Wolly is getting highly agitated, he feels like a man put upon, blamed for something he had no control over, , an innocent bystander.. he is not a happy man..

Nel says. you wouldn't take Dixons advice on ballistics??

Woll says, no. he isn't a ballistic expert..

Nel.. so. you are not a sound expert. yet you expect the court to take your testimony as to your sound test as kosher?? ( my word, I cant think of the proper word) ..

Woll. well. well. the contents of my report has never changed, except if Mr Dixon told me something I changed things.

Nel. did you consult with the accused??

Woll es. for not more than an hour, hour and a half. I took a measurement of the height of his arm with legs and without legs. but up until today, it hasn't been discussed WITH the accused. he has been THERE doing consultations, but I hve not consulted WITH the accused..

Nel. what questions were asked of the accused at these discussions?? ( naughty Nel) .

In his high school yearbook, he was voted Most Likely to Have His Expert Testimony Impeached.


Interesting. He has not done well in recent cases but I thought (according those in the know in SA) that, in his time, he has been very good. It seems maybe he was not as good as was thought or that the expertise in SA, at that time, was so poor that he appeared to be very good.

In his time Wollie was said to be very good but he is now well past his best. He will know everything there is to know but is no longer able to satisfactorily deal with being an expert witness or be cross examined. Time to retire methinks.

I don't think Wollie is up to this (IMO possibly because of cognitive decline). I also feel that, as a result of this, he lacks insight into his deficits. That's what make me feel embarrassed for him.

I think that the DT should take the responsibility for this particular fiasco. If Wollie's recall of his dealings with the DT is accurate, the DT is very remiss in not insisting on written, detailed, signed reports. After all, what are they being paid for??

W: er I met...with advocate Kenny O-I waas very-looking for the right English word-I wasn't aware of what I was doing, I brought a photo of the deceased and the accused vomited and went out of the room and never came back..

N accuses W of bias and W objects to that strongly.

Nel: He has never consulted with the accused what happened that night.
Nel asks if the shooting was discussed in your presence and in the accused's presence.
W, in the presence of Oldwage, brought up a photo of the deceased. OP then left and was vomiting.
Nel asked why OP was vomiting. OP never returned.
Nel says you're biased.
W says he's here to assist the court and takes exception to Nel's comments.

His respiration is going up and so is his blood pressure, but he's not getting enough oxygen, so he's yawning. It's a stress reaction. The witness is totally ******ing his defense.

oh dear. its got to real weepy stuff now. Wol is claiming he is here to help the court, whatever it takes, Nel is on him like a beagle to a fox. you are saying the court has never rejected your 'advice'??? here we go, a long story of how Woll has no idea. ., nel gently reminds him of previous occasions.

(Nel asks W whether any of his work has ever been rejected.)

W W W WHen I was there, th th they were told me me me I I had wor work that that was rejected. Nel: I do. It was the ______ case where you testified that the right-handed man would shoot himself in the left cheek.

Oh gosh. W has given Nel an opening to bring up a previous case where his evidence was rejected.

W: I can't remember what it was...

N: I'll help you. It was ??? Where you testified a right handed man could shoot someone in the left cheek...

(I may have got right/left confused there)

W now explaining how he was told his evidence 'wasn't really rejected'.

Nel moves on, with an apology for 'being sidetracked'.

N: You did a reconstruction...took photographs? I'm sure you submitted a report?

W: Not a written report..

Nel lost track. Goes back to if W consulted with Oscar again.

N: On 8 March 2013 you went to the crime scene. Mangena was there?
W: 100% correct. W made observations and took photos. W did a verbal confirmation of what was done there, not a written report.
