and AC on.

  • #123
This guy slept with all doors closed and locked....bedroom doors locked......e

Nel: Did you hear any sounds that might have been the cricket bat?

N: I didn't hear any bangs or anything like that. Neither did my wife.

Cross-X:
Nel asked if N followed the matter. N has. Nell asked if he's picked up anything different to what he gave in his statement. Van Aart asked if he needed to add anything further to his statement. No.

Nel: It was a terrible evening? N - Yes.
Nel: You know all the contentious issues in the case? N says he's closes neighbour. He won't come to court and say he's not following the case. Knows the whole world is watching.
Nel: Re contentious issues. N wants to know other things other people have heard. He was sleeping. Didn't heard.
N never heard any shots.
OP's version is he fired shots, then used bat to break door. Did you hear bat sounds. He didn't hear that sound. Was running around the house at that time. Wife didn't hear breaking down of door either.

Didn't hear any screaming. Didn't hear shots. Didn't hear cricket bat.

So, why is he testifying? ;) Other than to tell us how emotional Oscar was after shooting his girlfriend to death, discount what prosecution witnesses testified to hearing, and how rude South African police were?

Nel. did you hear any evidence of the cricket bat??

Mr N.. I didn't hear it. it may have been while I was running around the house checking, upstairs, downstairs..

Nel. as far as you know, your wife didn't hear cricket bat sounds either?

Mr N.. no she didn't say. she didn't say she did to me.

Nel. can you explain to me what you mean by crying?

Mr N... I heard the man that was crying.. I .. I cant say it was screaming. he was crying very loud.. .. one can cry loudly.. he was .. it was crying..

Nel.. when we consulted, you never heard anyone scream??

Mr N.. I don't know. I call it crying.. let me clarify.. in our language. he uses sotho words, . he explains it sort of.. the difference.. a word for crying a word for screaming..

Nel. you never mentioned screaming ,??

Mr N.. no. I never.

Nel: Explaining what you mean by crying...during our consultation, you never differentiated...you never heard somebody scream?

N: It depends what you mean by screaming...in terms of screaming...

He is now talking about the words in his language for screaming, but agrees he never mentioned someone screaming, eventually.

Point to remember : this is the house that the Stipps testified was completely lit up when they heard the shots and looked across

This witness is dabbling in a bit of "oscar speak" if Im not mistaken

So much for Roux's statement that OP's neighbour heard screaming (ie OP screaming like a woman). Mr N only heard crying which we know happened. Another lie from Roux during earlier testimonies. How does he get away with it?

Witness now explaining how they leave their lights on in bedroom passage for 'a bit of light' and a light on downstairs, by his son's room and on the stairs. Also how he tells his daughter 'When you sleep, you lock your door.'

IIRC he heard loud (and later softer) high pitched crying, but he also explained with Nel that distinguishing between screaming and crying is subjective.

Mr N.. it was difficult to relate the sounds to any specific house at the time, it seemed to come from everywhere.. I couldn't at the time it began pinpoint where the sound was exactly coming from.

Nel. now. its Oscars version, he screamed as loud as he ever has.. ( what he said was, he has never screamed like that before, Nel has to find the exact wording, the judge says, so its a bit of a shuffle )

Roux and Nel asked what he meant by crying. N never heard screaming. Heard man crying very loud.
Nel: In making statement and consultation you never mentioned screaming. N says he didn't.
N always leaves some lights on otherwise pitch dark because they have a baby. Fluoro light always on on ground floor. Light also on his stairs and elsewhere.
Daughter always locks her door.
Nel: When you heard bang and crying, you didn't relate it back to OP's house?
N: Heard the crying. Couldn't relate to anyone. Went upstairs. Thought it was probably coming from a neighbour's. No-one in house on left of his house.
Nel: OP said he screamed as loud as he'd ever screamed.

and If I am correct Michael just testified earlier it was a man screaming. He did mention high pitched or the like..

so unless the neighbor was the wife?

N explains that he did not immediately know if the noise was in or outside his house as left side of his house was still under construction.

No Nel's said something, Roux wants evidence and Nel has to find it and complains he can't do it with all eyes on him

'I'll look away then,' says Judge.
