Roux: It deals with relevance. It's for the Court to decide the weight it's to be given.

Masipa: What she saw and heard from the accused. They go together.

  • #282
Judge: I think they go together, what she heard, and what she saw from the accused...

Nel says he doesn't think it's relevant.

Judge says it is relevant because Nel brought up emtions when crossing OP.

Nel says it's relevant to the charges.

Masipa disagrees. She said Nel said "You're not using your emotions as an excuse are you?"

She saw a heartbroken man, he cried. He talked about what they planned for the future, his loss, their family. She saw a heartbroken man suffering emotionally.

Nel says the evidence should be relevant to the charges. Judge Masipa says she thinks it is relevant, reminding Nel of when he accused Pistorius of using his emotions.

IS: I saw a heartbroken man, crying 80 per cent of the time. Talked about their plans for the future, her family....I saw a heartbroken man.

She submitted weekly progress reports, which are in court.

Oh my....Roux must be really really hard up for expert witnesses...lol

Alex is in Nigeria reporting on the abducted school kids... a very pressing and worthwhile assignment to her, methinks.

A very worthy and righteous cause. CNN's Isha Sesay is reporting from in country (she's American, of Sierra Leonean background), and you can see the pain in her face when she reported tonight. Someone's got to stop the crazy animals who made that video. This uncircumcised pork-eating infidel does NOT represent Islam in any way.

  • #288
She supplied progress reports on a weekly basis. Roux produces same.

Sorry I missed some, who is this witness?

  • #290
OK, that's total BS, she opened her "evidence" with that acting lesson that was only in the media as her whole reason for wanting to come forward...

  • #291
Yeah, this kind of evidence wouldn't normally be allowed IMO but Nel did open the door by suggesting that OP's emotional breakdowns were fake

  • #292
I wonder what her employer thinks of her PROACTIVELY inserting herself into this trial two days ago!

  • #293
I think the judge is wrong here. I shall be very interested to hear what the lawyers on WhoopWhoop have to say.

  • #294
Grrrrrrr!!! a Social Worker/Probation Officer coming forward, for the DT, due to her own subjective feelings. Unprofessional.

Judge thinks it's relevant.

Recognise the professional from the personal feelings IMO.

I can't listen, :(

But for "anxiety" to delay Reeva's gastric emptying for so many hours, if my calcs are correct, and using Saayman's 2-3 hours to digest a light meal as a starting point, wouldn't that mean Reeva and OP would have had to have been arguing solidly from around 8:00pm, latest 9 or 10pm (by 11 according to Saayman's testimony gastric emptying would have already taken place so too late for anxiety to delay it), onwards until her death at around a quarter past 3:00 pm ?

And how does that fit with internet connections, texts, etc. or any witness testimony. And would Reeva argue for, according to my calcs, at least 5 hours (that's one hell of an argument) just 3 months into a relationship or would she up and go, or at least call a friend for support or to come and collect her.

I'm not sure the PT made that specific inference. I understood the point to simply be that it could be due to anxiety/arguments, something that OP denied happening.

You could then reason it's possible that OP and RS ate at a later time but earlier than the ~2 hours indicated by the pathologist and that the gastric emptying was then affected by anxiety or stress.

Dates of reports

March 1st. Mental health/emotional state of accused.

Feb 25th. progress. mental health/emotional state. OP seeing a psychologist. probation officer had daily contact with accused. he was very cooperative.

Feb 28th OP tested for 'substances'. Negative.

A defense attorney really has an obligation to present all evidence that will benefit the accused. In this case, Nel taunted OP about his emotional outbreaks and questioned why he was getting emotional at certain points and suggested that he was faking it or using it as an excuse.

It would be negligent not to address this if there's evidence available.

I was quite disappointed with her last OP report. I intensely dislike bias in journalistic reports but it seems to be everywhere. I think they should be required to produce a factual report only in court cases. Pigs flying springs to mind!

I've noticed it on the Sky News 'round up of the day in court' broadcast at 9:30pm every day of the trial .. she seems to be most pleased with herself about the way Oscar speaks with her, I was fairly horrified when I first heard the way she referred to it .. I just thought to myself, this bloke has killed another woman with 4 bullets and you're falling at his feet ?? !
