It doesn't seem right to me that Nel doesn't get her report until she walks into court.
 
N: It's relevant. The disorder. To the facts?.....that is the correct answer Dr, but I'm just trying to see if we can learn something from all your experience over they years...

and Nel back to trying to get court to refer OP to an institution, witness struggles against that but gives up and says 'it's up to the court'.

Adjourned until 1.14pm and that will include time for lunch.
 
Nel's going great. "You can't have your cake and eat it" which is what the DT is trying to do with this witness.
 
The major link is depression. I suffer from both, my anxiety triggers panic attacks. I DON'T try to control my environment, I'm not arrogant & I don't have an ego. I don't go gallivanting around, if anything I withdraw from the company of others. If I was talented enough to compete in a competitive sporting environment, I would never be able to compete because the effect of the competitive environment would make my anxiety uncontrollable. I call BS to this testimony from first hand experience. He may have anxiety now because of the experience he has experienced because of his actions but not prior to that.

I thought the article was worth reading for people to understand what she was testifying. I did not imply anything else other than it can be associated with other psychological disorders.
 
Right. I'm lost. So Nel is suggesting that Oscar be sectioned? I'm confused about what's happening . . .
 
do they not check [pre-trial] that the accused is [medically/mentally] fit to stand trial in sa?
 
It appears that Nel is covering all bases to make sure OP wasn't mentally incapacitated and if he was then that should have been his defence.
 
Oh..oh ...looks like OP is going on a holiday (from booze, ladies, the range ..) for 30 days or more.
 
Gosh, is it possible OP will end up being carted off to join Dewani in that big secure hospital at the end of this session?
 
a.hahah.. Nel is making this Doctor either claim a definite or move on. if Oscar has a mental illness that resulted in the killing of Reeva, Nel wants that one laid to rest or barking like a mad dog right now, this day.. if he has the same sort of general psychiatric disorder that EVERY SINGLE PERSON labours under, lets get this show on the road.
 
Nel has put OP's defence between the fire and the frying pan, I think.

1: Mitigation that he was mentally ill means he goes straight to an institution for examination

2: Or, mental illness cannot be used as any sort of mitigation.
 
Just a reminder that Janet Henzen-du Toit, one of the Assessors, has an Honours degree in psychology and Master's degree in criminal justice and criminal prosecution. She is working on a doctorate in criminal law, criminal prosecution, evidence and constitutional interpretation.

I was surprised to read that M'Lady got to appoint her own assessors. I can see some real problems, in general, with that policy.

Themba Mazibuko and Janet Henzen-du Toit were appointed by Judge Masipa before the trial began.
 
Well, we saw that coming with this witness, and the defence walked straight into it.

Seems like it's now S77, mental illness, or is it murder, premeditated?
 
yes, she has inferred that his physical attributes of sweating and retching ipso facto means the emotion is genuine.. .

Nel wont have that, I don't think.
 
Why didn't Roux see this coming? Or is it a complete surprise to him that The Pitbull plays very rough?
